SEWAGE FACILITIES ACT
PLAN APPROVAL


Plan approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

   Northeast Regional Office:  Water Management Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790, (570) 826-2511.

   Butler Township, Luzerne County. The Department has completed its review of the Corrective Plan and Schedule (CP&S) submission, dated June 1999 (received by the Department on September 16, 1999) with additional information dated October 14, 1999 (received by the Department on October 15, 1999) as submitted by Nassaux-Hemsley, Inc., on behalf of Butler Township and the Butler Township Authority (Authority).

   The submission proposes to systematic plan intended to identify and reduce/eliminate sources of infiltration/inflow (I/I) within the Drums Wastewater Collection/Conveyance System. The ultimate goal of the CP&S is to eliminate the hydraulic overload at the Drums Wastewater Treatment Facility. The Department's review has found that the CP&S is now acceptable and hereby grants planning approval.

   In accordance with the provisions of the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20(a)) (Act 537), and Chapter 71 of the Department's Regulations, 25 Pa. Code Ch. 71, the Department will hold Butler Township and the Authority responsible for the complete and timely implementation of the CP&S, as specified in the June 1999 submission. The Department realizes, though, that CP&S activities and their implementation schedules are dynamic in nature. Should conditions be encountered, during the implementation of the CP&S, which require the alteration of the approved CP&S, Butler Township and its Authority shall contact the Department, in writing, and discuss the need to modify the CP&S at the earliest possible instance.

   Location:  Farmington Township, Clarion County. Farmington Township Supervisors, P. O. Box 148, Leeper, PA 16233. Project Description:  This approved project proposes construction of a 100,000 gpd extended aeration-activated sludge Wastewater Treatment Plant with a combination of conventional gravity and pressure sewer system.

   The service area includes the villages of Leeper and Tylersburg, the Route 36 corridor between the two villages and extending west on S. R. 36 up to and including the North Clarion County Elementary and High Schools.

   The effluent would be discharged to an unnamed tributary to Licking Creek west of Tylersburg.

   The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal.

Notice of Interim Response under the Hazardous Sites Cleanup Act

Naginey Quarry Site

Armagh Township, Mifflin County

   The Department of Environmental Protection (Department) under the authority of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1304) (HSCA), has proposed an interim response at the Naginey Quarry Site (Naginey Site).

   The Naginey Site is located at Armagh Township, Mifflin County, PA. The Naginey Site is located in the Village of Naginey along the south side of Naginey Road, approximately 3 miles east of Route 322. The site measures about 55 acres. The site is bisected by Honey Creek in the northern portion of the site. Krentzman & Sons, Inc. (Krentzmans) owns the 1.7 acres of site located on the north side of Honey Creek. Charles Naginey owns the remaining 53.3 acres, located to the south of Honey Creek. The Naginey Site supports a masonry block building. The site is located in a rural area bordered on the south and east by agricultural lands, on the west by residential homes, and on the north by a recycling facility and limestone quarry. The area of contaminated soil occupies approximately 3 acres of the Charles Naginey portion of the site and several areas of the Krentzman portion of the site. Both properties comprise the Naginey Site and are proposed for cleanup.

   The quarry was originally owned and operated by Johnstown Mining as a limestone quarry. Bethlehem Steel took over Johnstown Mining in 1917. In the 1930's, the Naginey family (Naginey) purchased the site and continued to lease it to Bethlehem Steel. Although Naginey owned the property, Bethlehem Steel owned the building on the property. Bethlehem Steel sold the building to Krentzmans in 1972, and Naginey sold the 1.7-acre parcel of property to Krentzmans.

   Krentzmans leased their property to the Independent Trading Corporation (ITC). The ITC operated on the property from 1978 to December 1980. The operational procedures of the ITC at the site included the breaking of battery casings and/or crushing of battery tops, removing the lead and stockpiling the cases on the plant yard. During the late 1970's, the ITC also began dumping battery casings on the adjoining part of the site owned by Charles Naginey. Charles Naginey became aware of the dumping and entered into a lease with IRC for the adjoining part of the site.

