COAL AND NONCOAL MINING ACTIVITY APPLICATIONS Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); and The Clean Streams Law (35 P. Mining activity permits issued in response to the applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).
The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated above each application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.
Written comments or objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment and informal conferences).
Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

PROJECTS UNDER THE ENVIRONMENTAL GOOD SAMARITAN ACT The Environmental Good Samaritan Act (27 Pa.C.S. §§ 8001--8114) provides certain protections and immunities from civil liability for landowners and persons who voluntarily undertake reclamation and abatement projects to address land and water adversely affected by mining or oil or gas extraction or exploration for natural resources and left in an unreclaimed condition or left discharging water pollution. For landowners and persons to qualify for immunity, the projects must be approved by the Department of Environmental Protection (Department).

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. The limit of this work will begin (Lansdale, PA Quadrangle N: 15.2 inches; W: 6.5 inches) and will end (Lansdale, PA Quadrangle N: 14.5 inches; W: 6.41 inches). The alignment of the relocated roadway will affect a total of 440 linear feet of two unnamed tributaries of Wissahickon Creek (TSF).
Work will consist of the following activities:
1. To extend and maintain an existing 80-foot long 36-inch diameter pipe in the tributary beneath Moyer Boulevard. The existing pipe will be extended 189 feet downstream with a 34-inch by 53-inch elliptical reinforced concrete pipe. The connection between the existing and proposed pipes will be made with the installation of a concrete inlet at the outfall of the exiting pipe. A concrete end wall will be installed at the outfall of the proposed pipe and 65 linear feet of stream channel will be protected with Class R-5 Rock rip-rap.
2. To install and maintain 128 linear feet of 48-inch by 76-inch elliptical reinforced concrete pipe in the tributary beneath the proposed relocated road. Concrete end walls will be installed on each end of the proposed pipe and approximately 10 linear feet of stream channel will be protected with Class R-5 rip-rap both upstream and downstream of the end walls. This pipe will be installed between Construction Stations 19+43 and 20+33.
3. To extend and maintain an existing 125-foot long culvert consisting of twin 33-inch diameter pipes in the tributary beneath West Point Pike. The existing twin pipes will be extended 25 feet downstream by twin 36-inch diameter reinforced concrete pipes. A concrete end wall will be installed at the outfall of the twin pipes. Ten linear feet of stream channel will be protected with Class R-5 rip-rap.

To remove the existing bridges across Cold Stream (HQ-CWF) and Moshannon Creek (CWF); construct, operate and maintain a single span bridges across Cold Stream and Moshannon Creek for the upgrade of 1.03 miles of existing SR 0322 Section C08 and Section A03, as well as the 0.81 mile construction of a new SR 0322-Section C09; and to realign Moshannon Creek channel to improve bridge hydraulics. The prestressed concrete spread box beam bridge across Cold Stream shall be constructed with a clear span length of 63.5-feet, minimum underclearance of 7.05 feet and skew of 66 degrees. The prestressed concrete I-beam bridge across Moshannon Creek shall be constructed with a clear length span of 118.42 feet, underclearance 9.2 feet and skew of 85 degrees. The bridge construction project will not impact wetlands while impacting 400 feet of waterway. Construction of the new 0.81 mile length of SR 0322 Section C09 will impact 3.6 acres of wetland. The western terminus of the project is located on SR 0322 at the intersection of SR 0053 and SR 0322. This permit also authorizes the construction, operation, maintenance and removal of temporary construction crossings, causeways, stream diversions and cofferdams. Temporary structures shall be constructed with clean rock, free of fines and silts or other nonerodible material. Upon completion of the construction activities, all temporary structures shall be removed and the areas restored to original contours and elevations.

To construct and maintain 22,436 linear feet of stream restoration/enhancement within Bald Eagle Creek (12,381 linear feet), Bell Hollow Run (800 linear feet), Oliver Run (749 linear feet), Reese Hollow Run (3,759 linear feet) and Williams Hollow Run (4,747 linear feet) using a natural stream channel design approach including the installation of in-stream structures (5 rock vanes, 6 cross vanes, 20 J-hooks, 2 flow deflector vanes, 2 imbricated stone banks, 28 boulders, 17 areas of stone toe protection, 16 stream bank soil lift areas and 2 root wad areas), channel relocation, stream and floodway excavation and filling, 8 stone channel crossings, 8 hog slat channel crossings, 20,601 linear feet of stream bank fencing and riparian plantings. The project is located in the Townships of Worth and Taylor and the Borough of Port Matilda in Centre County and is being constructed to provide mitigation for stream impacts associated with the U. S. Route 220 (I-99) project, construction sections C10, A11, C11, A12, B12 and C12. Mitigation is being performed in accordance with the procedures and environmental commitments of the U. S. The stream mitigation project will impact 1.16 acres of riparian palustrine emergent wetlands. Wetland impacts are associated with placement of fill, stream bank grading and construction of at-grade crossings for the purpose of limiting stream access points for property owners and livestock. The stream improvements will involve minor grading within the floodplain of the northern Bald Eagle Creek and its tributaries. The grading will involve 15,794 cubic yards of excavation (cut) and 11,728 cubic yards of fill in the floodplain, which corresponds to the construction activities resulting in a net excavation of 4,066 cubic yards for the project. The project improvements will provide opportunity for wetlands to reestablish along the stream floodplains.

Replacement of gas transmission lines shall be completed so that there will be a minimum of 3 feet of cover between the top of the pipe and the lowest point in the streambed. Trench plugs or clay dikes shall be used at every waterway and wetland crossing to ensure the existing hydrology is not altered. If, upon investigation, the Department determines the gas transmission line approved by this permit is serving to degrade water quality, stream profile, meander pattern or channel geometries, then the permittee shall be required to implement all measures necessary to mitigate the degradation. This permit also authorizes the crossing of any wetland that may occur along the 20.5 mile right-of-way of LN-2; during replacement and maintenance operations, the permittee shall take all precautions necessary to ensure that wetland impacts along the right-of-way are temporary.

2. Restoring the stream banks after the removal of these culverts with approximately 145 linear feet of R-5 rock riprap bank stabilization.
3. The removal of material that was stockpiled along approximately 400 linear feet of stream bank.
4. The planting of an approximately 35-foot wide vegetative buffer along both stream banks for the entire project length of 600 feet.

Minard Run Oil Company is proposing to construct a minor road crossing across Lewis Run (HQ-CWF) by installing a 6 foot diameter culvert within Lewis Run. Both oil development and commercial timbering have previously disturbed the area and the culvert is replacing a previously existing culvert that has been removed. The area the be impacted under the application is 0.004 acre.

The applicant proposes to backfill a 2,000 feet long dangerous highwall as part of this project. During the mining operation, an adjacent, intermittent stream was diverted through the pit associated with this highwall and the original stream channel was backfilled. The applicant proposes to backfill the pit area associated with the highwall (along with the diverted stream) and relocate the stream channel to its approximate original location. The work will involve constructing approximately 1,900 feet of channel having a bottom width of 7 feet and a depth of 2 feet with 1 foot of rock lining. The channel will be connected to the existing stream at the upstream and downstream ends. This will eliminate hazards to public safety and decrease flooding potential on upstream properties.

The applicant is proposing to make a contribution to the Pennsylvania Wetland Replacement Project instead of constructing wetlands. A dam permit is required to operate and maintain the dam.
