MINING

APPLICATIONS TO CONDUCT COAL AND NONCOAL ACTIVITIES

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for the certification.

   Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment and informal conferences).

   Where any of the following mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

ENCROACHMENTS

   The following permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317 as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Safety or Encroachment Permit, or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.

To remove the existing structure and to construct and maintain a 13.08-foot by 8.3-foot aluminum structural arch culvert in the channel of an unnamed tributary to Conodoguinet Creek in order to improve the alignment of Creek Road located about 1,000 feet from its confluence with Conodoguinet Creek (Carlisle, PA Quadrangle N: 20.8 inches; W: 10.0 inches) in North Middleton Township, Cumberland County.

   E17-347.  Encroachment. Copper Township Municipal Authority, P. O. Box 446, Winburne, PA 16879. To construct and maintain a sewer line across Grassflat Run (CWF) at three locations, Browns Run (CWF) at two locations an unnamed tributary to Browns Run (CWF), Sulfur Run (CWF) at five locations, an unnamed tributary to Sulfur Run (CWF) at two locations, a sewer line along Browns Run (CWF), and a sewer line outfall at Moshannon Creek (CWF) and at Grassflat Run (CWF). The sewer lines will discharge to the Winburne STP (Philipsburg, PA Quadrangle N: 15.1 inches; W: 1.9 inches) and to the Grassflat STP (Karthaus, PA Quadrangle N: 0.7 inch; W: 13.8 inches) in Copper Township, Clearfield County. Estimated stream disturbance is 210 feet.

   E41-463.  Encroachment. Clinton Township, 2106 S. R. 0054, Montgomery, PA 17752. To operate and maintain an existing twin cell public road crossing that carries Middle Road across an unnamed tributary to the West Branch Susquehanna River: Warm Water Fishery. The public road crossing consists of two reinforced concrete pipes. Each pipe has a diameter of 48 inches and a length of 20 feet. The existing crossing will not impact wetlands while impacting 125 feet of waterway. The project is located along the northern right-of-way of S. R. 0054 approximately 200 feet east of Brose Road and Middle Road intersection (Muncy, PA Quadrangle N: 14.2 inches; W: 16.2 inches) in Clinton Township, Lycoming County. This permit solely authorizes operation and maintenance of the existing twin cell public road crossing, which shall be conducted in accordance with the Department's ''Standards for Channel Cleaning at Bridges and Culverts.'' Maintenance efforts that result in a change to the hydraulic capacity of the public road crossing must be authorized by the permittee applying for and receiving a written permit of the Department of Environmental Protection.

   E49-234.  Encroachment. Thomas Zamboni, President, Shamokin Creek Restoration Alliance, P. O. Box 263, Mount Carmel, PA 17851-0263. To construct and maintain three settlement ponds, not to exceed 0.75 total acre, for precipitation of iron from acid mine water discharge on the west side of Venn Access Road in and adjacent to an unnamed tributary to Carbon Run approximately 0.75 mile south of the Shamokin High School Building (Shamokin, PA Quadrangle North: 5.5 inches; West: 11.6 inches) in Coal Township, Northumberland County. The project will not impact on wetlands while impacting approximately 450 feet of waterway. Carbon Run is a Cold Water Fisheries stream.

   E55-162.  Encroachment. Kevin H. Hahn, Conestoga Wood Specialties, 441 West Market Street, Beavertown, PA 17813. To construct and maintain a 7 foot wide by 45 foot long pedestrian bridge and a 36 foot long ramp across Lupher's Run 200 feet north of Route 522 between Hetrick Avenue and Vanhoorheis Avenue (Beavertown, PA Quadrangle N: 0.3 inch; W: 7.2 inches) in Beavertown Borough, Snyder County. The project will not impact wetlands while impacting approximately 15 feet of waterway. Lupher's Run is a cold water fisheries stream.

   E57-087.  Encroachment. Pennsylvania Game Commission, P. O. Box 220, Dallas, PA 18612. To construct, operate and maintain a rock-based ford crossing Bloody Run (High Water-Cold Water Fishery) to provide access for timber management operations in State Game Lands No. 13. The ford crossing shall be constructed and perpetually maintained with R-4 rip-rap on graded stream bank approaches and R-7 rip-rap within the stream channel to provide a maximum wearing elevation of 12-inches. Installation of the R-7 rip-rap within the channel shall be conducted in dry work conditions by diverting stream flow through the use of dams and pumping or flumes. The project will not impact wetlands while impacting 20 feet of waterway. The project is located along the northern right-of-way of S. R. 2003 approximately 0.75 mile east of Shingle Mill Road and MSR 2003 intersection (Elk Grove, PA Quadrangle N: 10.5 inches; W: 7.3 inches) in Davidson Township, Sullivan County.

