LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office. The renewal permit includes additional operation requirements, monitoring requirements, and recordkeeping requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

16-00141: Kahles Kitchens, Inc. (7488 Rte 36, Leeper, PA 16233-3628). On October 26, 2020, the Department issued the renewal State Only Natural Minor Operating Permit for the kitchen cabinetry manufacturing facility located in Farmington Township, Clarion County. The primary sources at this facility are the surface coating operations. Other sources of emissions include a wood-fired boiler, natural gas-fired boilers, and internal combustion engines. The potential emissions of the primary pollutants from the facility after permit limitations are as follows: 9.93 TPY (tons per year) NOx, 13.77 TPY CO, 35.00 TPY VOC, 19.64 TPY total HAPs, 2.69 TPY PM-10, 2.33 TPY PM-2.5, and 1.34 TPY SOx; thus, the facility is a natural minor. The facility is limited to 35.00 TPY VOC, 24.90 total HAPs, and 9.9 TPY for any individual HAP per plan approval 16-141A. The surface coating booths are subject to 25 Pa. Code §§ 129.52 and 129.101—129.107 for control of VOC emissions from surface coating processes and wood furniture manufacturing operations. The parts washer is subject to 25 Pa. Code § 129.63 for degreasing operations. The engines are subject to 40 CFR 63 Subpart ZZZZ, NESHAP for Stationary Reciprocating Internal Combustion Engines. The renewal permit contains emission restrictions, recordkeeping, work practices, and additional requirements to ensure compliance with the Clean Air Act and the Air Pollution Control Act.

37-00271: Allegheny Mineral Corporation Princeton Plant (P.O.  The project will result in a total of 15 LF (149 SF) of permanent and 405 LF (3,721 SF) of temporary stream impacts, 1,071 SF (0.0246 acre) of permanent and 27,026 SF (0.6204 acre) of temporary floodway impacts and 3,128 SF (0.0718 acre) of permanent and 70,463 SF (1.6176 acres) of temporary wetland impacts all for the purpose of constructing a natural gas pipeline for Marcellus well development.

EROSION AND SEDIMENT CONTROL

 The following Erosion and Sediment Control permits have been issued.

AIR QUALITY

Northwest Region: Air Quality, 230 Chestnut Street, Meadville, PA 16335-3481, 814-332-6945.

10-00021: In accordance with 25 Pa. Code §§ 129.96—129.100, the Pennsylvania Department of Environmental Protection (DEP) has made a preliminary determination to approve an alternative Reasonably Available Control Technology (RACT II) plan and seeks an approval of an amendment to the State Implementation Plan (SIP) for INDSPEC Chemical Corporation, in Petrolia Borough, Butler County and in accordance with 25 Pa. Code § 127.521, the Department of Environmental Protection intends to modify the facility operating permit. The facility is located at 133 Main Street, Petrolia, PA 16050. The facility's representative to contact concerning this application is Ned Palmer, Site Manager. His phone number is 724-756-9849. The facility was a major source of NOx and VOC emissions. The facility's air emission sources previously included boilers, process heaters, kilns, dryers, reactors, tanks, emergency generators, control devices, and other ancillary equipment. On July 31, 2017 production ceased for all organic resin products at the facility, with all intermediate production and utility operations ending by September 22, 2017. Most of the sources were permanently shut down as of September 11, 2017. The facility is now considered a minor source of all air pollutants.

 The modification includes the ERCs approved for the shutdown sources, the over control of Source 235, and removes two engines no longer in use (180 emergency generators and 180D air compressor). In addition, the facility requested removal of Source 169—Sodium Sulfate Product Loading at the Copeland; Source 238—Tank Number T-3069; Source 270—V-8 X-Factor; and, Source 280—V-9 X-Factor. These sources are no longer required, have been emptied, cleaned and rendered unusable.

 The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997, 2008 and 2015 National Ambient Air Quality Standard (NAAQS) for ozone.

 The proposed amendments to the RACT II determination, if finally approved, will be incorporated into a revised operating permit (10-00021) for the facility. The relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal; this includes the provisions of the Department's presumptive RACT II requirements in accordance with 25 Pa. Code § 129.97, as they apply to existing sources at this facility.

 The following is a summary of the proposed amendments to the RACT II determination for this operation that will be submitted to the EPA as a SIP revision:

Public hearing In accordance with Governor Tom Wolf's emergency disaster declaration on March 6, 2020, and based on advice from the Department of Health regarding the mitigation of the spread of the novel coronavirus (COVID-19), the Department will offer a virtual public hearing to receive comments on the proposed SIP revision on December 10, 2020 at 1 p.m. Persons wishing to join the hearing may do so remotely.
