PUBLIC WATER SUPPLY (PWS) PERMITS

   The Department of Environmental Protection has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1-721.17) for the construction, substantial modification or operation of a public water system.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

HAZARDOUS SITES CLEANUP UNDER THE ACT OF OCTOBER 18, 1988

Prompt Interim Response

Reading Industrial Scrap, Inc. Site, Reading City, Muhlenberg Township, Berks County

   The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305), has initiated a prompt interim response at Reading Industrial Scrap, Inc. (RISCO). This response has been initiated under sections 501(a) and 505(b) of the HSCA (35 P. S. §§ 6020.501(a) and 6020.505(b)).

   The RISCO Site is off Route 61 along Berks Street in the City of Reading and Muhlenberg Township, Berks County. The address of the property is listed as 2001 Centre Avenue, Reading, PA 19605. The RISCO Site can be found on the USGS Elverson Pennsylvania Quadrangle map at north 40° 22` 6.3" latitude and west 75° 55` 48.3" longitude. The RISCO Site is in an industrialized area. The original property was 26 acres in size. The current disposal area covers approximately 3 acres.

   Access to the RISCO Site is currently unrestricted. Several area major roadways frame the RISCO Site, including Route 61 to the west and Route 222 to the north. A set of railroad tracks lies along the eastern perimeter, a commercial building along the western perimeter, an industrial building along the southern perimeter and a large excavated pit is inside the northern perimeter of the RISCO Site. A large pile of heavily damaged drums containing a tar-like substance, exposed waste, soil, rock and contaminated debris is in the center of the RISCO Site. The material in this pile was previously determined to be characteristically hazardous for lead.

   Lead is a hazardous waste as defined under the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003) and a hazardous substance as defined under section 103 of the HSCA (35 P. S. § 6020.103). Lead is an inorganic compound that is listed as a probable carcinogen. Lead is toxic by ingestion and inhalation and chronic cumulative effects of lead are exhibited in the body's nervous system.

   Based on the past history of disposal activities at the RISCO Site, it is anticipated that the remaining unexcavated area contains waste with similar hazardous substances. The RISCO Site is not secure and is open to trespass. The waste in the open pit and the surface piles of waste, contain hazardous substances that pose a direct contact threat. The excavated areas pose a safety risk and the remaining buried waste containing hazardous substances creates a possible threat to the groundwater. An initial response by the Department is deemed appropriate to secure the RISCO Site to prevent direct contact health threats to the public and promote public safety by preventing unrestricted access to the RISCO Site.

   The Department proposes a prompt interim response at the RISCO Site to protect public health and safety or the environment. This determination is based upon the following conditions that exist at the RISCO Site: (a) the actual or potential exposure by means of inhalation, ingestion and dermal contact to hazardous substances; and (b) public safety issues relative to an open excavation approximately 30 feet in depth.

   A prompt interim action is justified to remove the current exposure risks posed through releases of hazardous substances and contaminants and to prevent unrestricted access to excavated areas at the RISCO Site. This response should not be delayed for the length of time that it would take to develop and close an administrative record. This response will cost less than $2 million and take less than 1 year to implement.

   This response is not a final remedial response under section 504 of the HSCA (35 P. S. § 6020.504) and therefore is not required to meet the cleanup standards that apply to final responses. Additional response action may be needed to achieve a complete and final cleanup for the RISCO Site.

   The Department considered two alternatives:

   1.  No action for the contaminated soil or waste and would involve no action by the Department at the RISCO Site and is retained as a baseline for comparison with other alternatives. Under this alternative, the Department would take no further action at the RISCO Site. The RISCO Site would not be secured to prevent unrestricted access. Surface stockpiled waste and soil containing hazardous substances and contaminants would not be removed. This alternative would not remove the actual or potential exposure threat posed by the contaminated media and waste and would not be protective of the public health and safety. This alternative would not comply with ARARs and not be protective of human health and the environment. The present cost of this alternative is $0.

   2.  Secure the RISCO Site with fencing and remove stockpiled hazardous waste and contaminated media. This alternative will comply with ARARs and is protective of human health and safety and the environment. The estimated cost of implementing this alternative is $417,165.08.

   The Department has selected Alternative 2 because it is protective, cost effective and meets substantive regulatory requirements. The proposed response is necessary based on current RISCO Site conditions.

   The Department is providing this notice under section 505(b) of the HSCA and section 506(b) of the HSCA (35 P. S. § 6020.506(b) and the publication of this notice in the Pennsylvania Bulletin starts the administrative record period under the HSCA. The Administrative Record, which contains information about the RISCO Site and supports the Department's decision to perform this action at the RISCO Site, is available for public review and comment. The Administrative Record can be examined Monday through Friday from 8 a.m. to 4 p.m. at the Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110 by contacting David Hrobuchak, (717) 705-4843. The Administrative Record can also be reviewed from 8 a.m. to 4 p.m. at the Reading District Office, 1050 Crossroads Boulevard, Reading, PA by contacting Thomas Grubb at (610) 916-0100.

   The Administrative Record will be open for comment from the date of publication of this notice in the Pennsylvania Bulletin and will remain open for 90 days. Persons may submit written comments regarding this action to the Department before August 9, 2004, by sending them to David Hrobuchak, Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110-8200.

   The public will have an opportunity to present oral comments regarding the proposed action at a public hearing scheduled for June 9, 2004, at 7 p.m. at the Reading District Office. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, shall also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

   PPL Sunbury Steam Electric Station, Shamokin Dam Borough and Monroe Township, Snyder County. Penn Environmental & Remediation, Inc. on behalf of PPL Electric Utilities Corporation, Two North Ninth Street, Allentown, PA 18101-1179, has submitted a Final Report concerning groundwater contaminated with diesel fuel. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.
