ENVIRONMENTAL
HEARING BOARD

DEP v. Chester Stuckey; Doc. No. 96-025-SA-R

   The Department of Environmental Protection (Department) and Chester Stuckey have agreed to a settlement of the above matter.

   The parties have agreed to a settlement, the major provisions of which include that Chester Stuckey's Mine Official Certificates are suspended and shall be surrendered to the Department for a period of 1 year commencing as of January 23, 1996 and continuing through January 23, 1997. Following completion of the suspension period, on January 24, 1997, the Department will return Mine Foreman Certificate No. 1147, Assistant Mine Certificate No. 2004 and Mine Examiner Certificate No. 843 to Chester Stuckey without requiring him to undergo further examination.

   Copies of the full agreement are in the possession of:

   Gail A. Myers, Assistant Counsel, Department of Environmental Protection, Office of Chief Counsel, 400 Waterfront Drive, Pittsburgh, PA 15222-4745, (412) 442-4262;

   Chester Stuckey, 2585 Jefferson Avenue, Washington, PA 15301;

   and at the offices of the Environmental Hearing Board, and may be reviewed by any interested person on request during normal business hours.

   Persons who are aggrieved by the above settlement have a right to appeal to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457. Appeals must be filed within 20 days of this publication.

   The Environmental Hearing Board is empowered to approve this settlement if no objection is timely filed with the Board.
