SEWAGE FACILITIES ACT

PLAN APPROVAL

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Persons aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, 400 Market Street, Floor 2, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in braille or on audiotape from the Secretary to the Board at (717) 787-3483. Plan approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

   Location: Delaware Canal State Park Theodore Roosevelt Picnic Area, south of Raubsville on S. R. 0611 in Williams Township, Northampton County. Project Description: This project proposes the modernization of restroom facilities at the existing Theodore Roosevelt Recreational Area in the Delaware Canal State Park. The project will replace existing vault latrines with flush facilities. The proposed 800 gpd of sewage flows will be treated by a DEP permitted small flow treatment facility with a discharge to the Delaware River. The treatment facilities will consist of dual septic tanks, a 500 gallon duplex dosing pump tank, 4 free access intermittent recirculating sand filters (400 sf minimum filter area), a 500 gallon recirculation discharge pump/tank and 415 gallon chlorine erosion disinfection tank.

   This small flow treatment facility will be owned and operated by the Commonwealth of Pennsylvania Department of Conservation and Natural Resources. A new well will be drilled to supply water to the project.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

   For further information concerning the final report, contact the Environmental Cleanup Program in the Department's Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office listed.    Strunk Farm Property, East Fallowfield Township, Chester County. Michael A. Christie, P.G., Penn Environmental & Remediation Inc., 2755 Bergey Road, Hatfield, PA 19440, has submitted a Final Report concerning remediation of site soil contaminated with heavy metals, solvents and polycyclic aromatic hydrocarbons and groundwater contaminated with heavy metals. The report is intended to document remediation of the site to meet the Statewide health, background and site-specific standards.

   Stonegate, West Bradford Township, Chester County. Joseph W. Standen, Jr., Leggette, Brashears & Graham, Inc., 426 Brandywine Parkway, West Chester, PA 19380, has submitted a Final Report concerning remediation of site soil contaminated with lead and heavy metals. The report is intended to document remediation of the site to meet the Statewide health standard.

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program

   Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the Act 2 (Land Recycling and Environmental Remediation Standards Act) remediation standards. Plans and reports required by provisions of Act 2 for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   Granite Substation Site No. 259 (Decommissioned), Richland Township, Bucks County. Lisa A. Palfey, PP&L, Inc., Environmental Management Division, Two North Ninth Street, GENTW8, Allentown, PA 18101-1179, has submitted a Final Report concerning the remediation of site soil contaminated with PCBs, heavy metals, solvents, BTEX and polycyclic aromatic hydrocarbons and groundwater contaminated with solvents, BTEX and polycyclic aromatic hydrocarbons. The Final Report demonstrated attainment of the Statewide health standard and was approved by the Department on January 26, 1999.

   One Man Quarry, Worcester Township, Montgomery County. Gary R. Brown, P. E., RT Environmental Services, Inc., 215 W. Church Road, King of Prussia, PA 19406, has submitted a Final Report concerning the remediation of site soil contaminated with petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The Final Report demonstrated attainment of the Statewide health standard and was approved by the Department on January 28, 1999.

   Northbrook Orchards, Pocopson Township, Chester County. Frederick Bopp, III, Tetrahedron Consultants, Inc., 422 West First Avenue, Parkesburg, PA 19365, has submitted a Final Report concerning the remediation of site soil contaminated with heavy metals. The Final Report demonstrated attainment of the Statewide health standard and was approved by the Department on February 3, 1999.

   Conewago Contractors, Inc., Warehouse, Lemoyne Borough, Cumberland County. Conewago Contractors, Inc., P. O. Box 688, Hanover, PA 17331 submitted a final report concerning the remediation of site soils contaminated with solvents, BTEX and PHCs. The final report demonstrated attainment of the Statewide health standard, and was approved by the Department on February 4, 1999.

   Conewago Contractors, Inc., Warehouse, Lemoyne Borough, Cumberland County. Conewago Contractors, Inc., P. O. Box 688, Hanover, PA 17331 submitted a remedial investigation and final report concerning the remediation of site groundwater contaminated with solvents. These reports demonstrated attainment of the site-specific standard, and were approved by the Department on February 4, 1999.

The final report intended to demonstrate attainment of the site-specific standard and was approved by the Department on January 20, 1999.

   The Bureau of Deep Mine Safety (BDMS) has approved Canterbury Coal Company's request for a variance from the requirements of section 242(c) of the Pennsylvania Bituminous Coal Mine Act at the DiAnne Mine. The following notification contains a summary of this request.    Summary of the request:  Canterbury Coal Company requested a variance from section 242(c) of the Pennsylvania Bituminous Coal Mine Act to allow for the common ventilation of belt conveyor entry with other entries at the DiAnne Mine. The proposal accords protections to persons and property substantially equal to or greater than the requirements of section 242(c).

   The basis for the Bureau's approval can be summarized in the following statements:

   1.  DiAnne's plan provides early warning fire detection by the use of carbon monoxide (CO) detectors, and audible alarm over the mine communication system.

   2.  DiAnne's plan provides a separate, isolated intake escapeway that will be maintained at a higher ventilation pressure than the belt and common entries.

   3.  DiAnne's plan provides for the belt and common entries to serve as an alternate escapeway.

   4.  There are significant health and safety benefits associated with allowing entries in common with the belt entry. Repair and maintenance work in the belt entry is afforded safer access. Improved visual safety inspections are facilitated by open crosscuts.

   This approval is limited to a variance from the requirements in section 242(c) requiring that the belt entry is isolated from other entries. All other terms and requirements of section 242(c) shall remain in effect. This approval applies to all areas developed after May 20, 1998. Continued authorization for operation under the approval is contingent upon compliance with the measures described in DiAnne's plan and the following conditions:

   1.  Fire protection shall be installed and maintained on all belt conveyors in compliance with Federal standards.

   2.  Carbon monoxide (CO) sensors shall be set to alarm at the lowest practicable setting.

GM & S Coal Corporation
