PLAN APPROVAL


Plan approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

   For further information concerning the final report, contact the Environmental Cleanup Program Manager in the Department's Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office listed. Bones, Pennoni Associates, Inc., 3001 Market Street, Philadelphia, PA 19104, has submitted a Final Report concerning remediation of site soils contaminated with polycyclic aromatic hydrocarbons. The report is intended to document remediation of the site to meet the Statewide health standard.

   Katz & Katz, Hilltown Township, Bucks County. Michael A. Christie, P.G., Penn Environmental & Remediation, Inc., 2755 Bergey Road, Hatfield, PA 19440, has submitted a Final Report concerning remediation of site soils contaminated with petroleum hydrocarbons. The report is intended to document remediation of the site to meet the Statewide health standard.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.

   Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act (act). Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The Final Report demonstrated attainment of the Statewide health standard and was approved by the Department on April 22, 1999.

   Cecilia Kearns Residence, East Conemaugh Borough, Cambria County. David R. Crowther, Hydrocon Services, Inc., 2945 South Pike Avenue, Allentown, PA 18103, has submitted a final report concerning remediation of site soil contaminated with BTEX and PAHs. The final report demonstrated attainment of the Statewide health standard and was approved by the Department on April 9, 1999.

   Johnny Jones Building, City of Pittsburgh, Allegheny County. James Fleming, RECON/JRF Investments, 6550 Hamilton Avenue, Pittsburgh, PA 15232 and David R. Perry, American Geosciences, Inc., 3925 Reed Boulevard, Suite 400, Murrysville, PA 15668-1848, have submitted a Baseline Environmental Report concerning remediation of site soil and groundwater contaminated with PCBs, lead, heavy metals, solvents and PHCs. The Baseline Environmental Report was approved by the Department on April 28, 1999. The report delineates contamination existing onsite and will be the basis for any site remediation necessary under a Consent Agreement using the special industrial area requirements.

   Progress Park Lot 7, City of Lebanon, Lebanon County. Joanne and Barry McGee (t.d.b.a. Joanne M. McGee Cleaning and Janitorial Service, Inc.) 119 Buck Run, Lebanon, PA 17042, have submitted a baseline remedial investigation work plan concerning the remediation of site soils and groundwater contaminated with lead, heavy metals, solvents, BTEX and PAHs. This report was approved by the Department on April 5, 1999.

To construct and maintain a major league baseball stadium known as PNC Park within the flood plain of the Allegheny River (WWF) and to construct and maintain a river bulkhead wall and its associated fill for a distance of approximately 1,100 feet within the channel and floodway of the Allegheny River. The stadium will be located on the south side of West General Robinson Street between Stadium Drive and Federal Street near River Mile 0.5 on the right bank side of the Allegheny River (Pittsburgh West PA Quadrangle N:  12.9 inches; W:  0.7 inch) in the City of Pittsburgh, Allegheny County.

   E26-247. Encroachment. James W. Faith and Dorothy J. Faith, 101 Tanyard Hollow Road, Connellsville, PA 15425. To operate and maintain approximately 250 linear feet of fill and the associated residential building along the right bank of Breakneck Run (WWF) located at the corner of Breakneck Road (S. R. 1051) and Tanyard Hollow Road (S. R. 1034) (Connellsville, PA Quadrangle N:  5.9 inches; W:  8.7 inches) in Bullskin Township, Fayette County.    E56-288. Encroachment. Somerset County Commissioners, 111 East Union Street, Suite 100, Somerset, PA 15501-1543. To rehabilitate and maintain the Reading Mines Bridge (Somerset County Bridge No. 52) having a span of 39.9 feet and an underclearance of 10.1 feet across Beaverdam Creek (HQ-CWF-stocked) for the purpose of correcting a severe undermining problem along the south abutment by underpinning of concrete, placing a concrete toe wall and rock protection. This bridge is located on T-648 at a point approximately 2,500 feet north of intersection of T-648 and S. R. 281 (Stoystown, PA Quadrangle N:  16.5 inches; W:  12.19 inches) in Quemahoning Township, Somerset County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

Request for Proposal

   Northumberland County Pennsylvania is currently revising its Municipal Solid Waste Plan in accordance with the requirements of Pennsylvania Act 101, the Municipal Waste Planning, Recycling and Waste Reduction Act of 1988. The County of Northumberland is issuing this Request for Proposals (RFP) to obtain information which will form the basis for selecting a qualified vendor to provide long-term disposal capacity for county generated municipal solid waste (MSW), to include construction and demolition waste C/D and sewage sludge generated within the county. This RFP is issued to meet the requirements of Act 101, which mandates the utilization of a fair and competitive procurement process.

   For a nonrefundable fee of $100 U. S. currency a copy of the RFP may be obtained from the Northumberland County Planning Commission, 399 S. Fifth Street, Suite 207, Sunbury, PA 17801, or by calling (570) 988-4220. Proposals must be enclosed in a sealed envelope, clearly labeled as the ''Proposal for Municipal Solid Waste Disposal Capacity'' and will be received until 10 a.m. in the office of the County Controller and opened in the Office of the County Commissioners at 10:30 a.m., June 15, 1999.

Recycling Grant Award Under the Municipal Waste Planning Recycling and Waste Reduction Act of 1988, Act 101

   The Department of Environmental Protection (Department) announces the following correction to the amount of a grant to a municipality for its recycling program under the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, Section 902. The grant was previously announced in the March 13, 1999 Pennsylvania Bulletin.

   Grant funds are used to develop and implement recycling programs. Municipalities and counties are eligible for up to 90% funding of approved recycling program costs. Municipalities considered financially distressed under the Municipalities Financial Recovery Act (53 P. S. §§ 11701.101--11701.501) are eligible to receive funding for an additional 10% of approved costs. All grant awards are predicated on the receipt of recycling fees required by section 701 and 702 of Act 101, and the availability of moneys in the Recycling Fund.

Notice of Action on First Land Application of Nonexceptional Value Sewage Sludge Under General Permit PAG-8 or PAG-9

   The Department of Environmental Protection (Department) has previously approved coverage under General Permit PA-8 or PA-9 for the generators of nonexceptional quality sewage sludge listed as follows. General Permit PA-8 authorizes the beneficial use of nonexceptional quality sewage sludge by land application. General Permit PA-9 authorizes the beneficial use of residential septage by land application to agricultural land, forest or a reclamation site. The purpose of this notice is to advise the public that the Department has reviewed the Notices for First Land Application of Sewage Sludge for the following sites and determined that the sites are suitable for land application of nonexceptional quality sewage sludge.

   These actions of the Department may be appealed to the Environmental Hearing Board (Board) at 2nd Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457 by an aggrieved person under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to Administrative Agency Law).
