ENCROACHMENTS The following permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317 as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Safety or Encroachment Permit, or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.

E46-863. Encroachment. Liberty Property Limited Partnership, 65 Valley Stream Parkway, Malvern, PA 19355. To perform the following activities associated with the construction of an office building at 2301 Renaissance Boulevard;
1. To relocate approximately 720 linear feet of an unnamed tributary to Matsunk Creek (WWF) and routing its flow through 380 linear feet of proposed stream channel. The abandoned channel will be filled to facilitate the construction of an office building, parking facilities, utilities and stormwater facilities.
2. To modify an existing non-jurisdictional dam, Detention Basin No. 1, by reconstructing the embankment across 60 linear feet of unnamed intermittent tributary to Matsunk Creek and 0.05 acre of wetland (PEM). The applicant seeks an Environmental Assessment approval for construction of this facility.
3. To excavate 190 linear feet of unnamed intermittent tributary to Matsunk Creek and portions of the assumed 100-year floodway to facilitate the construction of stormwater Detention Basin No. 2.
4. To construct a non-jurisdictional dam, Detention Basin No. 2, by constructing the embankment across 100 linear feet of unnamed intermittent tributary to Matsunk Creek and 0.09 acre of body of water (POW). The applicant seeks an Environmental Assessment approval for construction of this facility.
5. To place fill in 0.12 acre of body of water (POW) to facilitate the construction of Drive C.
This project proposes impact to a total of 0.05 acre of wetland, 0.21 acre of two bodies of water and approximately 1,060 feet of watercourse. The project is located immediately south of the intersection of Horizon Drive and Renaissance Boulevard (Norristown, PA Quadrangle N: 1.70 inches; W: 1.75 inches) in Upper Merion Township, Montgomery County.
E15-622. Encroachment. West Whiteland Township, 222 North Pottstown Pike, Exton, PA 19341. To remove a single span 6.5 foot by 3.0 foot reinforced concrete box culvert along an unnamed tributary to Valley Creek (CWF-MF) and to install and maintain, in its place, a 205-foot long stream enclosure consisting of twin 68-inch by 43-inch reinforced concrete elliptical pipes. This work will also impact 0.04 acre of wetland (PFO). The site is located at the intersection of Swedesford Road (T-413) and Ship Road (S. R. 1001) (Malvern USGS Quadrangle N: 6.8 inches; W: 16.3 inches) in West Whiteland Township, Chester County.
E15-645. Encroachment. Eastern Shore Natural Gas, 417 Bank Lane, Dover, DE 19904. To construct and maintain segment 1 of the Eastern Shore Natural Gas 2000 Expansion Project which consists of 2.1 miles of 16-inch pipeline along the existing pipeline right-of-way. The pipeline will consist of seven stream crossings and adjacent wetlands:
Four utility line crossings of the West Branch of the White Clay Creek (TSF) (Stream Crossing ID Nos. 9922-1, 9925-1, 9925-2, and 9927-1) and adjacent wetlands (Wetland Crossing ID Nos. 9922, 9925, and 9927).
Three utility line crossings of unnamed tributaries to the West Branch of White Clay Creek (TSF) (Stream Channel ID Nos. 9921-1, 9922-1, and 9926-1) and adjacent wetlands (Wetland Crossing ID Nos. 9921 and 9926).
There will be a total of 0.68 acre of temporary impact to wetlands. This is a linear project which will begin at a point located approximately 200 feet east of the intersection of State Road and School Road in New London Township (West Grove PA-DEL USGS Quadrangle, N: 8.75 inches; W: 15.25 inches) and extend south to a point located approximately 2,000 feet west of the intersection of S. R. 896 and Hess Mill Road in Franklin Township (West Grove PA-DEL USGS Quadrangle N: 3.5 inches; W: 13.25 inches) Chester County.

E41-466. Encroachment. Pa. Dept. of Transportation, 715 Jordan Ave., Montoursville, PA 17754. To remove the existing structure and to construct and maintain a single span pre-stressed concrete bridge having a 91.5 foot clear span and a 13-foot average underclearance across Antes Creek on SR 0044/027 (Linden, PA Quadrangle 7.06 inches; 13.19 inches) in Limestone Township, Lycoming County. The project proposes to impact 44 feet of Antes Creek that is classified as a Cold Water Fishery.

To construct and maintain a stream bank stabilization project along the banks of Chartiers Creek beginning at the C.H.J.A. c. To construct and maintain a stream enclosure consisting of twin 54-inch diameter, 129-foot long culverts and utility lines in a tributary to Fourmile Creek approximately 2,630 feet east of Jordan Road (Hammett, PA Quadrangle N: 21.1 inches; W: 13.0 inches).
d. To construct and maintain a stream enclosure consisting of twin 54-inch diameter, 137-foot long culverts and utility lines in a tributary to Fourmile Creek approximately 2,800 feet east of Jordan Road (Hammett, PA Quadrangle N: 21.1 inches; W: 12.95 inches).

