Watershed Redesignation
[26 Pa.B. 2659] The Storm Water Management Act (32 P. S. §§ 680.1--680.19) (act) requires Pennsylvania counties to prepare and adopt watershed stormwater plans for designated watersheds. The intent of the act is to address the impacts of development on existing stormwater runoff levels and recommend measures to control accelerated runoff to prevent flood damages that could occur due to those development activities.
A watershed stormwater plan includes hydrologic and hydraulic evaluation of the drainage basin, consideration of existing drainage problems, existing and proposed flood control projects and their impacts, existing government regulatory mechanisms and provide recommendations for the control of accelerated runoff as a result of the development. The Department provides up to 75% funding assistance to counties for their watershed stormwater planning effort.
Under section 14(a)(10) of the act (Powers and duties of the Department of Environmental Protection), the Department, in consultation with the counties, originally designated 353 watersheds in the entire State. Those watersheds were approved by the Environmental Quality Board on May 31, 1980 with amendments on November 19, 1991, April 21, 1992, June 21, 1994 and, most recently, April 16, 1996, bringing the current number of watersheds to 355.
The Department of Environmental Protection in consultation with Clearfield County has designated 11 watersheds within Clearfield County. Clearfield County has requested that a portion of the West Branch Susquehanna River be redesignated as a separate watershed. The new watershed, which may be referred to as ''The Central Region West Branch Susquehanna River, Clearfield County'' encompasses all areas currently within and draining to the West Branch Susquehanna River designated watershed from the Curwensville dam downstream to the mouth of Clearfield Creek including the major tributaries of Montgomery Creek, Moose Creek and Wolf Run, but excluding Anderson Creek and Clearfield Creek which are already separate designated watersheds. This redesignation will enable Clearfield County to undertake stormwater planning for this subarea without immediately studying the entire Clearfield County portion of the West Branch Susquehanna River. Clearfield County wishes to immediately begin stormwater planning within this portion of the West Branch Susquehanna River since it currently has serious drainage problems along with a significant development potential that could exacerbate the existing problems without proper planning.
The Department, subsequent to advertising at 25 Pa.B. 4982, 5012 on November 18, 1995, held a public hearing on December 18, 1995, at the Clearfield County Multi-Services Center, Clearfield, for the purpose of accepting comments on the redesignation of these watersheds. No comments, objections or concerns were raised. The Environmental Quality Board approved this request at its public meeting on April 16, 1996.