   E02-1301.  Encroachment. J. A. Jones/Traylor Brothers, Inc., J. A. Jones Drive, Charlotte, NC 28287. To construct and maintain a temporary casting basin facility along the right bank of the Ohio River (WWF) for the purpose of fabricating precast float-in concrete dam segments for the new Braddock Dam, Lock # 2 as part of the USACE lower Mon Project. The casting facility will be located near river mile 15 at the Leetsdale Industrial Park (Ambridge, PA Quadrangle N: 12.6 inches; W: 13.6 inches) in the Borough of Leetsdale, Allegheny County. This permit also includes temporary impacts to 0.05 acre of wetlands (PFO1/EM1/SS1F).

   E04-270.  Encroachment. Connoquenessing Country Club, 1512 Mercer Road, Ellwood City, PA 16117-9335. To remove the existing pump house and to construct and maintain a new 20` x 20` pump house along the left bank of the Connoquenessing Creek (WWF). The pump house will provide irrigation water for the Connoquenessing Country Club. The project is located on the west side of Country Club Road approximately 500 feet east of its intersection with SR 0065 (Beaver Falls, PA Quadrangle N: 15.7 inches; W: 3.1 inches) in North Sewickley Township, Beaver County.

   E10-310.  Encroachment. Butler County Commissioners, 124 W. Diamond St., P. O. Box 1208, Butler, PA 16003-1208. To remove the existing structure and to construct and maintain a prestressed concrete or steel beam bridge having two clear spans of 21.5 meters and a minimum underclearance of 4.57 meters on a 75 degree skew across Connoquenessing Creek on T-332 (Textor Hill Road) approximately 1.1 kilometers north of SR 68 (Evans City, PA Quadrangle N: 9.6 inches; W: 13.1 inches) in Jackson Township, Butler County. Project includes installation of a temporary causeway extending from the right bank to approximately mid channel.

   E25-604.  Encroachment. PA Dept. of Transportation District 1-0, 255 Elm Street, Oil City, PA 16301-1499. To install concrete paving one foot below the existing streambed in the invert of the existing concrete arch in Horton Run on SR000 Segment 0200 Offset 1853 approximately 2 miles west of Union City (Lake Canadohta, PA Quadrangle N: 22.6 inches; W: 16.4 inches) in Union Township, Erie County.

   E25-605.  Encroachment. PA Department of Transportation, District 1-0, 255 Elm Street, Oil City, PA 16301-1499. To remove the existing bridge and to construct and maintain a precast spread box beam bridge having a clear span of 42 feet and an average underclearance of 9.4 feet on a 60 degree skew across Sevenmile Creek on S. R. 0005, Segment 0770, Offset 0000 approximately 2,000 feet east of Troupe Road (Harborcreek, PA Quadrangle N: 10.1 inches; W: 13.3 inches) in Harborcreek Township, Erie County.

WATER QUALITY CERTIFICATION


Initial Notice of Request for Certification under section 401 of the Federal Water Pollution Control Act.

   The following requests have been made to the Department of Environmental Protection (Department) under section 401(a) of the Federal Clean Water Act (act) (33 U.S.C.A. § 1341(a)), for certification that the construction and operation herein described will comply with the applicable provisions of sections 301--303, 306 and 307 of that act, and that the construction will not violate applicable Federal and State water quality standards.

   Prior to final approval of the proposed certification, consideration will be given to any comments, suggestions or objections, which are submitted in writing within 30 days of the date of this notice. Comments should be submitted to the Department at the address indicated above for each request for certification. All comments should contain the name, address and telephone number of the person commenting; identification of the certification request to which the comments are addressed; and a concise statement of comments, suggestions or objections in sufficient detail to inform the Department of the exact basis of the proposal and the relevant facts upon which it is based. The Department may conduct a fact-finding hearing or an informal conference in response to any given comments, if deemed necessary to resolve conflicts. Each individual will be notified in writing of the time and place of any scheduled hearing or conference concerning the certification request to which the protest relates. Maps, drawings and other data pertinent to the certification request are available for inspection and review at the address indicated above, between the hours of 8 a.m. and 4 p.m. on each working day.

Approvals to Use NPDES and/or Other General Permits

   The following parties have submitted (1)  Notices of Intent (NOIs) for Coverage under General NPDES Permits to discharge wastewater into the surface waters of this Commonwealth; (2)  NOIs for coverage under General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania; or (3)  Notifications for First Land Application of Sewage Sludge.

   The approval of coverage under these General Permits may be subject to one or more of the following:  pollutant or effluent discharge limitations, monitoring and reporting, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective general permit. The Department of Environmental Protection (Department) has reviewed the NOIs and determined that they comply with administrative requirements of the respective permit application. Also, the Department has evaluated the First Land Application of Sewage Sludge for the sites applying for coverage under PAG-7, PAG-8 and PAG-9 and determined that the sites are suitable for land application of sewage sludge.

   The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision:  40 CFR 123.24.

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangement made for copying at the contact office noted.
