The project is located 0.2 mile north of the intersection of S. R. 2005 and Jefferson Street (Allentown East, PA Quadrangle N: 14.9 inches; W: 15.0 inches) in the City of Allentown, Lehigh County (Philadelphia District, Army Corps of Engineers).

   E40-440.  Encroachment. Department of Environmental Protection, Bureau of Abandoned Mine Reclamation, 93 North State Street, Wilkes-Barre, PA 18701-3195. To place fill in a strip pit containing approximately 200 linear feet of a tributary to Black Creek (CWF) for the purpose of reclaiming an abandoned mine site. The project (OSM 40 (3716) 101.1--Tomhicken) is located on the north side of S. R. 3020 approximately 8,500 feet southwest of the Village of Tomhicken (Nuremburg, PA Quadrangle N: 15.1 inches; W: 0 inches) in Black Creek and Sugarloaf Township, Luzerne County (Baltimore District, Army Corps of Engineers).

   E40-441.  Encroachment. George D. and Nina Peltz, 1099 Alberdeen Road, Mountaintop, PA 18707-9057). To remove the existing flood-damaged structure and to construct and maintain a single-span bridge, having a span of approximately 30 feet and an underclearance of approximately 4 feet, across a tributary to Big Wapwallopen Creek (CWF), for the purpose of providing access to a single-family home. The project is located on the north side of S. R. 3010 (Alberdeen Road), approximately 400 feet west of S. R. 0081 (Freeland, PA Quadrangle N: 19.6 inches; W: 12.1 inches) in Dorrance Township, Luzerne County (Baltimore District, Army Corps of Engineers).

   E10-234.  Encroachment. Seneca Valley School District, 124 Seneca School Road, Harmony, PA 16037. To place fill in a total of 0.356 acre of two separate wetland areas. To place fill within the 100-year floodway of a tributary to Brush Creek (WWF) (approximately 1,500 square feet footprint area and to perform minor stream channel realignment and stream bank stabilization work along and within a tributary to Brush Run to allow for the Haine Elementary School Expansion project. This project will also include creation of two wetland replacement sites which will total at least 0.356 acre. Project is located at the existing Haine Elementary School approximately 800 feet south of the intersection of Haine School Road and Rochester Road (S. R. 3022) Baden, PA Quadrangle N: 12.7 inches; W: 0.5 inch) located in Cranberry Township, Butler County.

   E10-227.  Encroachment. North Suburban Land Co., Inc., Suite 207, 9400 McKnight Road, Pittsburgh, PA 15237. To maintain a 9-foot high by 320-linear foot long gabion basket wall along Coal Run (WWF) for streambank rehabilitation and to allow for the extension of Thomson Park Drive within Thomson Business Park. The project is located approximately 2,000 feet south of Rochester Road (S. R. 3022) on Thomson Park Drive in Thomson Business Park (Mars, PA Quadrangle N: 12.4 inches; W: 15.4 inches) located in Cranberry Township, Butler County.

   E24-194.  Encroachment. James B. and Barbara A. Tillia, R. D. 1, Box 1286, Wampum, PA 16157. To construct and maintain a 40.5 foot single clear span steel beam bridge with an average underclearance of 8.5 feet across Little Toby Creek (CWF, TSF) on existing abandoned railroad bridge abutments to allow for private access. Project is located across Little Toby Creek approximately 1,400 feet southwest of the intersection of S. R. 0219 and S. R. 2003 in the Village of Challenge (Brandy Camp, PA Quadrangle N: 6.5 inches; W: 8.5 inches) located in Horton Township, Elk County.

   E46-738.  Encroachment. Whitpain Township, 960 Wentz Road, Blue Bell, PA 19422. To remove an undersized deteriorated twin 5.0-foot diameter steel pipe culvert with stone headwalls, and to construct and maintain twin 18.0-foot by 7.0-foot reinforced concrete box culverts, reinforced concrete wingwalls and associated approach roadway fills. The site is situated along Stony Creek (TSF) approximately 1,800-feet southwest of the intersection of Skippack Pike (S. R. 0073) and North Wales Road (T-377) (Lansdale USGS Quadrangle N: 8.9 inches; W: 8.7 inches) in Whitpain Township, Montgomery County.

   E09-715.  Encroachment. Wilma M. Johnson, 12 Waterloo Street, New Hope, PA 18938. To modify, reconstruct and maintain approximately 73-foot long, 13-foot high and 12-inch thick deteriorated stone masonry retaining wall situated along the western bank of the Delaware River at 12 Waterloo Street. The project consists of constructing an 8-inch thick reinforced concrete wall placed directly in front of the existing wall and to be tied together with steel anchors. Also, included in this project is the placement of riprap stone along the shore line and repaired retaining wall. The site is located approximately 1,500 feet south from the intersection of S. R. 32 and S. R. 179 (Lambertville, PA-NJ Quadrangle N: 20.2 inches; W: 10.35 inches) in New Hope Borough, Bucks County.

