ACTIONS TAKEN UNDER SECTION 401:  FEDERAL WATER POLLUTION CONTROL ACT

ENCROACHMENTS

   The Department of Environmental Protection (Department) has taken the following actions on previously received Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   Persons aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, 400 Market Street, Floor 2, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, 1 (800) 654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of the written notice of this action unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decisional law.


Actions on applications filed under the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27) and section 302 of the Flood Plain Management Act (32 P. S. § 679.302) and sections 5 and 402 of The Clean Streams Law (35 P. S. §§ 691.5 and 691.402) and notice of final action for certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)). (Note:  Permits issued for Small Projects do not include 401 Certification, unless specifically stated in the description.)

   Northeast Regional Office, Regional Soils and Waterways Section, 2 Public Square, Wilkes-Barre, PA 18711-0790, (717) 826-5485.

   E58-223. Encroachment. Borough of Hop Bottom, Forrest Street, Box 175, Hop Bottom, PA 18824. To remove existing structures and to construct and maintain playground facilities in the floodplain of Martins Creek, for the purpose of reconstructing the existing Mary Karhnak Memorial Park. The project includes the removal of old playground equipment; installation of new playground equipment; and placement of minor amounts of fill for the construction of a basketball and volleyball court, and wood chip play surfaces. The park is located on the east side of S. R. 2002 (Greenwood Street), approximately 0.25 mile south of the intersection of S. R. 2002 and S. R. 0167 (Main Street) (Hop Bottom, PA Quadrangle N:  14.0 inches; W:  2.3 inches), in the Borough of Hop Bottom, Susquehanna County.

   Northcentral Region, Water Management, Soils and Waterways, F. Alan Sever, Chief, 208 West Third St., Williamsport, PA 17701.

   E08-329. Encroachment. Robert J. Ehoff, RR 2, Box 227B, Towanda, PA 18848. To maintain two 17-foot long 7.5-foot diameter steel culverts in an unnamed tributary to the Susquehanna River located approximately 1,600 feet northbound on Brook St. from SR 0187 (Wylusing, PA Quadrangle N:  17.6 inches; W:  14.3 inches) in Asylum Township, Bradford County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E17-316. Encroachment. Robert W. Gallagher, P. O. Box 85, Brisbin, PA 16620. To place and maintain approximately 4 feet of fill for small machinery storage in the floodway of Goss Run located next to Princess St. just upstream of Larch Alley (Houtzdale, PA Quadrangle N:  15.9 inches; W:  13.8 inches) in Brisbin Borough, Clearfield County. This permit was issued under section 105.13(e) Small Projects.

   E18-239. Encroachment. DCNR, Bureau of Facility Design & Construction, P. O. Box 8451, Harrisburg, PA 17105. Remove an existing structure and to construct, operate and maintain a single cell reinforced concrete box culvert to carry Robinson Road across Wilcox Branch, Young Womens Creek. The box culvert shall be cast in place with a clear single span of 14.4 feet, minimum underclearance of 4.5 feet and a skew of 76 degrees left ahead. The project is located along the western right of way of SR 0044 approximately 2,000 feet south of the intersection of County Line Road and Robinson Road (Slate Run, PA Quadrangle N:  18.1 inches; W:  16.4 inches) in Chapman Township, Clinton County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E18-243. Encroachment. Dept. of Conservation & Natural Resources, Bureau of Forestry, P. O. Box 8552, Harrisburg, PA 17105. To remove the existing structure and to construct and maintain a single span steel stringer bridge with a glulam timber deck and a clear span of approximately 25 feet, a curb to curb width of approximately 11 feet and an underclearance of 5.61 feet over Cooks Run on Cooks Run Road at the intersection of Cooks Run and Onion Run (Keating, PA Quadrangle N:  12.9 inches; W:  8.0 inches) in East Keating Township, Clinton County.

   E18-246. Encroachment. International Paper Co., Lock Haven Mill, P. O. Box 268, Lock Haven, PA 17745-0268. To operate and maintain an existing spillway structure and wood piling in and under the canal wall in the vicinity of the spillway of the Pennsylvania Canal system. The sub facility is located on the south side of Rt. 150 approximately 1/2 mile east of the intersection of Rt. 150 with US Rt. 220 (Mill Hall, PA Quadrangle N:  22.1 inches; W:  13.2 inches) in Flemington Borough, Clinton County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E18-248. Encroachment. Western Clinton County Municipal Authority, P. O. Box 363, Renovo, PA 17764. To stabilize with concrete and riprap and maintain an 8 inch and 12 inch concrete encased sanitary sewer line under Paddy Run located just upstream and downstream of the SR 120 bridge (Renovo East, PA Quadrangle N:  15 inches; W:  14 inches) in Renovo Borough, Clinton County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E41-414. Encroachment. DCNR, Bureau of Forestry, P. O. Box 8552, Harrisburg, PA 17105. To construct and maintain a low flow crossing utilizing nine 13-inch by 17-inch by 15-foot arch metal culvert spaced 32 inches apart with its associated hemlock endwalls and limestone cover for a total crossing length of 36 feet across Hawk Run located approximately 200 feet upstream of Hawk Run's confluence with Rock Run (Ralston, PA Quadrangle N:  8.2 inches; W:  0.6 inch) in McIntyre Township, Lycoming County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E47-064. Encroachment. Pa. Dept. of Environmental Protection, P. O. Box 218, Montoursville, PA 17754. To 1) remove an existing Parker Through-truss bridge and to construct and maintain a seven span Continuous Composite Steel I-Girder Bridge with a Reinforced Concrete Deck Slab, 6 piers, a span of 1,440 feet and a minimum underclearance of 28.5 feet located on SR 0054, Section 14 over the North Branch of the Susquehanna River 2) construct and maintain a 22 foot 7.25 inch long 6 foot by 8 foot cast-in-place concrete box culvert which will connect two existing culverts located 260 feet southeast of the SR 0054 and South D&H Ave. (Danville, PA Quadrangle N:  15.06 inches; W:  16.8 inches) in the Borough of Danville, Montour County and the Borough of Riverside, Northumberland County. The 2 year construction project will be using a variety of temporary causeways and coffer dams.

