Request for Variance

   The Bureau of Deep Mine Safety has received a request for variance from the Tanoma Mining Company. The following notification contains a summary of this request. Complete copies of the variance request may be obtained from Glen Ziegler by calling (717) 787-1376.

   The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice. All comments should be addressed to Thomas J. Ward, Jr., Director, Bureau of Deep Mine Safety, P. O. Box 8463, Harrisburg, PA 17105-8463.

   Section 702 of the Bituminous Coal Mine Act (52 P. S. §§ 701 -- 702) provides a mechanism for operators to obtain variances from specific requirements of the Act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

   Section 268(b) of the Bituminous Coal Mine Act, entitled Clearances and Shelter Holes, requires that shelter holes be provided on the clearance side along designated travelingways that are also used as haulage entries, other than belt conveyor haulage entries. Such shelter holes shall be spaced not more than 80 feet apart.

   Summary of the request: Tanoma Mining Company's plan calls for 105` distances between track shelter holes in the Main E and all future Mains development at the Tanoma Mine. Studies have shown that the main entries in the Tanoma Mine should be developed on 120` centers in order to enhance roof control. This 120` center will result in shelter holes being approximately 105` apart since the crosscuts are driven a maximum of 20` wide.


Notice of Presumed Abandonment

   The equipment described in this notice, which is located on a site mined by Dupont Anthracite, Incorporated in Taylor Borough, Lackawanna County, Contract No. BF 373-101.1, under the terms of Mining Permit Number 35890201-01, issued by the Department of Environmental Protection (Department) is presumed to be abandoned.

   The equipment is described as follows: Dragline.

   Any person who wishes to retain ownership of such equipment shall present documentation to the Department by March 20, 1996. If the Department determines the documentation is sufficient to establish ownership, the equipment must be removed from the site within a time specified by the Department. Failure to notify the Department within the above time frame, may result in disposal of the equipment in accordance with the provisions of applicable law.

MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.

   Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Depatment at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).

   Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. Such NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor, application number, a brief summary of the issues to be raised by the requestor at the conference and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

   The following permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection.

   In addition to permit applications, the Bureau of Dams, Waterways and Wetlands (BDWW) and the Regional Office Soils and Waterways Sections have assumed primary responsibility for processing requests for certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), for projects requiring both a Dam Safety and Encroachments Permit, and a U. S. Army Corps of Engineers (ACOE) permit. Section 401(a) of the Federal Water Pollution Control Act requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. 1301--1303, 1306 and 1307, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the BDWW permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Safety or Encroachment Permit, or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the Bureau or Field Office indicated as the responsible office.

E15-403 which authorized removal of the existing structure and to construct and maintain a twin-celled 14-foot x 5-foot R. C. box culvert (culvert bottom depressed 6 inches and a 12-inch concrete weir in east cell) in Crum Creek (HQ, CWF) located at S. R. 1005, Section 30M, Station 12+92 (Valley Forge, PA Quadrangle N:1.4 inches; W:12.7 inches) in Willistown Township, Chester County.

   E15-510. Encroachment. Department of Transportation, 200 Radnor-Chester Road, St. Davids, PA 19087-5178. To remove the existing structure and to construct and maintain an 18-foot span by 5-foot effective rise twin cell precast box culvert across the west branch of Ridley Creek (HQ, TSF) located on Paoli Pike (S. R. 2014) approximately 800 feet northeast of the intersection of S. R. 2014 and Boot Road (West Chester, PA Quadrangle N: 20.9 inches; W: 6.9 inches) in East Goshen Township, Chester County.

   E46-731. Encroachment. Huntingdon Valley Country Club, 2295 Country Club Drive, Huntingdon Valley, PA 19006-5699. To reconstruct, restore and maintain a new 9 hole golf course at the Huntingdon Valley Country Club. The new layout includes the construction of eight bridges, reconstruction of one bridge and three temporary constructions crossings of wetlands between 1st, 2nd, 4th, 7th and the 9th holes. Also, to clear the vegetation and re-establish tees, fairways and greens. The site is located along the south west side of Terwood Road and along the north west side of Paper Mill Road near the intersection of these roads (Hatboro, PA Quadrangle, N: 1.5 inches; W: 12.5 inches) in Upper Moreland Township, Montgomery County.

   E46-732. Encroachment. Michael Walsh, 2445 Edgehill Road, Huntington Valley, PA 19006. To remove accumulated bed load and to restore to original contours a small impoundment which is ancillary to an existing dam; to construct and maintain a sediment forbay approximately 20 feet long, 5 feet wide and 3 feet deep within an unnamed tributary to the Pennypack Creek (WWF) located approximately 80 feet upstream of the existing pond. The site is situated approximately 450 feet east and 50 feet north of the intersection of Edge Hill Road and Overlook Avenue (Hatboro USGS Quadrangle N:2.77 inches, W:13.45 inches) in Upper Moreland Township, Montgomery County.

Notices of Intent for Coverage Under General Permits Received

   The following parties have submitted Notices of Intent for coverage under General NPDES Permits to discharge treated wastewater into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review, or application of lawful standards and regulations, the Department of Environmental Protection proposes to issue coverage under the General Permit subject to effluent limitations, monitoring and reporting requirements and other conditions set forth in the General Permits.

   The Department of Environmental Protection has received Notices of Intent (NOI) for approval of coverage under General NPDES Permits and has taken the following final actions by approving the requested general permit coverages.

Plan revision approval granted December 1, 1995 under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

   Regional Office: Water Management Program Manager, Southcentral Region, One Ararat Boulevard, Harrisburg, PA 17110.

   Location: Union Township, Lebanon County, Fisher Avenue, 3,500 feet west of Interstate 81.

   The approved plan revision provides for construction of a warehouse/distribution facility with a total anticipated sewage flow of 12,000 gallons per day to be treated by the Northern Lebanon County Authority Lickdale Sewer Treatment Plant. Sewage from the warehouse lot will be conveyed by way of a private pump station to the proposed Fisher Avenue low pressure force main. The project qualifies for a Clean Streams Law permit exemption under Act 40. A joint permit will be obtained to address mitigation of wetland related activities.

   Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority.
