Application of Western Pennsylvania Hospital for Exception to 28 Pa. Code § 153.1(c)
[28 Pa.B. 4761] Under 28 Pa. Code § 51.33 (relating to requests for exceptions), the Department of Health (Department) hereby gives notice that Western Pennsylvania Hospital has requested an exception to the requirements of 28 Pa. Code § 153.1(c), referencing the National Fire Protection Association's Life Safety Code, NFPA 101, which requires under section 1-4.6 that any alterations or any installations of new equipment must be accomplished as nearly as practical in conformance with the requirements for new construction. Under the provisions of the Code, alterations should not diminish the level of life safety below that which exists prior to the alteration. Section 31-1.2.2.1 of the Life Safety Code also prohibits furnishings, decorations or other objects placed to obstruct exits or the visibility of exits.
Western Pennsylvania Hospital is requesting an exception/waiver for the installation of patient chart racks which are surface-mounted on the exit corridor walls, and encroach upon the minimum exit width of 8`0" approximately 3 1/2 inches in the closed position. The hospital contends that the chart rack doors are self-closing and are not used as work stations. Thus, the hospital argues that any encroachment is minimized.

Comments received by the Department within 10 days after the date of publication of this notice will be reviewed by the Department before it decides whether to approve or disapprove the request for exception.