   E53-307. Encroachment. DCNR, Bureau of Forestry, P. O. Box 673, Coudersport, PA 19151. To construct and maintain a 24 inch diameter C. M. culvert, 20 feet long, in an unnamed tributary to Wingerter Run located approximately 1,000 feet south of SR 44 and 0.6 mile east of the intersection of SR 44 and Junction Road (Cherry Springs, PA Quadrangle N:  3.2 inches; W:  6.8 inches) in Abbott Township, Potter County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E59-354. Encroachment. Georgia Pacific Corp. 71 McMurray Rd., Suite 108, Pittsburgh, PA 15241-1632. To place and maintain fill in a 0.28 acre palustrine scrub-shrub and forested wetland for the purpose of improving traffic flow at an existing hardwood sawmill. To compensate for unavoidable impacts, the permit applicant proposes to construct 0.94 acre of onsite replacement wetland. The project is located along the west side of SR 15 approximately 6 miles north of Tioga, PA and 3.5 miles south of the PA-NY state boundary line (Jackson Summit, PA Quadrangle N:  13.2 inches; W:  14.4 inches) in Lawrence Township, Tioga County.

   Southwest Regional Office, Soils and Waterways Section, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E65-684. Encroachment. City of New Kensington, 301 Eleventh Street, New Kensington, PA 15068. To remove the existing structure and to construct and maintain a single span bridge having a normal span of 45.0 feet and a minimum underclearance of 8.5 feet across Little Pucketa Creek for the purpose of improving structural integrity. This permit also authorizes the construction and maintenance of a temporary causeway in Little Pucketa Creek at the bridge location. The project is located at the eastern end of Fourth Street (New Kensington West, PA Quadrangle N:  10.4 inches; W:  1.3 inches) in the City of New Kensington, Westmoreland County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E02-1212. Encroachment. Urban Redevelopment Authority of Pittsburgh, 200 Ross Street, Pittsburgh, PA 15219. To rehabilitate and maintain the Monongahela Connecting Railroad Bridge across the Monongahela River for use as a vehicular bridge and primary site access to the proposed Southside Works mixed-use development located near river mile 3.1 (Pittsburgh East, PA Quadrangle N:  9.7 inches; W:  11.8 inches) in the City of Pittsburgh, Allegheny County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E26-234. Encroachment. Pa. Department of Conservation and Natural Resources, Bureau of State Parks, 400 Rachel Carson State Office Building, 8th Floor, P. O. Box 8451, Harrisburg, PA 17105-8451. To remove the superstructure of the Western Maryland Railroad Bridge and to construct and maintain a new superstructure for pedestrian traffic across the Youghiogheny River (HQ-CWF) located just downstream of S. R. 381 bridge. The project includes construction and maintenance of a 250-foot long temporary causeway (Ohiopyle, PA Quadrangle N:  21.9 inches; W:  16.7 inches) in Ohiopyle Borough, Fayette County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E63-443. Encroachment. Dredge Docks, Inc., 1231 River Avenue, Pittsburgh, PA 15212. To construct and maintain a 525 foot long barge dock along the left bank of the Monongahela River, near River Mile 59.8 (Carmichaels, PA Quadrangle N:  22.3 inches; W:  9.2 inches) in Centerville Borough, Washington County.

   ENVIRONMENTAL ASSESSMENT

   Central Office:  Bureau of Waterways Engineering, 400 Market Street, 6th Floor, P. O. Box 8554, Harrisburg, PA 17105-8554, (717) 787-8568.

   EA09-013CO. Environmental Assessment. Trueblood Construction Company (904 Sumneytown Pike, Springhouse, PA 19477). To construct and maintain two nonjurisdictional dams in the watershed of a tributary to Jericho Creek (WWF) impacting approximately 0.14 acre of wetland (PEM) for the purpose of stormwater management at the proposed Ely Farm subdivision located approximately 2,200 feet northeast of the intersection of Woodhill Road (T-367) and Slack Road (T-384) (Lambertville, PA-NJ Quadrangle N:  8.85 inches; W:  4.20 inches) in Upper Makefield Township, Bucks County. The applicant has made a contribution to the Pennsylvania Wetland Replacement Project as compensatory mitigation for wetland impacts.

   EA15-020CO. Environmental Assessment. G. William and James R. Freese (203 Hilltop Road, Oxford, PA 19363). To construct and maintain a nonjurisdictional dam across a tributary to Little Elk Creek (HQ-TSF; MF) for the purpose of stormwater management at a proposed residential subdivision on the Freese Tract located immediately north of the intersection of Hickory Hill Road (S. R. 0472) and Freese Road (T-334) (Oxford, PA Quadrangle N:  2.9 inches; W:  8.3 inches) in East Nottingham Township, Chester County.

   EA40-004CO. Environmental Assessment. R. N. Fitch and Sons, Inc. (185 Huntsville Road, Dallas, PA 18612). To construct and maintain a nonjurisdictional dam across a tributary to Trout Brook (CWF) impacting a de minimis area of wetland (PSS) equal to 0.04 acre for the purpose of stormwater management at the proposed Winterberry residential development located approximately 1,600 feet south of the intersection of Upper Demunds Road (S. R. 1041) and Seidler Road (T-819) (Kingston, PA Quadrangle N:  19.8 inches; W:  9.4 inches) in Dallas Township, Luzerne County.
