Order

   And Now, this 2nd day of February, 1999, it is hereby Ordered and Directed as follows:

   1.  Berks County Rule of Civil Procedure (B.R.C.P.) 217.3 is hereby promulgated.

   2.  The Court Administrator is directed to:

   a.  File seven (7) certified copies of this Order and B.R.C.P. 217.3 with the Administrative Office of Pennsylvania Courts.

   b.  Distribute two (2) certified copies of this Order and B.R.C.P. 217.3 to the Legislative Reference Bureau for publication in the Pennsylvania Bulletin.

   c.  File one (1) certified copy of this Order and B.R.C.P. 217.3 with the Civil Procedural Rules Committee.

   d.  Within three (3) weeks after the publication of B.R.C.P. 217.3 in the Pennsylvania Bulletin, cause a copy of this Order and a copy of said Rule to be published one (1) time in the Berks County Law Journal in suitable form so that the same may be placed as an additional or replacement page in the current binder of the Berks County Rules of Court. Each such additional or replacement page shall show in its lower right-hand corner, the effective date of said Rule.

   3.  A copy of this Order and B.R.C.P. 217.3 shall be kept continuously available for public inspection and copying in the office of the Prothonotary of Berks County.

   4.  Berks County Rule of Civil Procedure 217.3 shall become effective thirty (30) days after the date of publication of said Rule in the Pennsylvania Bulletin.

Rule 217.3.  Jury Costs on Continuance or Settlement of a Cause of Action.

   When a continuance is granted upon application of a party or a case is settled, either within three (3) days of the date set for jury selection or after a jury has been impaneled, the Court may impose on the party making the application for continuance or on both parties, if the case is settled, the reasonable costs actually incurred by the County and/or the jurors in impaneling said jury.

   When a continuance has been granted or a case has been settled under the circumstances outlined above and costs imposed, the party upon whom such costs have been imposed may not, so long as such costs remain unpaid, take any further step in such or any other suit without prior leave of Court.
