Acceptance of Rulemaking Petitions for Study

   At the December 21, 1999, meeting of the Environmental Quality Board (Board), the Board accepted two rulemaking petitions for study under 25 Pa. Code, Chapter 23 (relating to Environmental Quality Board policy for processing petitions--statement of policy).

   The petitions request changes to the designated uses for Crum Creek in Chester and Delaware Counties and Green Lick Run in Fayette County. The Crum Creek petition was submitted by the Willistown Conservation Trust and 11 copetitioners, and it requests a redesignation of the stream from Cold Water Fishes (CWF) and High Quality-Cold Water Fishes (HQ-CWF) to Exceptional Value Waters (EV). The Green Lick Run petition, submitted by the Rural Area Concerned Citizens (RACC), asks that the water body be upgraded from CWF to EV.

   The Department of Environmental Protection (Department) is evaluating all available data to determine the scope of its stream assessments on the petitioned streams. Public notice will be given before the Department conducts the stream assessments. The public notice will provide an opportunity for persons to make technical data concerning the streams available to the Department. Changes that are recommended to the existing designations of these streams following the evaluations will be proposed for rulemaking with an opportunity for additional public comment. It should be noted that stream assessments are currently on hold until the Department determines the impacts of the 1999 drought on the aquatic communities and when representative samples can be obtained.
