LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

Preamble 3


The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

   For further information concerning the final report, contact the Environmental Cleanup Program in the Department Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office listed. Permits revoked under the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003) and regulations to operate solid waste processing or disposal area or site.

   Regional Solid Waste Manager: Suite 6010, Lee Park, 555 North Lane, Conshohocken, PA 19428.

   Permit No. 301184.  Gemstar Corporation, R. D. 1, Coopersburg, PA 18936. This permit for a waste tire processing facility located in Springfield Township, Bucks County, has been revoked because of, but not limited to, violations of the Solid Waste Management Act and an Administrative Order issued by the Department on December 11, 1996. In addition, the facility's $30,000 bond has been forfeited. In a related action, a permit application for renewal and modification of the facility's waste permit has been denied. Permit revoked and bond forfeited by the Southeast Regional Office on May 15, 1998.

   A.  301184.  Gemstar Corporation, R. D. 1, Coopersburg, PA 18936. This permit application for renewal and modification of a waste tire processing facility located in Springfield Township, Bucks County, was denied because of, but not limited to, the applicant's noncompliance with the Solid Waste Management Act, the environmental protection acts, 25 Pa. Code Chapters 287 and 297 and Article 1, Section 27 of the Pa. Constitution. In related actions, the facility's existing waste permit No. 301184 has been revoked and the bond forfeited. Permit application denied by the Southeast Regional Office on May 5, 1998.

This application for a construction and demolition waste transfer facility to be located at 10-12 Reaney Street in the City of Chester, Delaware County was denied because of outstanding technical deficiencies and nonresponsiveness by the applicant. The permit application was denied by the Southeast Regional Office on June 2, 1998.

Environmental Assessment Approvals and Actions on 401 Certification

To breach and remove the Cabin Hill Dam across Spring Creek (CWF) for the purpose of restoring the stream to a free flowing condition. The dam is located approximately 1,200 feet upstream of the confluence of Spring Creek and Bald Eagle Creek (Bellefonte, PA Quadrangle N: 11.70 inches; W: 5.25 inches) in Borough of Milesburg, Centre County.

   EA15-022C0.  Environmental Assessment. Richard H. Carnathan (315 Gum Tree Road, Coatesville, PA 19320). To construct and maintain a nonjurisdictional dam across a tributary to Buck Run (TSF, MF) impacting a de minimis area of wetland (PEM) equal to 0.03 acres for aesthetics located approximately 1,800 feet northeast of the intersection of Buck Run Road (S. R. 3043) and Doe Run Road (Coatesville, PA Quadrangle N: 8.3 inches; W: 14.5 inches) in Highland Township, Chester County.

102/NPDES/Stormwater Construction Activities

   Notice is hereby given that the Department of Environmental Protection (DEP) Water Management Program will be holding a fact finding hearing on the following Stormwater NPDES permit application: SR 202, Section 402, and US Route 202 Improvement Project, PAS10-G324.

   The hearing is scheduled for July 21, 1998, at 1:30 p.m. at Chester County Conservation District Office, Government Services Center, Conference Room 240, 610 Westtown Road, West Chester, PA 19382-4519, Chester County. The hearing is being held to solicit pertinent comments on this application. The application is for stormwater construction activities, with a discharge to Little Valley and Trout Creeks. A copy of this application is available for review in the Southeast Regional Office's Record Management Section, (610) 832-6268. Those interested in reviewing the application should call to schedule a date to review the file. The project sponsor is: PA Department of Transportation, Engineering District 6-0, 200 Radnor-Chester Roads, St. Davids, PA 19087.

   Comments received will be considered by DEP in completing its review and prior to taking final action concerning the application. The hearing will not be a question and answer session.

   Anyone intending to make a presentation at the hearing should submit written notice to the Regional Manager, Water Management Program at the above address. The notice should include your name, address and phone number, whether you are opposed or in favor of the project and a brief statement about your presentation. Comments should be kept brief and, depending on the number of speakers, may be limited to 10 minutes per speaker. Where groups are represented, a spokesperson is requested to present the group's concerns. Anyone wishing to present written material directly to DEP may do so within 30 days following the hearing.
