ENCROACHMENTS

   The Department of Environmental Protection has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   E15-530.  Encroachment. PECO Energy Company, 175 North Caln Road, Coatesville, PA 19320. To install and maintain an 8-inch diameter high pressure steel gas main inside an abandoned 14-inch cast iron water main across Valley Creek located approximately 1,000 feet north of the intersection of North Valley Road and Swedesford Road (Valley Forge, PA Quadrangle N: 11.95 inches; W: 16.2 inches) in Tredyffrin Township, Chester County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E23-352.  Encroachment. Department of Transportation, District 6-0, 200 Radnor-Chester Road, St. Davids, PA 19087. To operate, modify and maintain two stream enclosures which convey unnamed tributaries to east branch Chester Creek (TSF) beneath Baltimore Pike. The proposed project is associated with the roadway widening and consists of extending one stream enclosure. This enclosure is approximately 158-foot long, 72-inch by 42-inch reinforced concrete arch pipe, which is to be extended upstream using a 13.6-foot long, 57-inch by 38-inch arch corrugated steel pipe with precast concrete endwall. The project also includes the replacement of deteriorated 140-foot long, 30-inch diameter corrugated steel pipe stream enclosure with a 151-foot long, 30-inch diameter reinforced concrete pipe stream enclosure. Associated activities include placement of fill material in 0.10 acre of adjacent wetlands (PFO). The site is located approximately 1,600 feet northeast of the intersection of Baltimore Pike (S. R. 0001) and S. R. 261, near the junction of Darlington Road (S. R. 4005) and Baltimore Pike, (Media, PA Quadrangle N: 4.1 inches; W: 14.0 inches) in Chester Heights Borough, Delaware County. The permit applicant has met the wetland replacement requirements by participating in the Pennsylvania Wetland Replacement Project.

   E23-353.  Encroachment. Harper Associates, P. O. Box 384, Ridley Park, PA 19078. To construct, operate and maintain an 874-foot long, 5-foot high by 10-foot wide reinforced concrete box culvert stream enclosure in and along a relocated alignment of an unnamed tributary to Little Crum Creek (WWF). The enclosure will have an attached precast concrete inlet section with wingwalls, and 50-foot long riprap apron streambed protection. The project is associated with the proposed Morton Avenue Shopping Center redevelopment and also includes the following work:

   1.  Removal of an existing 626-foot long CMP stream enclosure.

   2.  Regrading and maintenance of an existing stormwater management facility consisting of an earth fill dam and an 180-foot long impoundment area excavated in and along a tributary to Little Crum Creek and the 100-year floodway.

   3.  Installation and maintenance of a proposed sanitary sewer line and a storm water drainage outfall structure within the 100-year floodway of the aforementioned tributary.

   The project is located along east side of Morton Avenue at a point approximately 500 feet south of MacDade Boulevard (S. R. 2006) (Lansdowne, PA Quadrangle N: 1.8 inches; W: 11.1 inches) in Ridley Township, Delaware County. The downstream 64-foot long segment of the aforementioned stream enclosure, which extends beneath Morton Avenue (S. R. 2025) is proposed for approval by permit application No. E23-354, submitted by the Pennsylvania Department of Transportation.

   E23-354.  Encroachment. Department of Transportation, 200 Radnor Chester Road, St. Davids, PA 19087. To operate and maintain a 54-foot long section of a 5-foot high by 10-foot wide reinforced concrete box culvert stream enclosure in and along an unnamed tributary to Little Crum Creek (WWF). This enclosure section extends beneath Morton Avenue, and will have attached concrete endwalls and a gabion outlet apron. The project also includes construction, operation and maintenance of proposed storm sewer lines along Morton Avenue to improve drainage in this flood prone area. The project is located along Morton Avenue, at a point approximately 500 feet south of MacDade Boulevard (SR 2006) (Lansdowne, PA Quadrangle N: 1.8 inches; W: 11.1 inches) in Ridley Township, Delaware County. The aforementioned stream enclosure section will be connected, at its upstream end, to a stream enclosure proposed for approval by permit application E23-353, submitted by Harper Associates.

