CRAWFORD COUNTY

In the Matter of the Adoption of Rules of Criminal Procedure; No. 1995-771

Order

   And Now, February 25, 1998, it is ordered as follows:

   1. The following amendments are made to the Crawford County Rules of Criminal Procedure and will become effective thirty (30) days after publication in the Pennsylvania Bulletin.

   2. The Clerk of Courts is ordered and directed to:

   a. File seven (7) certified copies of this order with the Administrative Office of Pennsylvania Courts.

   b. Distribute two (2) certified copies of this order to the Legislative Reference Bureau for publication in the Pennsylvania Bulletin.

   c. File one (1) certified copy of this order with the Criminal Procedural Rules Committee.

   d. Keep continuously available for public inspection a copy of this order and the amended rules.

   3. Rule C9020 ''Motions'' is amended in two respects.

   Rule C9020 B (2) shall be amended to read as follows:

   Filing of uncontested motions. Uncontested motions shall be filed with the Clerk of Courts, properly timed stamped and docketed, and then sent to the Court Administrator. The Court Administrator will set an appropriate hearing or argument date or present the same to the Motions Judge for the entry of any order.

   Rule C9020 C is amended with the addition of the following:

   While contested motions should be filed with the Clerk of Courts pursuant to Pa.R.Crim.P. 9022 a motion may be presented to the Court in Motions Court under the procedure set forth above because the Court immediately files the motion and order with the Clerk of Courts during Motions Court.

   4. A new rule C9025 is hereby adopted and reads as follows:

   Rule C9025 Notice and Docketing of Orders

   In order that the Clerk of Courts may comply with Pa.R.Crim.P. 9025 counsel and pro se defendants shall list their addresses on any initial filings and are required to file a notice of any change of address that occurs during the pendency of the proceeding. When the Clerk of Courts sends a first class mailing, postage prepaid to the last known address of record there is created a presumption of service/receipt of said mail article and the contents thereof.
