LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

Preamble 3
The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.
Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act (act). Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office listed. Gold, Manko, Gold & Katcher, LLP, Suite 500, 401 City Avenue, Bala Cynwyd, PA 19004, has submitted a Final Report concerning remediation of site soil contaminated with PCBs, lead, heavy metals, solvents, BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons and groundwater, surface water and sediment contaminated with lead, heavy metals, solvents, BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standard and was approved by the Department on July 21, 1999.
Paulovic-Lazzard Residences, Plumstead Township, Bucks County. Kevin P. Van Kuren, Hydrocon Services, Inc., 2945 S. Pike Avenue, Allentown, PA 18103, has submitted a Final Report concerning remediation of site soil contaminated with polycyclic aromatic hydrocarbons and site groundwater contaminated with BTEX and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standard and was approved by the Department on July 21, 1999.
Kardon Park, Downingtown Borough, Chester County. Richard C. Karr, R. Karr Associates, Inc., 619A Swedesford Road, Malvern, PA 19355, has submitted a remedial investigation report, baseline risk assessment report and cleanup plan concerning remediation of site soil contaminated with lead and heavy metals and groundwater contaminated with lead. The combined reports were approved by the Department on July 14, 1999.
Murata-Wiedemann Facility (Former), Upper Merion Township, Montgomery County. Dean C. Seman, RT Environmental Services, Inc., 215 W. Church Road, King of Prussia, PA 19406, has submitted a Final Report concerning remediation of site groundwater contaminated with solvents. The report did not demonstrate attainment of the background standard and was disapproved by the Department on July 16, 1999.

Sammak, President, American Analytical & Environmental, Inc., 738 Front Street, Catasauqua, PA 18032, submitted a Final Report (on behalf of his clients, Kevin and Sandra Bendzlowicz, 6 Short Lane, Northampton, PA 18067) concerning the remediation of site soils found to have been contaminated with BTEX (benzene, toluene, ethylbenzene and xylene) compounds, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The final report demonstrated attainment of the Statewide health standard and was approved on July 16, 1999.

Box 341, Reading, PA 19603, has submitted a remedial investigation report, baseline risk assessment report and cleanup plan concerning the remediation of site soils and groundwater contaminated with heavy metals and solvents. These documents were approved by the Department on July 12, 1999.
M & M Realty/L. Lavetan & Sons, Inc., West Manchester Township, York County. Alliance Environmental Services, Inc., 3540 North Progress Avenue, Suite 102, Harrisburg, PA 17110, has submitted a remedial investigation report, baseline risk assessment report and cleanup plan concerning the remediation of site soils and groundwater contaminated with lead, heavy metals and PAHs. These documents were approved by the Department on July 16, 1999.
SOLID AND HAZARDOUS WASTE
OPERATE WASTE PROCESSING OR DISPOSAL AREA OR SITE
Permits revoked under the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003) and regulations to operate solid waste processing or disposal area or site.

Permit No. 101618. Thermal Pure Systems, Inc., 2900 West Front Street, Chester, PA 19013. Permit involves a commercial infectious waste processing facility located in the City of Chester, Delaware County. The facility has not operated for over 3 years. The facility has gone through closure under the approved closure plan and the owner has requested that the permit be revoked and the bond released. Program staff concurs with the completion of closure activities and permit revocation. After expiration of the revocation action appeal period, presuming no appeal is filed, the release of the waste permit bond will be initiated. The permit was revoked in the Southeast Regional Office on July 22, 1999.

To remove the existing bridge (Lick Run Bridge No. 10, LC10) and to construct and maintain a 54-inch diameter culvert in an unnamed tributary to Lick Run (TSF) for the purpose of improving Curry Road. The bridge is located on Curry Road, just north from the intersection of Curry Road and Forest Avenue (Glassport, PA Quadrangle N: 14.3 inches; W: 15.8 inches) in South Park Township, Allegheny County. E11-274. Encroachment. Pennsylvania Department of Transportation, Engineering District 9-0, 1620 North Juniata Street, Hollidaysburg, PA 16648. To place and maintain fill within 0.31 acre of palustrine emergent wetlands for the purpose of expanding the existing Walters Avenue maintenance stockpile site. The wetlands are located within the Falls Run (WWF) watershed and along Walters Avenue approximately 1 mile west of the S. R. 0056 interchange (Geistown, PA Quadrangle N: 9.7 inches; W: 17.0 inches) in Stonycreek Township, Cambria County. To compensate for the impacts the permittee will construct 0.31 acre of palustrine emergent wetlands onsite.

