FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

The project is located on S.R. 1015 (Potter Creek Branch Road) approximately 500 feet west of the intersection of S.R. 0036 (Woodbury Pike Road) and S.R. 1015 in Woodbury, PA, Woodbury Township, Bedford County (Latitude 40.21666°, Longitude -78.37360°). The project will permanently impact 0.01 acre of PEM/PSS/PFO wetland, temporarily impact 0.01 acre of PEM/PSS/PFO wetland, impact 0.014 acre of stream, and impact 0.078 acre of floodway to Yellow Creek. The purpose of the project is to improve the roadway to current safety standards. The project will have a detour implemented to maintain traffic control. No wetland mitigation is required.

Operate and maintain an approximately 193` wide and 68` long floating dock, along the right bank of the Allegheny River (WWF), for the purpose of constructing a recreational dock. This project will impact approximately 0.4 acre of the Allegheny River. Mitigation is accounted for by limiting the impact of the project on its surroundings. This project is located approximately 150 feet south of the intersection of East First Street and Willow Lane (New Kensington East, PA USGS Topographic Quadrangle; Latitude: 40° 36` 9"; Longitude: -79° 44` 24"; USACE: Pittsburgh District; Sub-basin 18A), in Bracken-ridge Borough, Allegheny County.

The applicant proposes to:
1. Place and maintain a new culvert crossing in a tributary to Clarks Run (aka UNT-2) (WWF). The crossing will consist of two adjacent 48 inch reinforced concrete pipes with a total length of 151 LF.
2. Remove the existing culvert and place fill in a tributary to Clarks Run (aka UNT-3) (WWF) impacting approximately 93 LF.
3. Remove the existing culvert and place fill in a tributary to Clarks Run (aka UNT-4) (WWF) impacting approximately 110 LF.
4. Relocate the existing upstream culvert and place fill in a tributary to Clarks Run (aka UNT-1) (WWF) impacting approximately 285 LF.
5. Remove the existing 60-inch culvert in a tributary to Clarks Run (aka UNT-7) (WWF), and construct, and maintain a replacement 60-inch reinforced culvert crossing with a total length of 194 LF.
6. Remove the existing culvert and place fill in a tributary to Clarks Run (aka UNT-8) (WWF) impacting approximately 119 LF.
7. Remove the existing 72-inch culver in a tributary to Clarks Run (aka UNT-6) (WWF), and construct, and maintain a replacement 72-inch culvert crossing. The culvert will be relocated approximately 280 feet east of the existing culvert (which is 665 LF in length) and will be 500 LF in length.
8. Remove the existing 7-span bridge over the Beaver River (WWF), and construct and maintain a replacement 5-span bridge. The replacement 5-span bridge will be approximately 150 feet upstream of the bridge and will be approximately 154 LF in length with a total river span length of approximately 475 LF.
9. Extend and maintain an arch culvert with a normal span of 10 feet in a tributary to Thompson Run (aka UNT-14) (WWF) with a total entrance extension of 70 LF.
10. Place and maintain fill in 25 wetlands (PEM, PSS, PFO, and POW) affecting 1.6 acre of wetland and temporarily affecting an additional 0.032 acre of wetland.
11. Realign/relocate various watercourses, in association with the preceding activities, which will impact a cumulative total of approximately 2,209 LF of watercourses in the Clarks Run (WWF) and Thompson Run (WWF) watersheds.
12. An approximate, cumulative total of temporary impacts are anticipated to 1,130 LF of various watercourses in the Clarks Run (WWF) and Thompson Run (WWF) watersheds.
The structures and activities requiring authorization for the Pennsylvania Turnpike Roadway and Bridge Reconstruction Milepost 12.02 to 14.01 (aka Beaver River Bridge replacement) (Beaver Falls, PA Quadrangle; starting at Latitude 40° 49` 9.97", Longitude -80° 20` 18.04" and ending at Latitude 40° 48` 22.66", Longitude -80° 18` 16.56") will permanently impact 3,885 LF of various watercourses and 1.6 acre of wetland and temporarily impact a total of approximately 1,130 LF of various watercourses and 0.032 acre of wetland. The project in located in Big Beaver and Homewood Boroughs and North Sewickley Township, Beaver County, PA. The proposed compensatory mitigation for the project includes construction of approximately 2.0 acres of wetland habitat adjacent to the project at the Beaver Valley interchange. The project results in a net gain of approximately 20 LF of open stream channel through reduced culvert length and channel relocation length. Compensatory stream mitigation for project impacts will include natural channel design concepts and plantings for all stream channel relocations. Additionally, approximately 90 feet of UNT-6 will be daylighted by removal of an abandoned culvert adjacent to the Beaver Valley interchange and the resulting open channel will be reconstructed with natural channel design concepts and plantings.

The applicant proposes to:
Place and maintain fill in 0.09 acre of PEM wetland. For the purpose of constructing two proposed single-family dwellings. This project will permanently impact 0.09 acre of PEM wetlands. Mitigation will include buying a 0.1 acre credit from a local mitigation bank. The project is located approximately 750 feet northeast of the intersection of East McMurray Road and Shady Lane (Bridgeville, PA USGS Topographic Quadrangle; Latitude 40° 16` 32"; Longitude: -80° 5` 37"; USACE: Pittsburgh District; Sub-basin 20F), in Peters Township, Washington County. This project is Phase 2 of the Henney Plan project.

The project will temporarily impact 90 linear feet of UNTs to Brush Run, 714 linear feet of permanent impacts to UNTs to Brush Run, 0.009 acre of temporary impact wetlands and 0.03 acre of permanent impact to wetlands additionally the project will have 787 linear feet of permanent impacts to UNTs to Brush Run with drainage areas under 100 acres. Mitigation for stream impacts are proposed by 3,474 linear feet of high bank plantings, low bank plantings and riparian buffer plantings along several UNTs to Brush Creek within the project area.

The project will result in approximately 178 linear feet of temporary stream impacts and 525 square feet of temporary wetland impacts for the purpose of installing a temporary waterline for Marcellus Shale gas development in Elkland and Fox Township, Sullivan County.

The project will result in 1,262 linear feet of temporary stream impacts, 13,895 square feet (0.32 acre) of permanent wetland impacts, and 46,286 square feet (1.06 acre) of temporary wetland impacts all for the purpose of installing a natural gas pipeline and associated access roads in Ward and Sullivan Townships, Tioga County. The permittee will provide 0.32 acre of onsite wetland restoration for forested wetland impacts.

FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

PUBLIC WATER SUPPLY PERMITS The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

Montour Plan Description: The plan provides for the replacement of the treatment process equipment of the Washingtonville Borough Municipal Authority sewage treatment facility, which serves Washingtonville Borough and portions of Limestone Township and Derry Township, and consists of the demolition of the existing treatment process equipment and installation of new treatment process components including fine screen headworks, a sequencing batch reactor (SBR) to replace the current extended aeration process, a new chlorine gas disinfection system, and sludge dewatering and updated sludge holding facilities. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.
