THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department of Environmental Protection (DEP) has taken the following actions on previously received applications for new, amended, and renewed National Pollutant Discharge Elimination System (NPDES) and Water Quality Management (WQM) permits, applications for permit waivers, and Notice of Intent (NOIs) for coverage under General Permits, as listed in the following tables. This notice of final action is published in accordance with 25 Pa. Code Chapters 91, 92a, and 102 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). The official file for each listed action can be reviewed at the DEP or delegated County Conservation District (CCD) office identified in the table for the action. DEP/CCD office contact information is listed as follows for Section I and is contained within the table for Section II.  Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law).

 The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, 717-787-3483. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law. For individuals who wish to challenge an action, the appeal must reach the Board within 30-days. A lawyer is not needed to file an appeal with the Board. Individuals who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at 717-787-3483 for more information. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at 717-787-3483.  For actions taken on applications for pipelines that are regulated by the Federal Energy Regulatory Commission (FERC).

 Any person aggrieved by this action may challenge it in an appropriate legal forum. The State and Federal courts are currently split on whether the proper forum to challenge a Department permit, authorization or approval for a facility or activity subject to the Federal Natural Gas Act, 15 U.S.C.A. §§ 717 et seq., is the United States Court of Appeals for the Third Circuit or the Pennsylvania Environmental Hearing Board. See Delaware Riverkeeper Network v. Sec'y, Dep't of Envtl. Prot., 833 F.3d 360 (3d Cir. 2016); Delaware Riverkeeper Network v. Sec'y, Dep't of Envtl Prot., 903 F.3d 65 (3d Cir. 2018), cert. denied, 139 S. Ct. 1648, 203 L. Ed. 899 (2019) and Cole v. Dep't. of Envtl Prot., 1577 C.D. 2019 WL 2420667 (Pa. Cmwlth Ct. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The DEP may approve or disapprove plans and reports submitted. This notice provides DEP's decision and, if relevant, the basis for disapproval.

 Notice is hereby given that the Pennsylvania Department of Environmental Protection (Department) will hold a public hearing on February 21, 2024 concerning the applications to revise a Large Industrial Minerals (Noncoal) Surface Mining Permit and associated NPDES Permit submitted by Pierson Rheems, LLC which is located at 426 Swedesboro Road, Pilesgrove, NJ 08098. The mine site is referred to as the Pierson Rheems Quarry and is located in West Donegal and Mt. Joy Townships, Lancaster County, PA. The mining Permit Application Number is 36080301 and the NPDES Permit Application Number is PA0224651. All interested parties are encouraged to attend the hearing.

 The application is being reviewed by the Department's Pottsville District Mining Office located at 5 West Laurel Boulevard, Pottsville, PA, 17901. The phone number for the Pottsville office is 570.621.3118.

 The pending revised permit acreage is 132.22 acres and is situated at on the property of Pierson Rheems, LLC. Dolomitic Limestone is mined within the permit area.

 The site is located within the Donegal Creek Watershed. The associated NPDES application discharges of water from the mining pit and support/processing area, and stormwater from the support/processing area to the UNT to Donegal Creek, which is designated as TSF.

 The application proposes to increase the mining permit and NPDES permit size by 29.58 acres from 102.64 acres to 132.22 acres. The application will also revise the maps, update the erosion and sedimentation control plan and update the bond with the current rates. No increase to the NPDES discharge is proposed.

 The public hearing will be held at Rheems Fire Department located at 350 Anchor Road, Elizabethtown, PA 17022 on February 21, 2024 from 6:00 p.m. to 8:00 p.m. DEP representatives will be available at 5:00 p.m. to answer questions the public may have about the permitting process and regulatory requirements prior to the start of the formal hearing at 6:00 p.m. During the hearing, individuals will be allotted up to five minutes to present verbal testimony. To ensure that all speakers have a fair and equal opportunity to present their testimony, relinquishing of time to other speakers will be prohibited, and groups are asked to designate one speaker. Written comments will also be accepted. All comments, whether delivered orally during the hearing or submitted in writing, carry equal weight and consideration with DEP. The hearing may end before the advertised end time if all in attendance have had an opportunity to offer testimony.
