ACTIONS

   The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decisional law.

   Project Description: This approved project is a special study under the PA Sewage Facilities Act (Act 537) for proposed sludge handling improvements.

   Under this study, the Borough will construct improvements to the sludge handling facilities at the Site I sewage treatment plant to prevent the excessive onsite storage of sewage sludge. Construction should commence by January 15, 1997.

   The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal.


Actions taken under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1--721.17).

Submission of Final Reports on Attainment of Background and Statewide Health Standards (Sections 302(e)(2) and 303 (h)(2).

   The following final reports were submitted to the Department of Environmental Protection under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

   For further information concerning the final report, contact the Environmental Cleanup Program in the Department of Environmental Protection Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office listed.    Burle Industries, City of Lancaster, Lancaster County. Burle Industries, Inc., 1000 New Holland Avenue, Lancaster, PA 17601-5688 has submitted a Final Report concerning remediation of site soils contaminated with PHCs. The report is intended to document remediation of the site to meet the Statewide health standard.

   The Department of Environmental Protection (Department) under the authority of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1305) (HSCA), initiated a prompt interim response (response) at the East Union Township PCB Contamination Site (Site). The site, which consisted of soil which was contaminated with polychlorinated biphenyl (PCB) oil as the result of an illegal transformer salvage operation, is located in East Union Township, Schuylkill County.

   On August 2, 1996 Department personnel inspected the Site and obtained soil and surface water samples for PCB analysis. Analysis confirmed the presence of PCBs in site soil and surface water.

   After determining that Site conditions constituted a substantial threat to public health and safety and the environment, the Department initiated a response. On August 14, 1996, prior to the Department undertaking the response, a potentially responsible party came forward and agreed to undertake the prompt action interim response which was chosen by the Department. The prompt action interim response chosen by the Department consisted of the excavation and disposal of all visually contaminated soil found on site. The Department also considered taking no action at the site. However, due to the imminent threat to human health and safety and the environment, this option was rejected.

   The administrative record contains information which was used as the basis for the decision to conduct the response at the site. The administrative record will be available for public inspection from 8 a.m. to 4 p.m., Monday through Friday, at the Department's Northeast Regional Office located at 2 Public Square, Wilkes-Barre, PA 18711.

   Written comments concerning the response or information in the administrative record will be accepted in person, if delivered, or by mail, if postmarked, on or before January 3, 1997 to the attention of Woodrow Cole, Compliance Specialist--Hazardous Sites Cleanup Program, at the Northeast Regional Office address.

   Additionally, the public will have an opportunity to present oral comments at a public hearing. The public hearing has been scheduled for November 19, 1996, at 10 a.m. at the Department's Northeast Regional Office in Wilkes-Barre. Persons wishing to present oral com- ments must register on or before November 12, 1996 by calling Woodrow Cole at (717) 826-2511. If no person registers to present oral comments by November 12, 1996, the hearing will not be held.    The Department is providing this notice under section 506(b) of the HSCA. The date of publication of this no- tice in the Pennsylvania Bulletin initiates the minimum 90 day public comment period on the administrative record, as provided under that act. The site, which was an abandoned hotel, is located in an area off of Rovinsky Road in Scott Township, Lackawanna County.

   On May 29 and June 14, 1996, Department personnel inspected the site subsequent to a complaint filed with the Department. During the inspections, Department personnel noted the presence of 83 16-oz. bottles of embalming fluid, several 55-gallon fiber drums of unknown material and numerous other containers of unknown material. It was determined by the Department that the embalming fluids were characteristically hazardous and toxic.

   After determining that site conditions constituted a substantial threat to public health and safety and the environment, the Department initiated a response. On August 16, 1996, the Department conducted a prompt action interim response which consisted of the removal and disposal of those chemicals found onsite. The Department also considered taking no action at the site. However, due to the imminent threat to human health and safety and the environment, this option was rejected.
