Notice of Intent to Promulgate Regulation and Request for Public Participation
[28 Pa.B. 6125] The Department of Transportation, Bureau of Construction and Materials, pursuant to the authority contained in Sections 670-101, et seq. of the State Highway Law, 36 Pa.C.S. Section 670-101, et seq., announces its intention to amend Title 67 of Department Regulations by amending Chapter 457, Prequalification of Bidders.
The purpose of this rulemaking is to amend the existing regulations by including provisions recommended by the Department's Business Process Re-engineering team, comprised of contractors and Department employees. These provisions are related to the processing and evaluation of the financial capacity, work classifications and past performance history of contractors and subcontractors to determine their qualifications to perform highway and bridge construction work in Pennsylvania. These amendments are intended to implement changes to streamline the process of prequalifying the contractors and subcontractors, and to ensure that only quality contractors are building highways and bridges in this Commonwealth.
The Department anticipates that this rulemaking will directly affect persons who apply for or are currently prequalified to bid on and perform highway project work in this Commonwealth.
The Department requests that, within 30 days of the publication of this notice in the Pennsylvania Bulletin, all interested persons desiring to participate in the development of this rulemaking or having questions, suggestions, or comments on prequalification of bidders regulations, please contact Fred N.
