APPLICATIONS RECEIVED UNDER SECTION 401:  FEDERAL WATER POLLUTION CONTROL ACT

ENCROACHMENTS

   The following Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department). Section 401(a) of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)) requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Safety or Encroachment Permit or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.


Applications received under the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27) and section 302 of the Flood Plain Management Act (32 P. S. § 679.302) and requests for certification under section 401 of the Federal Water Pollution Control Act.

   E15-633. Encroachment. County of Chester, 601 Westtown Road, Suite 160, West Chester, PA 19382-2913. To remove an existing three span concrete encased steel stringer bridge structure and to construct and maintain a 65-foot single span steel bridge consisting of a composite concrete deck at a 2 degree skew and an underclearance of 6-feet 9-inches. This work also includes the removal of an unvegetated gravel bar located upstream of the bridge and the construction of a temporary road crossing consisting of five 5-foot diameter CMP pipes downstream of the bridge. This bridge spans the Middle Branch of White Clay Creek and is located on Valley Road approximately 400 feet southwest of its intersection with South Guernsey Road (West Grove, PA-DE Quadrangle N:  12.35 inches; W:  12.15 inches) in London Grove Township, Chester County.

To remove the existing structure and to construct and maintain a pile-supported boathouse and dock having a surface area of approximately 2,350 S. F. The project is located along the western shore of Harveys Lake approximately 0.6 mile northeast of the intersection of S. R. 0415 and S. R. 1049 (Outlet Road) (Harveys Lake, PA Quadrangle N:  20.0 inches; W:  5.8 inches), Harveys Lake Borough, Luzerne County (Baltimore District, U. S. Army Corps of Engineers).

   E06-529. Encroachment. Robesonia-Wernersville Municipal Authority, P. O. Box 202, Wernersville, PA 19565. To construct and maintain a screening device and an extension to an existing wet well within the floodplain of Spring Creek at an existing sewage treatment plant at a point approximately 9,000 feet upstream of Blue Marsh Lake (Sinking Springs, PA Quadrangle N:  17.9 inches; W:  11.8 inches) in Wernersville Borough, Berks County.

   E28-271. Encroachment. Trent Gadberry, 510 W. Loudon St., Chambersburg, PA 17201. To place and maintain a fill material within the right bank's 100-year floodway and provide a 24-inch revetment of an unnamed tributary to Conococheague Creek in order to construct additional rental storage building located downstream of the Loudon Street culvert (Chambersburg, PA Quadrangle N:  11.0 inches; W:  6.0 inches) in Chambersburg Borough, Franklin County.

   E36-684. Encroachment. PennDot, District 8-0, 2140 Herr Street, Harrisburg, PA 17103. To construct and maintain reinforced concrete pier extensions onto the upstream and downstream ends of four existing bridge piers and both abutments for deck widening improvements to the US Route 0030-011 Bridge (Sta. 98+17.2) having two clear spans of 90 feet each and three at 115 feet each on a 60 degree skew with an underclearance of 33.2 feet across the Conestoga River (WWF) (Lancaster, PA Quadrangle N:  10.5 inches; W:  3.3 inches).

   The permit also authorizes the construction and maintenance of cast-in-place reinforced concrete slab and frame extensions of 17 feet onto the upstream end and 36.55 feet downstream on the SR 0030-001 Bridge (Sta. 72+96) having a clear span of 15.45 feet on a 75 degree skew and a minimum vertical underclearance of 5.64 feet over a tributary (WWF) to the Conestoga River (Lancaster, PA Quadrangle N:  11.25 inches; W:  4.2 inches) in East Lampeter and Manheim Townships, Lancaster County.

To construct and maintain a 42-inch submerged stormwater outfall on the right bank of the Allegheny River (WWF) near River Mile 0.5 (Pittsburgh West PA Quadrangle N:  13.0 inches; W:  0.5 inch) in the City of Pittsburgh, Allegheny County.

   E32-413. Encroachment. West Wheatfield Township, 6120 Rt. 22 Highway East, New Florence, PA 15944. To remove the existing structure and to construct and maintain an elliptical pipe culvert having a span of 6.5 feet and underclearance of 5 feet (invert depressed 6 inches) in an unnamed tributary to Conemaugh River (CWF) located on Southwell Road (T600) at a point approximately 1 mile east of its intersection with Clay Pike Road. The project includes construction and maintenance of 27 LF of riprap at the structure's approaches (New Florence, PA Quadrangle N:  7.7 inches; W:  7.95 inches) in West Wheatfield Township, Indiana County.

