New General Permit for the Reclamation of Forfeited Noncoal Mines (GP-106)

 The Department of Environmental Protection (Department) has issued a new general permit that authorizes the extraction of noncoal minerals to facilitate the reclamation of sites that have previously been forfeited prior to reclamation.

 The Department is authorized under section 26(b) the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. § 3326(b)) and 25 Pa. Code Chapter 77, Subchapter J (relating to general permits) to initiate and issue general permits for any category of noncoal surface mining activities if the Department determines the activities in the category are similar in nature, the activities in the category can be adequately regulated utilizing standardized specifications and conditions, and the activities in the category, in the opinion of the Department, are more appropriately regulated under a general permit than under individual permits.

 Notice of the availability of the draft General Permit 106 (GP-106) was published at 49 Pa.B. 1854 (April 13, 2019). A 30-day comment period was provided. The Department received comments from one individual during the comment period, but no substantive changes were made to the final GP-106.

Registration and Information Requirements

 The new GP-106 will become effective on June 27, 2020. To qualify for coverage under this general permit, a licensed mine operator must submit a complete Notice of Intent (NOI) form (5600-PM-BMP0454) to the appropriate District Mining Office with jurisdiction in the area of the proposed project. A fee of $725 will be required for coverage under this general permit upon submission of the NOI. If approved, the operator will receive written notice of coverage under this general permit effective for 2 years (unless an extension is granted).
