   PA-25-070D:  Gunite EMI Corp. (603 West 12th Street, Erie, PA 16501) to emit # 11 Cleaning Mill outdoors and to eliminate all grinding operations except one which will be controlled with the dust collector from the # 11 Cleaning Mill at the EMI Plant in the City of Erie, Erie County. Gunite EMI Corporation is a Title V facility.

Notice of Intent to Issue a Plan Approval and Amend a Title V Operating Permit

   In accordance with 25 Pa. Code §§ 127.44(b) and 127.424(b), the Department of Environmental Protection (Department) intends to issue a plan approval to Molded Fiber Glass Co. (55 Fourth Avenue, Union City, PA 16438) in Union City, Erie County. The facility currently has a Title V Operating Permit, TVOP-25-00035. This plan approval will, in accordance with 25 Pa. Code § 127.450, be incorporated into the Title V operating permit through an administrative amendment at a later date.

   Plan Approval No. PA-25-035A is for construction of a surface coating operation and for defining a VOC plantwide applicability limit (PAL). This construction will result in a PAL for VOC emissions of 164.15 tons per year, calculated on a baseline emission rate of 124.25 tons per year and a one-time growth factor of 39.9 tons per year.

MINING

APPLICATIONS TO CONDUCT COAL AND NONCOAL ACTIVITIES

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to these applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.

   Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment and informal conferences).

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

BUREAU OF DEEP MINE SAFETY

   The Bureau of Deep Mine Safety has received a request for variance from the Consolidation Coal Company. The following notification contains a summary of this request. A complete copy of the variance request may be obtained from Allison Gaida by calling (724) 439-7469 or from the BDMS web site at http://www.dep.state.pa.us/dep/deputate/minres/dms/dms.htm.

   The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice. All comments should be addressed to Richard E. Stickler, Director, Bureau of Deep Mine Safety, Fayette County Health Center, 100 New Salem Road, Room 167, Uniontown, PA 15401.

   Section 702 of the Bituminous Coal Mine Act (act) (52 P. S. §§ 701 and 702) provides a mechanism for operators to obtain variances from specific requirements of the act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

   Section 228(a) requires that certified persons conduct certain examinations within 3 hours immediately preceding the beginning of a coal-producing shift, and before any workmen in such shift other than those who may be designated to make the examinations prescribed in the section enter the underground areas of such mine.

   Summary of the request: Consolidation Coal Company requests a variance to conduct pre-shift examinations within 3 hours preceding the beginning of any 8-hour interval during which any person is scheduled to work or travel underground and establish the 8-hour intervals of time subject to these examinations at the Dilworth Mine.

APPLICATIONS RECEIVED UNDER SECTION 401: FEDERAL WATER POLLUTION CONTROL ACT

ENCROACHMENTS

   The following permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317 as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Safety or Encroachment Permit, or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.

A request for an Environmental Assessment Approval to construct, operate and maintain a non-jurisdictional dam across a small, intermittent unnamed tributary to Skippack Creek (TSF) associated with a stormwater management facility for the proposed Greenbrier Estate subdivision. The dam and its associated reservoir will impact approximately 225 linear feet of the channel during a 100-year storm event. The site is located just northeast of the intersection of Old Forty Foot Road (S. R. 1006) and Hedrick Road (Collegeville, PA USGS Quadrangle N: 19.3 inches, W: 0.3 inch) in Towamencin Township, Montgomery County.

   E09-803.  Front Porch Farm, 1720 Molasses Way, Quakertown, PA 18951. To construct and maintain a 1.15 acre impoundment area associated with an off-stream non-jurisdictional dam in the 100-year floodway of Cooks Creek (EV) and to install and maintain a 6-inch intake structure with a gate valve. Work will impact 0.14 acre of wetland (PEM). Project is located at the Front Porch Farm approximately 400 feet south of the intersection of State Road and Quakertown Road (Route 212) (Hellertown, PA Quadrangle N: 0.2 inch; W: 6.95 inches) in Springfield Township, Bucks County.

