Philadelphia Air Management Services Notice of Intent to Approve Construction and Operation of Sun Company's, Inc. Cumene Expansion Project

   Applicant: Sun Company, Inc., Girard Point Facility

   Source Description: Cumene Expansion Project

   Sun Company Inc. (Sun) has requested Air Management Services (AMS) for a permit to expand its cumene process. Annual emissions from the cumene expansion project are: 58.6 tons of nitrogen oxides, 4.6 tons of volatile organic compounds, 90 tons of sulfur dioxide, 8.7 tons of particulate matter and 5.3 tons of carbon monoxide. For purposes of this project, Sun has applied emission reduction credits against the nitrogen oxide and sulfur oxide emissions.

   AMS is making a preliminary determination of approval for the cumene expansion project described above.

Philadelphia Air Management Services Notice of Intent to Approve a Permit for Construction and Operation of Kalmbach Feed Ingredients, Inc. Animal Feed Production Process

Reasonably Available Control Technology

(RACT)


Notice of Proposed Revision to the State Implementation Plan for Oxides of Nitrogen and Volatile Organic Compounds and Notice of Public Hearing

   Approval of Reasonably Available Control Technology (RACT) plan for Strick Corporation in Berwick Borough, Columbia County.

   The Department of Environmental Protection has made a preliminary determination to approve a Reasonably Available Control Technology (RACT) plan and an amendment to the State Implementation Plan (SIP) for a truck trailer chassis manufacturing facility owned and operated by Strick Corporation in Berwick Borough, Columbia County.

   The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the RACT approval for the facility to comply with current regulations.

   The preliminary RACT determination, if finally approved, will be incorporated into an operating permit for the facility and will be submitted to the U. S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan.

   The only air contamination sources to be addressed in the proposed operating permit are 21 small combustion units (20 space heaters and one gas-fired oven) and surface coating equipment cleanup activities (spray gun cleaning, spray line flushing, and the like). The preliminary RACT determination for these sources is that the volatile organic compound emissions from each of the respective two air contamination source categories (''small combustion units'' and ''surface coating equipment cleanup activities'') shall remain below 3 pounds per hour, 15 pounds per day and 2.7 tons per year.

   One public hearing will be held for the purpose of receiving comments on the proposed operating permit and the proposed SIP revision. The hearing will be held on May 20, 1997, at 1 p.m. at the DEP Northcentral Regional Office, 208 West Third Street, Suite 101, Williamsport, PA. The public is invited to comment on the proposal. Persons interested in commenting are invited to appear at the public hearing.

   Persons wishing to present testimony at the hearing should contact Daniel Spadoni at (717) 327-3659 at least 1 week in advance of the hearing to reserve a time to present testimony. Oral testimony will be limited to a maximum of 10 minutes per individual and two written copies of the oral testimony are requested. Each organization is requested to designate one witness to present testimony on its behalf.

MINING

CONDUCT COAL AND NONCOAL ACTIVITIES

MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.31); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.

   Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).

   Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. Such NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor, application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

Bureau of Deep Mine Safety; Request for Variance

   The Bureau of Deep Mine Safety has received a request for variance from the Cyprus Cumberland Resources Corporation. The following notification contains a summary of this request. Complete copies of the variance request may be obtained from Glen Ziegler by calling (717) 772-4006.

   The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice. All comments should be addressed to Richard E. Stickler, Director, Bureau of Deep Mine Safety, P. O. Box 8463, Harrisburg, PA 17105-8463.

   Section 702 of The Bituminous Coal Mine Act (52 P. S. § 702) provides a mechanism for operators to obtain variances from specific requirements of the Act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

   Section 268(b) of The Bituminous Coal Mine Act, entitled Clearances and Shelter Holes, requires that shelter holes be provided on the clearance side along designated travelingways that are also used as haulage entries, other than belt conveyor haulage entries. These shelter holes shall be spaced not more than 80 feet apart.

   Summary of the request: Cumberland Resources wishes to extend the maximum distance between shelter holes to 130 feet along main line haulage entries at the Cumberland Mine.

APPLICATIONS RECEIVED UNDER SECTION 401: FEDERAL WATER POLLUTION CONTROL ACT

ENCROACHMENTS

   The following permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection.

   In addition to permit applications, the Bureau of Dams, Waterways and Wetlands (BDWW) and the Regional Office Soils and Waterways Sections have assumed primary responsibility for processing requests for certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), for projects requiring both a Dam Safety and Encroachments Permit, and a United States Army Corps of Engineers (ACOE) permit. Section 401(a) of the Federal Water Pollution Control Act requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1301--1303, 1306, 1307, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the BDWW permit application. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Safety or Encroachment Permit, or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the Bureau or Field Office indicated as the responsible office.

   E46-769.  Encroachment. PA DOT, 200 Radnor-Chester Rd., St. Davids, PA 19087-5178. To modify, operate and maintain an existing stream enclosure in and along an unnamed tributary to Tacony Creek which conveys stream flow beneath Township Line Road (S. R. 0073). The project proposes a roadway widening to accommodate increased automobile traffic volume and will require the extension of the 178-foot long existing stream enclosure for an additional 20 feet by constructing a cast-in-place 34-inch high by 78-inch wide, reinforced concrete box culvert, adjoining the downstream end. The project also includes removal of an existing concrete headwall, construction of a new approximately 60-foot long reinforced concrete endwall, and repair of existing masonry stone walls along the edge of the stream. The site is located at the intersection of Township Line Road and Foxcroft Road approximately 0.25 mile southeast from S. R. 0611 (Frankford, PA-NJ Quadrangle N: 15.4 inches; W: 17.4 inches) in Cheltenham and Abington Townships, Montgomery County.