   E32-414. Encroachment. Pennsylvania Department of Transportation, Engineering District 10-0, P. O. Box 429, Indiana, PA 15701. To remove the existing structure and to construct and maintain a 14.0 ft. x 8.0 ft. precast reinforced concrete box culvert, invert depressed 1.0 ft. in Sugarcamp Run (CWF). The project is located on S. R. 0954 approximately 500 feet east of its intersection with S. R. 4009 (Ernest, PA Quadrangle N:  18.7 inches; W:  12.8 inches) in Washington Township, Indiana County.

   E62-362. Encroachment. Spring Creek Township, R. D. 2, Box 299, Corry, PA 16407. To remove the existing bridge and to construct and maintain a precast concrete arch having a span of 36 feet and a rise of 8 feet on Hyde Road across East Branch Spring Creek (HQ-CWF, stocked trout and wild trout). The project is located on Hyde Road across East Branch Spring Creek approximately 2,500 feet north of State Lot Road (Spring Creek, PA Quadrangle N:  10.3 inches; W:  11.9 inches) located in Spring Creek Township, Warren County.

ENVIRONMENTAL ASSESSMENT


Request for Environmental Assessment approval under 25 Pa. Code § 105.15 and request for certification under section 401 of the Federal Water Pollution Control Act.

   EA59-002NC. Environmental Assessment. Pa. Dept. of Transportation, P. O. Box 218, Montoursville, PA 17754. Approval is requested to restore the SR 349 bridge structure waterway opening and associated channel along/across Wattles Run for design opening maintenance work and flood protection. Scope of work will be 100 feet upstream and downstream of the SR 349 structure (Sabinsville, PA Quadrangle N:  12.8 inches; W:  10.4 inches) in Clymer Township, Tioga County. Wattles Run is classified as a Cold Water Fishery. Approval of an Environmental Assessment is requested in conjunction with 105.12(a)(16), Dam Safety and Waterway Management regarding restoration activities.

   The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514), and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board.    WQM Permit No. 0999401. Sewerage. Bucks County Water and Sewer Authority, 1275 Almshouse Road, Warrington, PA 18976. Applicant is granted approval for the retate of the Harvey Avenue STP to handle 1.2 mgd located in the Borough of Doylestown, Bucks County.

   WQM Permit No. 1599420. Sewage. Westtown Township, 1081 Wilmington Pike, West Chester, PA 19382. Applicant is granted approval for the improvements to the Pleasant Grove Pump Station located in Westtown Township, Chester County.

   WQM Permit No. 4699201. Industrial waste. Lonza, Inc., 900 River Road, Conshohocken, PA 19428. Applicant is granted approval for the expansion of the Lonza Industrial Wastewater Treatment Plant from 60,000 gpd to 80,000 gpd located in Upper Merion Township, Montgomery County.

   WQM Permit No. 0999424. Sewage. Kevan Price, 1219 Ridge Road, Sellersville, PA 18960. Applicant is granted approval for the construction and operation of a small flow STP located in West Rockhill Township, Bucks County.

   WQM Permit No. 4699428. Sewerage. Lower Moreland Township, 640 Red Lion Road, Huntingdon Valley, PA 19006-6234. Applicant is granted approval for construction and operation of a new pump station and conveyance system located in Lower Moreland Township, Montgomery County.

This permit approves the construction of Industrial Waste Treatment Facilities accepting additional sewage in New Morgan Borough, Berks County.

INDIVIDUAL PERMITS

APPROVALS TO USE NPDES AND OTHER GENERAL PERMITS

   The following parties have submitted (1)  Notices of Intent (NOIs) for coverage under General NPDES Permit(s) to discharge wastewater into the surface waters of this Commonwealth; (2)  NOIs for coverage under General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania; or (3)  Notifications for First Land Application of Sewage Sludge.

   The approval of coverage under these General Permits may be subject to one or more of the following:  pollutant or effluent discharge limitations, monitoring and reporting, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective general permit. The Department of Environmental Protection has reviewed the NOIs and determined that they comply with administrative requirements of the respective permit application. Also, the Department has evaluated the First Land Application of Sewage Sludge for the sites applying for coverage under PAG-7, PAG-8 and PAG-9 and determined that the sites are suitable for land application of sewage sludge.

   The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision:  40 CFR 123.24.

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangement made for copying at the contact office noted.

   This notice is to advise that the Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1304) (HSCA), is reopening the administrative record in support of its HSCA prompt interim response at the National Granulating Company, Inc. site. The site is located in the City of Washington, Washington County, PA

   The Department is reopening the administrative record under section 506(g) of HSCA (35 P. S. § 6020.506(g)) and is doing so for the following reasons:

   (1)  additional information which the Department has determined to be of central relevance to the selected action was obtained during the implementation of the response action; and

   (2)  the Department wishes to document further its response costs.

