ENCROACHMENTS The following permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Safety or Encroachment Permit, or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.

E15-605. Encroachment. West Chester Borough, 401 East Gay Street, West Chester, PA 19380-2729. To remove two dilapidated single span concrete deck slab bridges and associated masonry abutments which carry Nields Street and Lacey Street across Goose Creek (WWF), and to install and maintain two separate precast reinforced concrete box culverts, at the aforementioned locations, measuring 12 feet by 4 feet and 16 feet by 3.75 feet, respectively. The Nields Street Crossing is located about 100 feet west of its intersection with Franklin Street and the Lacey Street Crossing is located approximately 600 feet northwest of the Nields Street Crossing (West Chester USGS Quadrangle N: 14.7 inches; W: 13.3 inches) in West Chester Borough, Chester County.
E15-606. Encroachment. Richard Mingey, P. O. Box J, Newtown Square, PA 19073. To perform the following activities associated with the construction of a driveway for a single family residence across an unnamed tributary to Crum Creek (HQ-CWF) and 0.25 acre of adjacent wetland (PFO/PEM): 1) To install and maintain three 24-inch corrugated metal pipe culverts across the watercourse and adjacent wetlands to accommodate driveway crossing area no. 1; 2) To install and maintain six 12-inch corrugated metal pipe culverts across wetlands to accommodate driveway crossing area no. 2; 3) To install and maintain eight 12-inch corrugated metal pipe culverts across wetlands to accommodate driveway crossing area no. 3; 4) To install and maintain twin 36-inch corrugated metal pipe culverts across the watercourse and adjacent wetlands to accommodate driveway crossing area no. 4; These crossings will impact a total of 0.25 acre of wetland. The site is located approximately 2,400 feet west of the intersection of South Valley Road and Grubbs Mill Road (Valley Forge; USGS Quadrangle N: 3.5 inches; W: 12.8 inches) in Willistown Township, Chester County.

To maintain an 8-inch sanitary sewer aerial crossing, supported by a W12 × 65 steel I-beam and three 12-inch by 12-inch reinforced concrete columns spanning Muckinipates Creek (WWF, MF) (Lansdowne, PA Quadrangle N: 3.5 inches; W: 4.9 inches) in Folcroft Borough, Delaware County. On February 3, 1999, approval was given for the construction of this activity under EP2399301.35.

E54-263. Encroachment. Blue Mountain School District, P. O. Box 279, Red Dale Road, Orwigsburg, PA 17961-0279. To place fill in 0.11 acre of PEM wetlands within the drainage basin of Mahonney Creek (CWF), for the purpose of constructing site improvements at Blue Mountain High School. The wetland impacts are associated with the construction of an athletic field, an outfall apron and berm for a stormwater detention pond, and the widening of an existing access road. The project is located on a 118 acre parcel of land situated on the northwest corner of the intersection of S. R. 0443 and T-376 (Greenview Road) (Pottsville, PA Quadrangle N: 4.7 inches; W: 1.7 inches), in North Manheim Township, Schuylkill County (Philadelphia District, U. S. Army Corps of Engineers).