To construct and maintain a single 0.5-foot depressed 12.9-foot × 8.3-foot structural plate pipe-arch culvert in Crabapple Run (WWF) for the purpose of providing access to a residence. The project is located off of T. R. 669, approximately 0.44 mile west of its intersection with S. R. 0051 (Fayette City, PA Quadrangle N: 5.2 inches; W: 4.1 inches) in Franklin Township, Fayette County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.
E32-396. Encroachment. William J. Scott, 145 Mill Run Drive, Indiana, PA 15701. To construct and maintain a 125-foot long, two 36-inch diameter pipe stream enclosure in an unnamed tributary to McCarthy Run (CWF) on the proposed access road; to construct and maintain a 120-foot long, trapezoidal channel having a bottom width of 16 feet, and a depth of 1.5 feet at the downstream of the proposed enclosure; to place and maintain fill in 0.46 acre of wetlands (PEM) for the purpose of constructing a commercial development (South Town Development property). The project is located at the intersection of S. R. 286 and S. R. 422 (Indiana, PA Quadrangle N: 18.5 inches; W: 8.5 inches) in White Township, Indiana County. To compensate for the wetlands impact the permittee proposes to construct and maintain 0.46 acre of replacement wetlands.
E32-402. Encroachment. Green Township, R. D. 1, Box 204A, Commodore, PA 15729. To remove the existing structure and to construct and maintain a 15.24-M long, 7.2-M by 3.3-M box culvert (invert depressed 0.485M) in Cush Cushion Creek (HQ-CWF-TS) located on T-928 at a point approximately 1.5 miles north of intersection of T-928 and S. R. 240; and to place and maintain fill in .02 acre of a de minimis area of wetlands (PFO) (Barnesboro, PA Quadrangle N: 17.7 inches; W: 15.8 inches) in Green Township, Indiana County.

To relocate, stabilize and maintain 380.0 feet of Crooked Creek (WWF) and to construct and maintain an agricultural low gradient grade crossing in Crooked Creek (WWF). The project is located off of Tanoma Road north of its intersection with Route 286 (Clymer, PA Quadrangle N: 7.2 inches; W: 7.9 inches) in Rayne Township, Indiana County. To place and maintain fill in 0.02 acre of wetland (PEM) for the purpose of reconstructing 0.75 mile of an urban arterial road, S. R. 2025 (Coyle Curtain Road) as part of the Mon/Fayette Expressway (S. R. 0043) Construction Section 52C2. This construction Section is located on Coyle Curtain Road between its intersections with S. R. 0088 and T-882 (Bogan Road) (Monongahela PA Quadrangle N: 7.0 inches; W: 6.8 inches) in Carroll and Fallowfield Townships, Washington County. The wetland replacement has been constructed under DEP Permit No. E02-1132 for this project.
E65-717. Encroachment. City of Lower Burrell, 2800 Bethel Street, Lower Burrell, PA 15068-1401. To relocate, stabilize and maintain approximately 175.0 feet of an unnamed tributary to Little Pucketa Creek (TSF) for the purpose of preventing further erosion of a steep slope which adjoins a residential area. The project is located off of Hastings Avenue (New Kensington East, PA Quadrangle N: 15.0 inches; W: 14.7 inches) in the City of Lower Burrell, Westmoreland County. This permit also authorizes the placement and maintenance of fill in 1.3 acres of wetlands (PEM/PSS) and the relocation and maintenance of 30.0 feet of an unnamed tributary to Bushy Run. To compensate for wetland impacts, the permittee is required to provide a minimum of 3.0 acres of replacement wetlands (PEM/PSS). The project is located on the east side of the Harrison City--Export Road, approximately 0.25 mile north of its intersection with Watt Road (Irwin, PA Quadrangle N: 21.3 inches; W: 2.4 inches) in Penn Township, Westmoreland County.