   E15-500.  Encroachment. Tredyffrin Township, 1100 Duportail Road, Berwyn, PA 19312; and Department of Transportation, 200 Radnor-Chester Road, St. Davids, PA 19087. To reopen application E15-500 to maintain an existing 10-foot × 6-foot reinforced concrete box culvert and extend said culvert by 19 linear feet on the southern end. Culvert is located in and along Crabby Creek a tributary to Little Valley Creek (EV), under Duportail Road, and impacts 0.05 acre of wetland for the purpose of widening Duportail Road. The site is located approximately 185 feet northeast of the Swedesford and Duportail Roads intersection (Valley Forge, PA Quadrangle N: 11.75 inches; W: 14.0 inches) in Tredyffrin Township, Chester County.

To construct and maintain a 40-foot long bridge over an unnamed tributary to Bull Creek located 0.25 mile from triangle intersection of Bull Creek Road and Red Belt (Curtisville, PA Quadrangle N: 4.2 inches; W: 7.1 inches) in Fawn Township, Allegheny County.

   E02-1147.  Encroachment. Allegheny County, 501 County Office Bldg., 542 Forbes Ave., Pittsburgh, PA 15219-2951. To construct and maintain a 140-foot long retaining wall; to remove existing culvert; and to construct and maintain a 75-foot long, 24-inch diameter culvert in Lick Run at a point along Broughton-Cochran Mill Road, 145 feet south of its intersection with McElhaney Road (Glassport, PA Quadrangle N: 10.7 inches; W: 14.2 inches) in Jefferson Borough.

   E56-262.  Encroachment. Department of Transportation, 1620 N. Juniata Street, Hollidaysburg, PA 16648. To remove necessary existing structures, to place and maintain fill at various locations for roadway construction, and to construct and maintain the following list of structures for the purpose of constructing proposed U. S. 219 Meyersdale Bypass (S. R. 6219, B08) consisting of a 4-lane limited access divided highway. The project begins south of Hunsrick Summit, just south of Meyersdale and ends at interchange connecting to U. S. 219 near Pony Farm Road and Indian Dig Road (Meyersdale, PA Quadrangle N: 11.0 inches; W: 5.0 inches) in Summit Township, Somerset County.

   *  (2) 30-inch × 19-inch oval RCP culverts in an unnamed tributary to Casselman River (T-824, ST 18+42 and 21+83)

   *  a 350-foot stream enclosure in an unnamed tributary to Casselman River (ST 94+00)

   *  a 510-foot stream enclosure in Miller Run (ST 118+30--123+40)

   *  a 114-foot stream enclosure in Miller Run (ST 395+00 on existing U. S. Route 219)

   *  fill in 130 feet of channel of Miller Run for purpose of relocating and maintain 200 feet of channel (ST 155+00--156+50)

   *  (2) 4-span I-beam bridges (one is 459 feet and one is 518 feet) in Casselman River (ST 157+00--158+50)

   *  a 435-foot stream enclosure in an unnamed tributary to Casselman River (ST 199+00)

   *  (2) 4-span I-beam bridges, each 410 feet long in Elk Lick Creek (ST 232+00--233+00)

   *  (2) 3-span 355-foot long I-beam bridges across Casselman River (ST 260+80--262+43)

   *  (2) single-span bridges, each 136 feet long in Blue Lick Creek (ST 293+40)

   *  fill in a total of 1.35 acres of wetlands

   E56-263.  Encroachment. Texas Eastern Transmission Corporation, 5444 Westheimer Street, Houston, TX 77056-5310. To remove existing structure and to construct and maintain a 36-inch diameter pipe across Laurel Hill Creek as part of a 4.46 mile replacement project. The crossing is located on T-342 approximately 0.25 mile from King's Bridge (Kingwood, PA Quadrangle N: 10.7 inches; W: 2.9 inches) in Middlecreek Township, Somerset County.

   E12-097.  Water obstruction and encroachment. Department of Transportation, 1924-30 Daisy St., Clearfield, PA 16830. Remove the existing structure and to construct and maintain a 4 span thru-girder bridge with a span along the center line of 317.04 feet with an average skew of 43 degrees and average underclearance of 17 feet over the Driftwood Branch of the Sinnemahoning on S. R. 120 about 70 feet upstream of the confluence of Hunts Run (Cameron, PA Quadrangle N: 13.9 inches; W: 7.0 inches) in Lumber Township, Cameron County. Estimated stream disturbance is approximately 150 feet and the stream is classified as TSF.

