E46-820. Encroachment Permit. Plymouth Township, Community Center, 2910 Jolly Road, Norristown, PA 19401-2325. To construct and maintain a timber deck bridge with concrete abutments and wing walls across an unnamed tributary to Plymouth Creek (WWF). The proposed bridge will provide access to the Harriet Wetherill Park. This 22.5 foot clear span bridge will have a 15-foot roadway width, and have 4 feet 8 inches of minimum underclearance. The work also includes placing rip-rap stone protection along abutments and wing walls. A 15-inch R.C.P. drainage culvert will be installed through the westerly approach road fill to provide adjacent wetland hydrology. The site is located approximately 1,000 feet south from the intersection of Narcissa Road and Hickory Road at the entrance to Wetherill Park off Narcissa Road (Norristown, PA Quadrangle N: 21.3 inches; W: 3.2 inches) in Plymouth Township, Montgomery County. To repair and maintain the existing 6.7-foot by 6.7-foot precast concrete arch stream enclosure in a tributary to Black Creek, with work consisting of replacing the undermined, displaced culvert sections and restoring/protecting approximately 140 linear feet of downstream channel. The channel work will include placement of fill to restore the eroded area, and construction of a trapezoidal R-7 riprap-lined channel with two plunge pools. The project is located approximately 250 feet west of S. R. 0081, approximately 2,000 feet south of the intersection of S. R. 0081 and S. To construct, operate and maintain a parking area in the floodway of an unnamed tributary to Shamokin Creek; and to construct, operate and maintain a pedestrian bridge across an unnamed tributary to Shamokin Creek to provide access to an existing medical facility. The construction of the parking area shall consist of the removal of existing vegetation and earth and placing sub-base and crushed stone that will not exceed existing elevations and contours. The pedestrian bridge shall be constructed with a maximum width of 5-feet and a maximum span of 24-feet that is located along the eastern right-of-way of S. R. 0054 approximately 100-feet north of the intersection of West Center Street and S. R. 0045 (Shamokin, PA Quadrangle N: 20.8 inches; W: 7.3 inches) in Ralpho Township, Northumberland County. This permit also authorizes the construction, operation and maintenance of a stormwater outfall structure that shall be in accordance with the Department of Environmental Protection's BDWWGP-4. Act 91
Amending Title 30 (Fish) of the Pennsylvania Consolidated Statutes Providing for the Marking of Dams Under its responsibility under Act 91, the Department of Environmental Protection (Department), Bureau of Waterways Engineering, Division of Dam Safety has compiled and maintains the following list of existing dams on the waters of this Commonwealth that the Department determines to be run-of-the-river type dams. The Department has notified the permittees and owners of these run-of-the-river dams and advised them of their duties and responsibilities to mark these dams under Act 91 in accordance with guidelines established by the Fish and Boat Commission.
Act 91 requires permittees and owners of run-of-the-river dams to maintain warning signs and buoys and provides for civil penalties for any permittee or owner who fails to maintain signs and buoys in accordance with Fish and Boat Commission Guidelines. The Act also provides that exclusion zones above and below these dams be established by the Fish and Boat Commission and that persons who enter an exclusion zone marked under the provisions of the Act commits a summary offense of the third degree.
Persons aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, Second Floor, Market Street State Office Building, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period.