2. To construct and maintain twin 54-inch diameter, 84-foot long culverts in a tributary to Fourmile Creek to provide an access roadway and utility lines to a building lot east of Road D between I-90 and Knowledge Parkway (Hammett, PA Quadrangle N: 21.0 inches; W: 12.9 inches).
3. To construct and maintain a pedestrian bridge having two clear spans of 16.5 feet and an underclearance of 4 feet across a tributary to Fourmile Creek approximately 2,950 feet east of Jordan Road (Hammett, PA Quadrangle N: 21.1 inches; W: 12.8 inches).
4. To construct and maintain a pedestrian bridge having a total length of approximately 187 feet and a minimum underclearance of 1.5 feet over a total of 0.052 acre of wetland C approximately 1,500 feet east of the intersection of Jordan Road and Knowledge Parkway (Hammett, PA Quadrangle N: 20.65 inches; W: 13.2 inches).
5. To fill 0.004 acre of wetland N for construction of North Ridge Road approximately 1,900 feet east of Jordan Road (Hammett, PA Quadrangle N: 21.2 inches; W: 13.3 inches).
6. Fill 0.007 acre of wetland N for lot development north of North Ridge Road approximately 2,200 feet east of Jordan Road (Hammett, PA Quadrangle N: 21.25 inches; W: 13.2 inches).
7. Fill 0.066 acre of wetland O for lot development north of North Ridge Road approximately 1,500 feet east of Jordan Road (Hammett, PA Quadrangle N: 21.3 inches; W: 13.5 inches).
8. To construct and maintain a pedestrian bridge having two side spans of 65 feet and a center span of 100 feet and a maximum underclearance of approximately 60 feet across a tributary to Fourmile Creek (Jordan Run) approximately 400 feet upstream of Jordan Road (Hammett, PA Quadrangle N: 20.95 inches; W: 13.9 inches).
Construction of two roadway crossings, a sanitary sewer line stream crossing and two non-jurisdictional dams in tributaries of Fourmile Creek (having contributory drainage areas less than 100 acres) associated with Phase 1 has been completed.
This project includes creation of 0.272 acre of replacement wetland adjacent to Wetland C south of Knowledge Parkway (Hammett, PA Quadrangle N: 20.85 inches; W: 13.25 inches).
E25-609. Encroachment. Thomas A. Calicchio, 410 Rondeau Drive, Erie, PA 16505. To extend and maintain an existing jetty by placing 2-foot by 2-foot by 6-foot concrete blocks to a maximum distance from shore of approximately 85 feet into Lake Erie (WWF) to provide shoreline protection. This project is located along the shore of Lake Erie approximately 2,400 feet north of the intersection of SR Alternate 5 and Grant Avenue (Swanville, PA Quadrangle N: 18.0 inches; W: 7.2 inches) located in Millcreek Township, Erie County.
E25-611. Encroachment. Pennsylvania Department of Transportation, Engineering District 1-0, 225 Elm Street, Oil City, PA 16301. To relocate and maintain approximately 805 linear feet of 96-inch-diameter reinforced concrete culvert stream enclosure, to re-line and maintain an additional 90 linear feet of the existing Garrison Run stream enclosure by slip-lining with PVC liner, fiberglass liner, or an ''in-situ'' resin lining, and replace and maintain an additional 90 linear feet of 96-inch-diameter reinforced concrete culvert stream enclosure of Garrison Run under S. R. 5 (12th Street). All of these activities are associated with the S. R. 4034 Section A51 (East side access highway) located approximately 700 feet west of the intersection of S. R. 5 (12th Street) and Wayne Street adjacent to Kosciuszka Park (Erie North, PA Quadrangle N: 1.2 inches; W: 8.4 inches) located in the City of Erie, Erie County.
E42-268. Encroachment. Pennsylvania Game Commission, 2001 Elmerton Avenue, Harrisburg, PA 17110-9797. To remove the existing structures and to construct and maintain the following structures in Skinnner Creek (HQ-CWF) to provide timber harvesting and public access within State Game Lanes No. 61 west of Port Allegany in Liberty Township, McKean County:
1. A reinforced concrete box culvert having a 14-foot-wide by 4-foot-high waterway opening or two 5.9-foot-wide by 3.9-foot-high corrugated metal pipe arch culverts on Skinner Creek Road approximately 3.8 miles west of T-408 (Port Allegany, PA Quadrangle N: 8.5 inches; W: 12.9 inches).
2. A reinforced concrete box culvert having two 10-foot-wide by 4-foot-high waterway openings on Coalbed Hollow Road approximately 2.4 miles west of T-408 (Port Allegany, PA Quadrangle N: 6.7 inches; W: 9.9 inches).

E62-365. Encroachment. Eldred Township Supervisors, R. D. 2, Box 123A, Pittsfield, PA 16305. To construct a nonjurisdictional dam across a tributary to Quittapahilla Creek (TSF) to increase the capacity of the existing sediment impoundment at the Old Fiali Quarry. Construction of the dam will impact approximately 120 linear feet of the stream channel. The proposed dam will be located approximately 3,400 feet northwest of the intersection of West Main Street (S. R. 422) and S. R. 934 (Palmyra, PA Quadrangle N: 14.85 inches; W: 3.85 inches) in North Annville Township, Lebanon County.

Approvals to Use NPDES and/or Other General Permits
The following parties have submitted (1) Notices of Intent (NOIs) for coverage under General NPDES Permits to discharge wastewater into the surface waters of this Commonwealth; (2) NOIs for coverage under General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania; or (3) Notifications for First Land Application of Sewage Sludge.
The approval of coverage under these General Permits may be subject to one or more of the following: pollutant or effluent discharge limitations, monitoring and reporting, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective general permit. The Department of Environmental Protection (Department) has reviewed the NOIs and determined that they comply with administrative requirements of the respective permit application. Also, the Department has evaluated the First Land Application of Sewage Sludge for the sites applying for coverage under PAG-7, PAG-8 and PAG-9 and determined that the sites are suitable for land application of sewage sludge.
The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision: 40 CFR 123.24.
The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.