E36-671. Encroachment. Rapho Township, 971 N. Colebrook Rd., Manheim, PA 17545. To remove three existing structures and construct and maintain a precast reinforced concrete box culverts at three locations or Hernley Road (T-855) across Rife Run and two tributaries to Rife Run. Box culvert No. 1 is a 12-foot span with a 5.5-foot rise waterway opening in a tributary channel located near the intersection of Hernley Road with Old Line Road (SR 4026). Realignment of approximately 40 linear feet upstream and 60 linear feet downstream channel at Culvert No. 1 is authorized by this permit. Box culvert No. 2 will have a 12-foot span × 6-foot rise waterway opening in Rife Run tributary. Box culvert No. 3 will have a 17-foot span with a 4-foot rise waterway opening in Rife Run. The realignment of approximately 20 linear feet upstream and 50 linear feet downstream channel at Culvert No. 3 is made a part of this permit. The proposed roadway improvements on Hernley Road are located (Manheim, PA Quadrangle N: 8.5 inches; W: 5.0 inches) in Rapho Township, Lancaster County.
E01-204. Encroachment. Gettysburg Municipal Authority, 601 E. Middle St., Gettysburg, PA 17325. To construct and maintain an 8-inch fire service waterline through Willoughby Run (CH-93) at the National Park Service Eisenhower National Historic Site located east of Eisenhower Farm No. 4 (Fairfield, PA Quadrangle N: 7.4 inches; W: 3.3 inches) in Cumberland Township, Adams County. The construction of this line will result in 1,050 square feet of temporary impact to an adjacent wetland.
E01-205. Encroachment. PA Department of Transportation, Engineering District 8-0, 2140 Herr Street, Harrisburg, PA 17103. To remove an existing structure and to construct and maintain a single span concrete spread box beam bridge having a clear span of 65 feet and an underclearance of 4.3 feet on SR 3038, Section 001 (Crooked Creek Road), Segment 0010, Offset 0000 over Marsh Creek (Fairfield, PA Quadrangle N: 20.5 inches; W: 6.1 inches) in Franklin Township, Adams County. A de minimis area of wetlands equal to 0.043 acre will be permanently impacted due to this project.

To construct and maintain a 68-inch × 106-inch, 203 foot long, elliptical reinforced concrete pipe stream enclosure addition to an existing stream enclosure in an unnamed tributary to Spring Run (WWF) for the purpose of developing a commercial property located on the northeast corner of the intersection of 25th Avenue and Juniata Gap Road (SR 4017) (Altoona, PA Quadrangle N: 6.23 inches; W: 3.75 inches) in Altoona City, Blair County.

To construct and maintain a 200-foot long and 5-foot wide boardwalk with piers across a wetland for recreational walkway of residents of Bent Creek Development located about 2,800 feet east of Interchange Exit No. 18 of I-81 (Wertzville, PA Quadrangle N: 3.3 inches; W: 4.9 inches) in Silver Spring Township, Cumberland County.

E36-668. Encroachment. Lititz Run Watershed Alliance, W. Logan Myers, 315 Clay Rd., Lititz, PA 17543. To construct and maintain a stream restoration project in Lititz Run and Santo Domingo Creek consisting of the placement of random instream habitat structures and various bank stabilization techniques using rock weirs and veins, logs spurs and root wad bank revetment. The project purpose is to improve water quality and improve fisheries habitat. The project work will occur on seven sites with work to be performed on approximately 14,800 linear feet of channel, beginning upstream of Water Street, and extending downstream along Lititz Run to the Rothsville Road (SR 772) (Lititz, PA Quadrangle N: 6.0 inches; W: 7.25 inches) in Warwick Township and Lititz Borough, Lancaster County.
E36-669. Encroachment. PA Department of Transportation, Engineering District 8-0, 2140 Herr Street, Harrisburg, PA 17103. To remove the existing structure and to construct and maintain a prestressed concrete box beam bridge with two solid wall piers set on a 65 degree skew with a composite reinforced concrete deck slab and parapets. The bridge will have three clear spans, one at 25.378 meters, and two at 25.303 meters and will also have a main channel underclearance of 3.885 meters on SR 322 over the Conestoga River near Hinkletown (Terre Hill, PA Quadrangle N: 5.1 inches; W: 0.4 inch) in Earl and Ephrata Townships, Lancaster County.

To place fill in 0.11 acre of wetlands for the purpose of building a residential home on Lot 139 in the Grandview Acres development southwest of Stonecrest Drive (Dover, PA Quadrangle N: 21.9 inches; W: 3.9 inches) in Newberry Township, York County. The permit applicant has met the wetland replacement requirement by participating in the PA Wetland Replacement Project.

To remove the existing structure and to construct and maintain two 0.305-meter depressed 2.495-meter × 1.585-meter elliptical concrete pipe culverts in an unnamed tributary to Sewickley Creek (WWF) for the purpose of improving the roadway standards. Also proposed is the construction and maintenance of R-7 rock lined aprons depressed 0.305 meter extending 14 meters upstream and 13 meters downstream from the proposed culverts. The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision: 40 CFR 123.24.