   The Department sampled the Naginey site in December of 1996. Composite samples from drummed waste on the site revealed lead levels of 3,760 mg/kg. Soil samples were also collected from the battery casing disposal area. Those soil samples indicated total lead at levels of 8,150 mg/kg. Both of these sample results indicate total lead at levels exceeding the regulatory direct contact standard for nonresidential areas (1,000 mg/kg).

   Based on the December 1996 sampling results, the Department conducted a Prompt Interim Response at the Naginey Site in July of 1998. The response addressed 180 drums of foundry casting sands and 1,600 tons of battery casings/soils. The Prompt Interim Response was conducted to remove the direct contact threat that existed at the site. Additionally, the removal action provided the Department with an opportunity to further assess the property for residual soil contamination and potential groundwater impacts from the waste disposal activities.

   The Naginey Site was further investigated in May/June of 1999. Sample results indicated elevated levels of lead, arsenic and antimony in the soils at the site. Lead levels were detected up to 90,800 mg/kg, antimony up to 1,950 mg/kg, and arsenic up to 487 mg/kg (see Table 1). The presence of lead, antimony and arsenic is consistent with the presence of a battery cracking operation.

   Based upon the Department's investigations, the Department has determined that the immediate concerns at the site are contaminated soils containing lead, antimony and arsenic. It is anticipated that 3--5 acres of the Naginey site contain contaminated soils due to impacts of the improper storage of battery casings. The depth of the contaminated soils is estimated to average 2" on the south side of Honey Creek and 2' on the north side of Honey Creek. The amount of contaminated soils at the site is estimated at 2,150 tons.

   The hazardous substances associated with the soils pose a threat to human health by ingestion, inhalation and dermal contact. The proposed interim response is intended to address the human health threats posed by the site.

   The Department considered two alternatives for the Naginey Site:  1)  No Action, and 2)  Excavation and Offsite Disposal. The no action alternative is retained as a baseline for comparison with other alternatives. Under this alternative, the Department would take no action at the site. All substances and contaminants would remain in place. This alternative would not remove the direct contact threat from exposure to these substances. The Excavation and Offsite Disposal alternative provides for the removal of contaminated site soils. This alternative would require the mechanical excavation of contaminated soils or similar technology, short-term stockpiling of contaminated soils, and disposal of the sites at an offsite, permitted facility. Soils would be excavated to meet appropriate Act 2 standards. This action would eliminate the potential and actual threat to the public and the environment from exposure to lead, antimony and arsenic at concentrations above established risk-based standards. Alternative #2, Excavation and Offsite Disposal is the Department's preferred remedy.

   The Department is providing this notice under sections 505(b) and 506(b) of HSCA (35 P. S. §§ 6020.505(b) and 6020.506(b)), and the publication of this notice starts the administrative record period under HSCA. The Administrative Record which contains information about this site and which supports the Department's decision to perform this action at the site is available for public review and comment. The Administrative Record can be examined from 8 a.m. to 4 p.m. at the Department's Southcentral Regional Office located at 909 Elmerton Avenue, Harrisburg, PA 17110, by contacting Barbara Faletti at (717) 705-4864. The Administrative Record can also be reviewed at the Armagh Township Municipal Building, 224 College Avenue, Milroy, PA 17063 between the hours of 9 a.m. and 5 p.m.

   The administrative record will be open for comment from the date of publication of this notice in the Pennsylvania Bulletin, and will remain open for 90 days. Persons may submit written comments regarding this action to the Department before March 25, 2000, by mailing them to Barbara Faletti at the above address.

   The public will have an opportunity to present oral comments regarding the proposed action at a public hearing. The hearing has been scheduled for February 1, 2000 at 7 p.m. at the Armagh Township Municipal Building, 224 College Avenue, Milroy, PA 17063. Persons wishing to present formal oral comment at the hearing should register before 4 p.m., January 28, 2000, by calling Sandra Roderick at (717) 705-4931.

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.

   Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup on a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediations Standards Act (act). Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The report demonstrated attainment of the Statewide health standard and was approved by the Department on December 7, 1999.

   Lafarge Corporation, Whitehall Township, Lehigh County.