   E51-154.  Encroachment. Rohm and Haas Company, 5000 Richmond Street, Philadelphia, PA 19137. To perform maintenance dredging along the western shoreline of the Delaware River (WWF-MF) in approximately 0.44 acre of riverbed adjacent to the Rohm and Haas Plant dock facility. This project also includes the modification of the existing berth area by the installation of an additional mooring cluster. The purpose of this project is to enlarge an existing mooring area to accommodate large barges. This site is located at the 5000 Richmond Street, Frankford Section of Philadelphia at a point, approximately 3/4 mile east from the intersection of I-95 and Bridge Street (Camden, NJ-PA Quadrangle N: 22.6 inches; W: 8.75 inches) in the City of Philadelphia, Philadelphia County.

   E09-285A.  Encroachment. Warminster Township Board of Supervisors, Township Building, Henry and Gibson Avenue, Warminster, PA 18974. To operate and maintain 18 water obstructions and encroachments located on the Warminster Five Pond public golf course in and along a tributary to the Little Neshaminy Creek and the adjacent wetlands, and to construct 2.35 acres of replacement wetlands in this watershed. The golf course is located at a point approximately 3,200 feet east of the Warrington-Warminster Township Line and north of Street Road (Hatboro, PA USGS Quadrangle N: 17.7 inches; W: 15.6 inches) in Warminster Township, Bucks County. These activities modify and expand previously permitted activities under Permit No. E09-285.

   E09-735.  Encroachment. The Cutler Group, 5 Sentry Parkway West, Suite 100, Blue Bell, PA 19422. To perform the following activities associated with the proposed Rothrock Tract residential subdivision which will impact 265 linear feet of an unnamed tributary of Mill Creek (TSF) and 0.20 acre of adjacent wetland (PFO/SS):

   1.  To remove the existing outlet works of a dam, and an existing driveway culvert. Also, to construct, operate and maintain an on stream non-scope storm water management dam which includes Red Coat Farm Drive roadway crossing along the dam crest.

   2.  To remove 16 linear feet of an existing 24-inch CMP roadway culvert stream crossing and construct Red Coat Farm Drive roadway stream crossing utilizing 80 linear feet of 53-inch by 34-inch RCP culvert.

   3.  To remove 16 linear feet of an existing 24-inch CMP culvert and construct an on-stream stormwater management facility consisting of an excavated basin, an earth fill non-scope storm water management dam embankment, appurtenant outlet conduit, and a roadway crossing for Pond View Drive along the downstream embankment slope.

   The permit application has met the wetland replacement requirements by participating in the Pennsylvania Wetland Replacement Project. This site is located on the northeast side of Pickertown Road between Stump Road and Lower State Road (Doylestown, PA Quadrangle N: 3.25 inches; W: 7.75 inches) in Warrington Township, Bucks County.

   E45-306.  Encroachment. Michael Berardi, Sr., R. R. 5, Box 5199, East Stroudsburg, PA 18301. To place fill in a man-made pond having a surface area of approximately 0.34 acre and a depth of 4.0 feet for the purpose of eliminating the pond to facilitate commercial development of the site. The project is located along a tributary to Pocono Creek, approximately 300 feet west of S. R. 0611 and 0.75 mile south of the intersection of S. R. 0611 and S. R. 0715 (Mount Pocono, PA Quadrangle N: 6.1 inches; W: 7.4 inches) in Pocono Township, Monroe County.

   E45-307.  Encroachment. Locust Lake Village Property Owners Association, HC 88, Box 121, Pocono Lake, PA 18347. To construct and maintain six dry hydrant intake structures: one in Pilgrim Lake, one in East Lake, two in Locust Lake and two in ''Pines Lake'', for the purpose of fire protection. Each intake structure will consist of a screened 6-inch PVC intake pipe extending approximately 8 feet into the lake, at a depth of 2 feet below the water surface. The project is located in Locust Lake Village, on the north side of S. R. 0940, approximately 7 miles west of S. R. 0380 (Thornhurst, PA Quadrangle N: 2 inches; W: 7 inches) in Tobyhanna Township, Monroe County.

