SEWAGE FACILITIES ACT
PLAN APPROVAL
Plan Approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).
Northeast Regional Office: Water Management Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790, (570) 826-2511.
Thomas J. Chickey Apartment Building. The project is located in Hop Bottom Borough, Susquehanna County with a discharge to Martins Creek approximately 1/8 mile upstream from the point where the watercourse crosses under State Route 167 in the center of Hop Bottom Borough. The project consists of the construction of a small flow treatment facility to serve an existing 4 unit apartment building located at 21 North Center Street, Hop Bottom Borough, which currently has a malfunctioning onlot septic system.

Location: Ontelaunee Township, Berks County, P. O. Box 746, Leesport, PA 19533. The approved plan provides for extension of public sewers from the existing Leesport Authority system to provide service to the northwestern section of the township and the State Route 61 corridor. Additionally, extensions of public sewer lines from the existing Maidencreek Authority system will provide sewer service to the south and southwest portions of the Township. The remainder of the Township will remain under an onlot disposal system (OLDS) management district. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.
Location: Mount Joy Township, Lancaster County, 159 Merts Drive, Elizabethtown, PA 17022. The approved plan provides for improvements to the Mount Joy Township Municipal Authority's conveyance system to expand capacity. Additionally, participation in an expansion of the Elizabethtown regional sewage treatment plant is authorized. Non-sewer service portions of the Township are to be addressed in greater detail in a separate planning document. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.
Location: West Lampeter Township, Lancaster County, 852 Village Road, P. O. Box 237, Lampeter, PA 17537. The plan was disapproved because the Township failed to address the eight deficiencies identified in the Department's February 12, 1998 letter. As indicated in the Department's letter dated January 13, 2000, failure to respond within 30 days of the date of that letter would result in the Department taking final action on the technically incomplete document. The original deficiencies are:
1. The sewage disposal needs identification and analysis is inadequate. Your needs analysis should address the entire municipality and include a field survey of any potential sewer service areas to accurately identify malfunctioning systems and system malfunction rates. Additionally, an evaluation of the age of the systems (pre or post regulation), lot size (replacement area availability), type of systems in use (septic tank, cesspool, old well, and the like), system repair type (BTG?) and history, and system type v. general soils type should be included. The information must be effectively mapped. Refer to the Department's brochure, Sewage Disposal Needs Identification, March 1996, for additional information.
2. Well test data in your plan is extremely old and must be updated. Additionally, all well samples were not tested for Total Coliform, Fecal Coliform and Nitrate-Nitrogen as required. A minimum sampling rate of 15% is appropriate for your general plan, however, higher rates are appropriate in any sewer project areas. Refer to the Department's brochure Sewage Disposal Needs Identification Guidance, March 1996 for additional information concerning sampling rates and necessary information to collect.
3. The plan does not indicate how elevated groundwater nitrate-nitrogen levels (evident in the samples taken) will impact new land development. These elevated areas should be mapped, with areas above 5 ppm clearly indicated. Review zoning, subdivision and any other applicable land use ordinances to ensure procedures are established in the Township's land development process to reflect the impact of degraded groundwater. Specifically, your plan should examine the requirements for preliminary hydrogeologic studies and the use of de-nitrification technology for new land development proposing the use of onlot sewage disposal. Additionally, the use of Component 1 (mini-modules) should be eliminated in areas of elevated nitrates or hazardous geology.
4. Since you have been implementing the public sewer alternatives in your 1990 plan, your 1998 plan's alternative analysis and selection must be updated as appropriate to reflect your current situation. It appears that several options are possible to accomplish this, depending on to what extent the Suburban Lancaster Sewer Authority (SLASA) addresses the sewer extensions proposed in your 1990 plan. For example, if the SLASA plan proposes the same sewer extensions as your 1990 plan, reproducing them in your 1998 plan is unnecessary. However, if the SLASA plan limits discussion to existing sewers and capacity issues, your 1998 plan should include the sewer extension information. Whatever option is selected, your 1998 Act 537 Plan must ''dovetail'' with the SLASA plan as it applies to public sewer service in your municipality and it must also completely address onlot sewage disposal issues in your municipality.
5. Your selection of an Onlot Disposal System (OLDS) Management Ordinance in 1990 to address system maintenance in the portions of your municipality dependent on OLDS was an excellent idea that was ahead of its time. If that portion of your plan was also implemented, please provide information about your program and its success in your resubmission. If OLDS Management has not yet been implemented, I can provide you with sample ordinances for your consideration that were obtained from other municipalities who have successfully completed their programs.
6. Your plan's implementation schedule is obviously out of date.
7. Consistency issues such as the historic preservation, rare and endangered species protection, wetlands protection and prime agricultural lands preservation have not been addressed.
8. Lancaster County Planning Commission comments are out of date, as well as, your public notice, public comment period, etc. Your resubmission must be adopted by the municipality and all submission requirements found in Chapter 71, Section 71.31 must be observed.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.
For further information concerning the final report, contact the Environmental Cleanup Program Manager in the Department's Regional Office under which the notice of receipt of a final report appears. The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediations Standards Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.
Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediations Standards Act (act). Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Red Rose Buick Suzuki, 939 North Prince Street, Lancaster, PA 17603 has submitted a final report concerning the remediation of site soils contaminated with BTEX, PHCs and PAHs. The final report demonstrated attainment of the Statewide health standard, and was approved by the Department on March 23, 2000.
Former Intermet Facility, East Hempfield Township, Lancaster County. HydroScience, Inc., 607 Washington Street, Reading, PA 19601 has submitted a combined remedial investigation report and final report concerning the remediation of site groundwater contaminated with heavy metals, BTEX, PCBs and PAHs. The report demonstrated attainment of the site-specific standard, and was approved by the Department on March 29, 2000.
SOLID AND HAZARDOUS WASTE

Code §§ 123.101--123.120 The Department of Environmental Protection (Department) has revised the following Operating Permits to include revised allocations under the provisions of 25 Pa. Code §§ 123.101--123.120 (relating to NOx allowance requirements) as specified in Appendix E.