   E14-383.  Water obstruction and encroachment. Centre Lime and Stone Co., 325 West Aaron Drive, State College, PA 16801. To construct and maintain single span concrete box beam bridge with a clear span of 40 feet and an underclearance of 5 feet across Gap Run Channel located in the northeast corner of the intersection of S. R. 0026 and Harrison Road (Centre Hall, PA Quadrangle N: 22.3 inches; W: 15.5 inches) in Spring Township, Centre County. This project as proposes, will not impact Gap Run Channel which is classified as a CWF.

   E14-284.  Water obstruction and encroachment. William and Tammie Burnaford, 1474 Summit Hill Road, Howard, PA 16841. To expand and maintain an existing pond on an unnamed tributary to Marsh Creek, located off Summit Hill Road, T-485, about 500 feet north of Marsh Creek Road (Snowshoe SE, PA Quadrangle N: 8.5 inches; W: 2.5 inches) in Curtin Township, Centre County. Estimated stream disturbance approximately 130 feet; the stream is classified as CWF.

   E17-302.  Water obstruction and encroachment. Woodward Township Supervisors, R. R. 1, Box 621, Houtzdale, PA 16651. Remove the existing structure and to construct and maintain a 16-foot by 5-foot reinforced concrete box culvert in Whiteside Run which is located approximately 1,800 feet southeast from the intersection of S. R. 2007 while traveling on T-812 (Houtzdale, PA Quadrangle N: 9.75 inches; W: 13.25 inches) in Woodward Township, Clearfield County. The project proposes to impact approximately 75 feet of Whiteside Run which is a CWF.

   E19-151.  Water obstruction and encroachment. PP&L Co., 2 North 9th St., Allentown, PA 18101. To construct and maintain two 3-foot diameter power poles with 6-foot diameter concrete foundations and two 3-foot power poles with foundations in wetlands and/or the floodway of Fishing Creek to be located in a 3.82 mile corridor starting at the Benton Substation and ending at the Benton Foundry (Stillwater, PA Quadrangle N: 20.0 inches; W: 16 inches) in Sugarloaf Township, Columbia County. The project proposes to permanently impact approximately 100 square feet of wetlands and/or floodway stream bank of Fishing Creek which is desigated HQ-CWF.

   E19-152.  Water obstruction and encroachment. Department of Transportation, P. O. Box 218, Montoursville, PA 17754. To remove the existing structure and to construct and maintain a prestressed concrete box beam bridge with a clear span of 40 feet, average underclearance of 6.6 feet on a 90 degree skew over Hemlock Creek on S. R. 4010 just off of S. R. 44 and to construct a temporary crossing consisting of five, 48 inch corrugated metal pipe (Millville, PA Quadrangle N: 4.1 inches; W: 0.7 inch) in Hemlock Township, Columbia County. Estimated stream disturbance approximately 150 feet; stream is classified as CWF.

   E41-361.  Water obstruction and encroachment. Department of Transportation, P. O. Box 218, Montoursville, PA 17754. To remove the existing structure and to construct and maintain a single span prestressed concrete adjacent box beam bridge with a normal clear span of 60 feet and an average underclearance of 14 feet plus an associated temporary single lane bridge with a single span of 68.83 feet across Plunketts Creek located 1.2 miles northbound on S. R. 1005 from its intersection with S. R. 1007 (Barbours, PA Quadrangle N: 6.1 inches; W: 7.3 inches) in Plunketts Creek Township, Lycoming County. This project proposes to temporarily impact approximately 230 linear feet of Plunketts Creek which is a HQ-CWF.

   E41-362.  Water obstruction and encroachment. Lycoming Supply Inc., 801 Beeber St., Williamsport, PA 17701. To remove the existing superstructure of a two span railroad bridge across Lycoming Creek for the purpose of steel salvage. The proposed work shall consist of removing the superstructures, leaving abutments and center piers intact, from existing grade that will not impact wetlands or Lycoming Creek, a cold water fishery. The project is located along the eastern right-of-way of S. R. 0014 approximately 500.0 feet west of the intersection of S. R. 1006 and S. R. 0014 (Bodines, PA Quadrangle N: 13.1 inches; W: 14.5 inches) in Lewis Township, Lycoming County.

   E41-363.  Water obstruction and encroachment. Department of Transportation, P. O. Box 218, Montoursville, PA 17754. To remove the existing structure and to construct and maintain a prestressed concrete box beam bridge skew 50 degrees having a normal span of 48.3 feet and an average underclearance of 9 feet over Mill Creek on S. R. 2031 adjacent the intersection with S. R. 2039 (Montoursville North, PA Quadrangle N: 8.0 inches; W: 9.0 inches) in Loyalsock Township, Lycoming County. Estimated stream disturbance is approximately 100 feet and the stream is classified as High Quality/CWF.

