 On February 15, 2024, the Independent Regulatory Review Commission (Commission) received this regulation from the Pennsylvania Gaming Control Board (Board). This rulemaking amends 58 Pa. Code Chapters 617b, 623b, 627b, 629b, 631b, 633b, 635b, 639b, 641b, 643b, 645b, 647b, 649b, 653b, 655b, 657b, 659b, 670b, 685b, 687b, 688b, and 689a. Notice of proposed rulemaking was omitted for this regulation; it will become effective upon publication in the Pennsylvania Bulletin.

 This final-omitted rulemaking adopts existing temporary regulations related to table game rules and procedures into final-form regulations.

 We have determined this regulation is consistent with the statutory authority of the Board (4 Pa.C.S. §§ 1202(b)(30) and 13A02(1) and (2)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Technical Revisions for Statutory Consistency,
Clarity and Modernization
Regulation No. 63-08 (# 3385)

 On January 24, 2024, the Independent Regulatory Review Commission (Commission) received this regulation from the State Ethics Commission (Commission). This rulemaking amends 51 Pa. Code Chapters 11, 13, 15, 17, 19, 21, 23, and 25. Notice of proposed rulemaking was omitted for this regulation; it will become effective upon publication in the Pennsylvania Bulletin.

 The final-omitted regulation consists of technical revisions necessary for statutory consistency, clarity, and modernization to regulations that have not been updated since 2001.

 We have determined this regulation is consistent with the statutory authority of the Commission (65 Pa.C.S. § 1107(1); 45 P.S. § 1204(3)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Environmental Hearing Board—
Practice and Procedure
Regulation No. 106-14 (# 3377)

 On June 6, 2023, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Environmental Hearing Board (Board). This rulemaking amends 25 Pa. Code Chapter 1021. The proposed regulation was published in the June 17, 2023 Pennsylvania Bulletin with a public comment period ending on July 17, 2023. The final-form regulation was submitted to the Commission on February 15, 2024.

 This final regulation amends the rules of practice and procedure of the Board to provide the Department of Environmental Protection (Department) and persons challenging Department actions before the Board with more specific guidance on how to represent their interests. The purpose of the amendments is to make practice before the Board more efficient by reducing paperwork and less costly by avoiding the need for litigation over interpretation of the rules.

 We have determined this regulation is consistent with the statutory authority of the Board (35 P.S. §§ 7515(c) and 691.307(b), 27 Pa.C.S. § 7708) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

State Board of Medicine—
Registration of Naturopathic Doctors
Regulation No. 16A-4953 (# 3324)

 On November 30, 2021, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the State Board of Medicine (Board). This rulemaking amends 49 Pa. Code Chapters 16 and 18 and adds Subchapter M to Chapter 18. The proposed regulation was published in the December 18, 2021 Pennsylvania Bulletin with a public comment period ending on January 18, 2022. The final-form regulation was submitted to the Commission on January 18, 2024.

 The rulemaking implements the Naturopathic Doctor Registration Act (63 P.S. §§ 272.101—272.301), establishes fees for initial registration and biennial renewal of registration and removes outdated provisions of the Board's regulations relating to ''drugless therapists.''

 We have determined this regulation is consistent with the statutory authority of the State Board of Medicine (63 P.S. §§ 272.202(6), 272.203(b) and 272.207 and 63 P.S. § 422.8) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