   E48-239.  Encroachment. Department of Transportation, Engineering District 5-0, 1713 Lehigh Street, Allentown, PA 18103. To remove the existing structure and to construct and maintain a road crossing of a tributary to Little Bushkill Creek, consisting of dual 18.0-foot by 5.0-foot precast concrete box culverts with their inverts depressed 1.0 foot below streambed elevation. The project is located on S. R. 0512, Section 01B, approximately 1,000 feet northeast of the center of the interchange of S. R. 0033 and S. R. 0512 (Wind Gap, PA Quadrangle N: 15.5 inches; W: 6.5 inches), in Plainfield Township, Northampton County.

   E05-242.  Encroachment. Department of Transportation, Engineering District 9-0, Earl Neiderhiser, 1620 North Juniata Street, Hollidaysburg, PA 16648. To remove the existing structure and to construct and maintain a bridge having a clear span of 58.6 feet on a 55 degree skew with a minimum underclearance of 8.9 feet across Scrubgrass Creek on SR 4034, Section 001, Segment 0030, offset 0759 located about 0.8 mile west of Imler Village (Alum Bank, PA Quadrangle N: 15.5 inches; W: 5.3 inches) in King Township, Bedford County. This permit also includes 401 Water Quality Certification.

   E06-485.  Encroachment. Charles and Theresa Ziegler, 1279 Powder Mill Hollow Road, Boyertown, PA 19512. To place fill in 0.18 acre of wetlands adjacent to Ironstone Creek at a point along the north side of South Reading Avenue approximately 300 feet west of the intersection of South Reading Avenue and Mill Street (Boyertown, PA Quadrangle N: 13.8 inches; W: 3.5 inches) in Colebrookdale Township, Berks County. The permit applicant has met the wetland replacement requirement by participating in the Pennsylvania Wetland Replacement Project.

   E07-275.  Encroachment. New Enterprises Stone & Lime Co., Inc., P. O. Box 77, Church Street, New Enterprise, PA 16664. To maintain a previously constructed foot bridge across Halter Creek having a span of 48 feet and a maximum underclearance of about 5.5 feet to provide access from a parking area to office buildings located approximately 500 feet east of SR 0036 about 1.0 mile north of the Roaring Spring Borough corporate boundary (Roaring Spring, PA Quadrangle N: 17.3 inches; W: 4.0 inches) in Taylor Township, Blair County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E67-577.  Encroachment. Department of Transportation, Engineering District 8-0, John Rautzahn, 2140 Herr Street, Harrisburg, PA 17103. To remove existing structure and to construct and maintain a prestressed adjacent plank beam bridge with a normal span of 24 feet and a minimum underclearance of 5 feet, 6 inches over Fishing Creek on SR 2031, Segment 0030, Offset 0272. A corner of the masonary wall will be removed and replaced with a reinforced concrete retaining wall at the confluence of the tributary immediately upstream from the bridge (Red Lion, PA Quadrangle N: 7.29 inches; W: 11.25 inches) in Windsor Borough, York County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

To construct and maintain a nonjurisdictional dam across a tributary to Hodgson Run (HQ-TSF;MF) impacting approximately 0.13 acre of wetlands (PSS) for the purpose of stormwater management and access at the proposed Saginaw Farms subdivision. Requests for Certification under Section 401 of the Federal Water Pollution Control Act

   The following requests have been made to the Department of Environmental Protection for certification under § 401(a) of the 1972 amendments to the Federal Water Pollution Control Act, 33 U.S.C.A. § 1341(a), that there is reasonable assurance that the construction herein described will not violate applicable Federal and State water quality standards.

   Prior to final approval of the proposed certification, consideration will be given to any comments, suggestions or objections which are submitted in writing 30 days of the date of this Notice. Comments should be submitted to the Department of Environmental Protection at the address indicated above each of the following requests for certification. All comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments/objections are addressed, and a concise statement of comments, objections or suggestions in sufficient detail to inform the Department of the exact basis of the proposal and the relevant facts upon which it is based. The Department may conduct a fact-finding hearing or an informal conference in response to any given comments if deemed necessary to resolve conflicts. Each individual will be notified in writing of the time and place of any scheduled hearing or conference concerning the certification request to which the protest relates. Maps, drawings and other data pertinent to the certification request are available for inspection and review at the address indicated above each request for certification between the hours of 8 a.m. and 4 p.m. on each working day.