   E53-286.  Water obstruction and encroachment. Daniel and Frances Reilly, 254 Dickie Ave., Staten Island, NY 10314. To construct and maintain a single span bridge with a span of 32 feet and an approximate underclearance of 4 feet across east branch Fishing Creek located approximately 3.1 miles northbound on Fishing Creek Road from its intersection with S. R. 0006 (Coudersport, PA Quadrangle N: 11.0 inches; W: 15.3 inches) in Roulette Township, Potter County. This project proposes to impact approximately 50 feet of the stream which is HQ-CWF.

   E60-125.  Water obstruction and encroachment. DCNR, Bureau of Facility Design, P. O. Box 8451, Harrisburg, PA 17105-8451. To remove the existing structure and to construct and maintain a 40 foot single span bridge with a minimum underclearance of 4.72 feet across White Deer Creek located on White Deer Creek Road about 1.9 miles south of its intersection with Sugar Valley Narrows Road (Williamsport SE, PA Quadrangle N: 7.2 inches; W: 11.6 inches) in West Buffalo Township, Union County. Estimated stream disturbance is 50 feet; the stream is classified as HQ-CWF.

   The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Rachel Carson State Office Building, 400 Market Street, P. O. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges

   The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (DEP) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements, with appropriate and necessary updated requirements to reflect new or changed regulations and other requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management, and total residual chlorine control (TRC). Any major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.

   The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.

   Persons wishing to comment on the proposed permits are invited to submit a statement to the Field Operations indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding these applications and proposed permit actions. Comments should include the name, address and telephone number of the writer and a brief statement to inform the Field Office of the basis of the comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.

   Following the 30-day comment period, the Water Management Program Managers will make a final determination regarding the proposed permit action. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

   The permit renewal application and related documents, proposed effluent limitations and special conditions, comments received and other information are on DEP's file. The documents may be inspected at, or a copy requested from, the Field Office that has been indicated above the application notice.

Plan approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

   Location: Mount Union Borough, Huntingdon County, Nine West Market St., Mount Union, PA 17066. The approved plan provided for construction of a 1.65 mgd wastewater treatment facility to replace an existing, hydraulically overloaded plant. This regional facility will provide treatment capacity to Shirley Township, Kistler Borough, Wayne Township and Newton-Hamilton Borough. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES permits or WQM permits must be obtained in the name of the municipality or authority.

   Location: King Township, Bedford County, R. D. 1, Box 174, Osterburg, PA 16667. The approved plan provided for construction of a pump station, collection system and interceptor sewer to provide public sewer service to the Osterburg and Imler sections of the Township. Treatment will be provided by the Chestnut Ridge Joint Sewer Authority. The Weyant area is scheduled for service in 10 years. Weyant and the remainder of the township will employ an on-lot sewage disposal system management program. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES permits or WQM permits must be obtained in the name of the municipality or authority.

   Location: Bern Township, Berks County, R. D. 9, Box 9276, Reading, PA 19605. The approved plan provided for development driven construction of a pump station, collection system, and an interceptor sewer to serve sewer area one. This area will be tributary to an enlarged Leesport wastewater treatment facility. Sewer area two is the West Shore and industrial park. A pump station and collection system will be constructed tributary to the existing airport wastewater treatment facility. Area three surrounds the existing county wastewater treatment facility. Collection system construction will be developer driven in this area. A Well Drillers Ordinance and an on-lot disposal system Management Ordinance will address the remainder of the Township. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES permits or WQM permits must be obtained in the name of the municipality or authority.

   Location: Orchard Heights Park, Damascus Township, Wayne County.

   Project Description: This project proposes a Spray Irrigation, Small Flow Treatment Facility (SFTF) to correct two existing on-lot sewage disposal systems that are currently malfunctioning. Orchard Heights Park contains 33 units located on a 29 acre tract of land. The SFTF will be located on the adjoining 14 acre site. Five mobile home units will be removed from the malfunctioning on-lot systems and will provide the 2,000 gpd wastewater flow for the SFTF. In conjunction with repairs to be provided for one of the existing elevated sand mounds, the sewage system malfunctions inherent to this park should be eliminated.

   The property owner will be responsible for the operation, maintenance and repair of the SFTF. In addition, a Part II Water Quality Management Permit will be required.

   This project is located on the east side of S. R. 1004, 1,300 feet south of the intersection with T-529 in Damascus Township, Wayne County, PA.

   Project Description: The approved plan provides for an upgrade and expansion of the sewage treatment plant serving the sewage disposal needs of the City of Erie, the Borough of Wesleyville and the Townships of Lawrence Park, Harborcreek, Millcreek and Fairview.

   Construction of an overflow retention facility, a relief outfall, headworks expansion and other facilities will enable the plant to properly treat existing and future wet weather flows up to 168 mgd. In addition, de-chlorination facilities will be provided to meet total residual chlorine limits.

   The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal.