   E09-748.  Encroachment. Sesame Place, 100 Sesame Road, Langhorne, PA 19047. To construct a parking facility expansion impacting 0.35 acre of wetlands (PSS1) at Sesame Place Amusement Park located at the intersection of Town Center Drive and North Buckstown Drive (Langhorne, PA Quadrangle N: 11.4 inches; W: 0.1 inch) in Middletown Township, Bucks County.

   E46-414.  Encroachment. PA DOT, 200 Radnor-Chester Road, St. Davids, PA 19087-5178. To reissue and amend Permit No. E46-414 for the extension and maintenance of an existing 10-foot by 5-foot box culvert which exists under Horsham Road (SR 0463) and along a tributary to Park Creek. Work also includes:

   1.  Extend the Horsham Roadway culvert by 15 feet on the upstream end and 45 feet on the downstream end;

   2.  To construct and maintain a concrete retaining wall associated with the culvert's outlet structure;

   3.  To extend by 85 linear feet of an existing 36-inch R.C.P. stream enclosure.

   The site is located approximately 434 feet southeast from the intersection of Babylon and Horsham Roads (Ambler, PA Quadrangle N: 13.6 inches; W: 5.9 inches) in Horsham Township, Montgomery County.

   E46-766.  Encroachment. Manufacturers' Golf and Country Club, 511 Dreshertown Rd., P. O. Box 90, Oreland, PA 19075. To modify, operate and maintain golf course foot bridge across Sandy Run (WWF) and to construct and maintain a 90-foot long retaining wall along Sandy Run (WWF) near the 18th Fairway, at the Manufacturers' Golf and Country Club property. The site is located at 511 Dreshertown Road (Ambler, PA Quadrangle N: 0.3 inch; W: 6.5 inches) in Upper Dublin Township, Montgomery County.

   E09-236A2.  Encroachment. Jack's Neshaminy Marina, Inc., 100 River Road, Croydon, PA 19020. To amend Permit No. E09-236A which authorized construction and maintenance of an existing Marina Lagoon and travel Lift Slip and to perform maintenance dredging along the east bank of the Neshaminy Creek at points 1,250 feet to 3,000 feet upstream from the confluence of the Neshaminy Creek with the Delaware River in Bristol Township, Bucks County.

   The permit also includes the following work:

   1.  To maintain a 6-foot wide ''L'' shaped pier which extends parallel to the Neshaminy Creek for 300 feet and is attached to an 80-foot section which extends eastward. This dock is located approximately 3,300 feet upstream from the confluence with the Delaware River.

   2.  To maintain a 6-foot wide, 140-feet long pier along the east bank of the Neshaminy Creek at a point 1,500 feet from the confluence of the Delaware River.

   3.  To operate and maintain an existing 45-foot × 51.5-foot restaurant building which is located along the east bank and in the 100-year floodway of the Neshaminy Creek at a point 1,500 feet upstream from the confluence of the Neshaminy Creek and the Delaware River. Jack's Marina is located along the east bank of the Neshaminy Creek (Beverly PA-NJ Quadrangle N: 16 inches; W: 5.5 inches) in Bristol Township, Bucks County.

   Permit is to be amended to include the following:

   1.  To construct and maintain a ''U'' shaped bulkhead which extend approximately 310 feet parallel to the north of Neshaminy Creek to a point where the bulkhead extends 75-foot north then bends 90 degree and extends eastward 180 feet. Eighty foot long bulkheads will also be installed adjacent to each side of the existing boat rail line launching ramp. The bulkhead is located in the vicinity of an existing ''L'' shaped floating dock, and approximately 3,300 feet upstream from the Neshaminy Creek confluence with the Delaware River.

To construct a multi-use student recreation facility entrance spanning a watercourse and wetland. The span will be approximately 17 feet high, 36 feet maximum width and 65 feet long. This structure will span approximately 0.02 acre of wetland and 65 linear feet of an unnamed tributary of Slippery Rock Creek (CWF). These wetlands are not exceptional value and are disturbed palustrine, emergent, seasonally flooded, freshwater, mineral soil wetlands. Project includes construction of 0.02 acre of replacement wetland at the same project site. The total project is approximately 9.0 acres in size and is located approximately 0.50 mile east of the intersection of S. R. 0173 and Keister Road on the north side of Keister Road (Slippery Rock, PA Quadrangle N: 10.90 inches; W: 05.70 inches) located in Slippery Rock Township, Butler County.

   EA26-001SW.  Environmental Assessment. Western PA Coalition for Abandoned Mine Reclamation, Donohoe Ctr., R R 12, Box 202B, Greensburg, PA 15601. To periodically place high-quality alkaline (limestone) sand in the floodway of Glade Run (HQ-CWF) and two unnamed tributaries to Glade Run. This will allow high flow events to distribute the material downstream where it would dissolve to mitigate non-point source acid mine drainage by reducing acidity levels and raising the stream PH.