   The Department previously opened the administrative record for this site for public review and comment from May 17, 1997 through August 18, 1997 and from April 3, 1999 through June 28, 1999. The Department now wishes to provide the public opportunity to review and comment on the new information it is including in the administrative record with this reopening.

   The new information being added to the administrative record is available for public review and comment for a 60-day period at the Department's Southwest Regional Office, 400 Waterfront Drive, Pittsburgh, PA 15222-4745, Monday through Friday, from 8 a.m. to 4 p.m.

   The new information contained in the administrative record will be open for public review and comment from January 15, 2000 until March 15, 2000. Persons may submit written comments regarding the new information during this time period only and may send them to Terry E. Goodwald at 400 Waterfront Drive, Pittsburgh, PA 15222-4745; or they may deliver the comments to this office in person.

   If requested, the Department will conduct a public hearing where persons may present oral comments regarding the new information now being included in the administrative record. A request for a public hearing must be in writing and must be postmarked no later than February 14, 2000. The request should be mailed to Terry E. Goodwald, 400 Waterfront Drive, Pittsburgh, PA 15222-4745. A public hearing will not be held if the Department does not receive a written request by the date specified above.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

   For further information concerning the final report, please contact the Environmental Cleanup Program Manager in the Department of Environmental Protection Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office listed. The report is intended to document remediation of the site to meet the Statewide health standard.

   F. P. Woll & Co., City of Philadelphia, Philadelphia County. Craig M. Hopkins, RT Environmental Services, Inc., Suite 306, Pureland Complex, 510 Heron Drive, P. O Box 521, Bridgeport, NJ 08014, has submitted an addendum to a previously submitted Final Report concerning remediation of site groundwater contaminated with solvents, BTEX and polycyclic aromatic hydrocarbons. The report is intended to document remediation of the site to meet the Statewide health standard.

   Transit America, Inc., City of Philadelphia, Philadelphia County and Lower Moreland Township, Montgomery County. Robert S. Hyams, Transit America, Inc., One Red Lion Road, Philadelphia, PA 19115, has submitted a Groundwater Final Report concerning remediation of site groundwater contaminated with BTEX and solvents. The report is intended to document remediation of the site to meet the site-specific standards.

   Pennsylvania Power & Light Company (PP&L)--Distribution Pole #63982S47834 (Corner of Clay and North Halst Streets), City of Allentown, Lehigh County. PP&L, Environmental Management Division, 2 North Ninth Street, Allentown, PA 18101 has submitted a Final Report concerning the remediation of site soils found to be contaminated with PCBs (polychlorinated biphenyls). The report was submitted to document remediation of the site to meet the Statewide health standard.

   Paradise Lake Retreat Center, Lehman Township, Pike County. Dan Kellam, Northeast Environmental Management, R. R. 3, Box 267, Harveys Lake, PA 18618 has submitted a Final Report (on behalf of his client, Paradise Lake Retreat Center, Box 252, Bushkill, PA 18324) concerning the remediation of site soils and groundwater found to be contaminated with no. 2 home heating oil compounds. The report was submitted to document remediation of the site to meet the Statewide health standard. A Notice of Intent to Remediate was simultaneously submitted. The report was submitted to document remediation of the site to meet Statewide health standard.

PP&L, Environmental Management Division, 2 North Ninth Street, Allentown, PA 18101 has submitted a Final Report concerning the remediation of site soils found to be contaminated with PCBs (polychlorinated biphenyls). The report was submitted to document remediation of the site to meet Statewide health standard.

   Pfizer, Inc., Washington Township, Lehigh County. Steven F. Kemp, Principal, Environmental Engineering, Pfizer Inc., 235 East 42nd Street, New York, NY 10017 has submitted a Final Report concerning the remediation of site soils, sediments and groundwater suspected to be contaminated with lead and other metals, solvents, petroleum hydrocarbon compounds, polycyclic aromatic hydrocarbons and BTEX compounds (benzene, toluene, ethylbenzene and xylenes). The applicant proposes to remediate the site to meet the Statewide health standard. A Notice of Intent to Remediate was simultaneously submitted. See additional Pennsylvania Bulletin notice.

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediations Standards Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.

   Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediations Standards Act (act). Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   Carbondale Industrial Development Authority, Borough of Carbondale, Lackawanna County. Craig Robertson, Groundwater Sciences Corporation, 2601 Market Place Street, Suite 310, Harrisburg, PA 17110-9307 submitted a Baseline Environmental Report (on behalf of his client, Carbondale Industrial Development Authority, 1 North Main Street, Carbondale, PA 18407) concerning the characterization and remediation of site soils and groundwater found to have been contaminated with metals, solvents, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Special Industrial Area standard and was approved on August 18, 1998. The Consent Order and Agreement was executed on September 4, 1998, and a letter approving completion of cleanup activities was dated December 22, 1999.
