THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department of Environmental Protection (DEP) has taken the following actions on previously received applications for new, amended, and renewed National Pollutant Discharge Elimination System (NPDES) and Water Quality Management (WQM) permits, applications for permit waivers, and Notice of Intent (NOIs) for coverage under General Permits, as listed in the following tables. This notice of final action is published in accordance with 25 Pa. Code Chapters 91, 92a, and 102 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). The official file for each listed action can be reviewed at the DEP or delegated County Conservation District (CCD) office identified in the table for the action. DEP/CCD office contact information is listed as follows for Section I and is contained within the table for Section II. Additional information for permits issued under 25 Pa. Code Chapters 91 and 92a and Individual permits under 25 Pa. Code Chapter 102, including links to Individual Chapter 92a NPDES and WQM Permits, may be reviewed by generating the ''Final Actions Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law).

 The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, 717-787-3483. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law. For individuals who wish to challenge an action, the appeal must reach the Board within 30-days. A lawyer is not needed to file an appeal with the Board. Individuals who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at 717-787-3483 for more information. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at 717-787-3483. Important legal rights are at stake, however, so individuals should contact a lawyer at once.

 For actions taken on applications for pipelines that are regulated by the Federal Energy Regulatory Commission (FERC).

 Any person aggrieved by this action may challenge it in an appropriate legal forum. The State and Federal courts are currently split on whether the proper forum to challenge a Department permit, authorization or approval for a facility or activity subject to the Federal Natural Gas Act, 15 U.S.C.A. §§ 717 et seq., is the United States Court of Appeals for the Third Circuit or the Pennsylvania Environmental Hearing Board. See Delaware Riverkeeper Network v. Sec'y, Dep't of Envtl. Prot., 833 F.3d 360 (3d Cir. 2016); Delaware Riverkeeper Network v. Sec'y, Dep't of Envtl. Prot., 903 F.3d 65 (3d Cir. 2018), cert. denied, 139 S. Ct. 1648, 203 L. Ed. 899 (2019) and Cole v. Dep't. of Envtl. Prot., 1577 C.D. 2019 WL 2420667 (Pa. Cmwlth Ct. June 15, 2021) (Pet. for Allowance of Appeal pending); West Rockhill Twp. v. Dep't of Envtl. Prot., No. 1595 C.D. 2019 WL 2426014 (Pa. Cmwlth. June 15, 2021) (Pet. for Allowance of Appeal pending).

HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF

PUBLIC NOTICE OF PROPOSED PROSPECTIVE PURCHASER AGREEMENT

Commodore Semiconductor Superfund Site, Van Buren and Rittenhouse Rds., Audubon, PA 19403, Lower Providence Township, Montgomery County.

 The Department of Environmental Protection (Department), under the authority of the Pennsylvania Hazardous Sites Cleanup Act (''HSCA'') proposes to enter into a Prospective Purchaser Agreement (''PPA'') with 960 Rittenhouse Road Associates LLC (''Purchaser''), 338 Sun Valley Drive, Ambler, PA 19002. The property at issue is located in Lower Providence Township, Montgomery County.

 Purchaser intends to purchase real property located at 960 Rittenhouse Road (the 960 Property) for commercial or industrial purposes, which will result in beneficial reuse of the 960 Property. The 960 Property is located within the Commodore Semiconductor Superfund Site (''the Site''). This site was added to the United States Environmental Protection Agency (''USEPA'')'s National Priorities List in October 1989. USEPA divided the Site into three Operable Units for purposes of cleanup. Operable Unit 3 consists of the 960 Property.

 In 2013, offsite investigations were performed at the 960 Property to better define upgradient contamination. The results indicated a localized volatile organic compound (''VOC'') source not associated with what was previously understood by USEPA to be the source of contamination at the Site. Previous testing and studies at the 960 Property have identified the presence of VOCs in soil and groundwater, as well as the presence of certain metals in soil.

 As part of its responsibility under HSCA, the Department has incurred and will continue to incur response costs with respect to the Commodore Site and/or 960 Property, authorized and recoverable under Section 507 of HSCA, 35 P.S. § 6020.507. The Department has determined that, upon acquisition of the 960 Property, Purchaser could become a potentially responsible person within the meaning of Section 701(a) of HSCA for the releases or threatened releases of hazardous substances or contaminants at the Site and/or the 960 Property. Purchaser has represented to the Department that it has not caused, contributed to, or is not otherwise liable under environmental law for the Existing Contamination at the Site or at or from the 960 Property. Existing Contamination includes any and all releases or threats of releases of hazardous substances and contaminants identified and addressed or intended to be addressed at the Site as of the effective date of the PPA. In accordance with the proposed PPA, Purchaser intends to complete a removal action consisting of excavation and offsite disposal of soil contaminated with VOCs at the 960 Property. The Purchaser will also record an environmental covenant on the deed of the 960 Property. Purchaser desires, through the PPA, to resolve any potential liability it may have upon purchase of the 960 Property.

 This notice is provided under Section 1113 of HSCA, 35 P.S. § 6020.1113, which states that, ''settlement shall become final upon the filing of the Department's response to significant written comments.'' The PPA is available for public review and comment. The DEP may approve or disapprove plans and reports submitted. This notice provides DEP's decision and, if relevant, the basis for disapproval.

A drainage system and riprap channel will be constructed to control the discharge and lower the mine pool to a safer elevation and eliminate the risk to public health and safety. The wetland is being created by the acid mine drainage discharge and due to the location of the wetland, impacts could not be avoided. This project will permanently impact 0.2 acre of wetland. Available water quality data indicates that the wetland meets elevated total metal levels (pH < 5.0, Aluminum > 0.6mg/l, Iron > 7.0 mg/l, and Manganese > 4.0 mg/l) required for a Waiver 16—Restoration Activities. Notice of Public Meeting

 Notice is hereby given the Pennsylvania Department of Environmental Protection (DEP) District Mining Operations, has received an application for a new large industrial minerals (noncoal) surface mining application from Bishop Brothers Construction Company, Inc., for the Minard Mine. The Permit Application Number is 08230301. The application is to commence surface mining of sandstone and sand and gravel. The proposed mine expansion is located within Athens Township in Bradford County.

 The proposed permit is near the Environmental Justice area of Athens Borough therefore the Moshannon District Mining office has scheduled a public information meeting concerning this application. The meeting will be held at the Athens Area High School Auditorium, 401 W Frederick St, Athens, PA 18810, on Monday July 31, 2023 starting at 6:00 p.m. and ending at 8:00 p.m. Attendees may bring written comments to the meeting and give them to DEP staff, or they may make a verbal statement of no more than three (3) minutes duration at the meeting. DEP staff will be available at the meeting to answer general questions about the permit application.

 Notice is hereby given that the Pennsylvania Department of Environmental Protection (DEP) will hold a public hearing on Tuesday, July 25, 2023, beginning at 5:30 PM at the F.W.  The purpose of this hearing is to take testimony concerning the Roulette Oil & Gas Company, LLC (ROGC), application to convert the Clara Field # 20 gas well into an oil and gas waste disposal well (solely for ROGC conventional well waste) in Clara Township, Potter County. The U.S. Environmental Protection Agency (EPA) issued an Underground Injection Control Permit (PAS2D050BPOT), effective January 14, 2022, to authorize the operation of the Class II-D Injection Well.