To place fill in 0.08 acre of (PEM) wetlands for the purpose of the construction of a parking lot for a vehicle sales and service building. The project is located on the west side of S. R. 0309 approximately 700 feet south of the intersection of S. R. 1021 and S. R. 0309 (Tamaqua, PA Quadrangle N: 15.4 inches; W: 16.0 inches), Rush Township, Schuylkill County (Philadelphia District, U. S. Army Corps of Engineers).

   E66-123.  Encroachment. F. R. Mehoopany, L.L.C., 200 Phillips Road, Exton, PA 19341-1326. To place fill in a deminimis area of (PEM) wetlands equal to 0.03 acre for the construction of a 1.6 million square foot warehouse facility. The project is located on the western side of S. R. 0006, approximately 1.0 mile northwest of its intersection with S. R. 0087 (Meshoppen, PA Quadrangle N: 18.0 inches; W: 2.4 inches), Washington and Meshoppen Townships, Wyoming County (Baltimore District, U. S. Army Corps of Engineers).

To construct and maintain a 16-foot by 4-foot concrete box culvert and a 60-inch diameter corrugated metal pipe (CMP) at the channel of an unnamed tributary to Back Creek in order to construct Echo Springs Road in a housing development called Whiskey Run, Phase II. These sites are located off SR 4010 about 2,500 feet west of Strasburg Church (Chambersburg, PA Quadrangle N: 14.8 inches; W:  12.2 inches and N:  15.0 inches; W:  12.22 inches respectively) in Hamilton Township, Franklin County.

   E30-192. Encroachment. Pennsylvania Department of Transportation, Engineering District 12-0, P. O. Box 459, Uniontown, PA 15401. To remove the existing structure and to construct and maintain a prestressed concrete I-beam bridge having a single normal span of 30.1 meters and an underclearance of 2.0 meters over Pursley Creek (HQ-WWF). Also to construct and maintain a temporary stream crossing, a 525 mm diameter pipe outfall, and two 450 mm diameter pipe outfalls in Pursley Creek. The project is located on S. R. 3013 in the Village of Oak Forest (Oak Forest, PA Quadrangle N:  17.0 inches; W:  15.6 inches) in Center Township, Greene County.

   E32-421. Encroachment. Indiana County, 825 Philadelphia Street, Indiana, PA 15701-3972. To remove the existing structure and to construct and maintain a 24-foot long, 4-foot by 8-foot R. C. box culvert in Tom's Run (CWF) located on an access road in Pine Ridge Park at a point approximately 1,000 feet southeast of S. R. 2002. Also, to construct and maintain riprap stream bank protection for a length of 15 feet at the structure (Bolivar, PA Quadrangle N:  12.5 inches; W:  10.8 inches) in Burrell Township, Indiana County.

   E02-1311. Encroachment. Allegheny County Airport Authority, 1000 Airport Boulevard, Suite 400, Pittsburgh, PA 15231-0370. To remove existing structures; to construct and maintain an 84 inch diameter RCP stream enclosure for a distance of 885 feet in a tributary to McClarens Run (TSF); to construct and maintain a 66 inch diameter RCP stream enclosure for a distance of 361 feet in a tributary to Montour Run (TSF) (both culverts are to be depressed one foot) and to place and maintain fill in 0.29 acre of palustrine emergent wetlands for the purpose of constructing the Cargo Interchange (S. R. 3160 Section A03). The project is located on the northern side of the Pittsburgh International Airport along the Beaver Valley Expressway/Airport Service Road (Business Route 0060) (project begins at Ambridge, PA Quadrangle N:  0.4 inch; W:  14.3 inches and ends at Aliquippa, PA Quadrangle N:  3.3 inches; W:  3.1 inches) in Moon and Findlay Townships, Allegheny County. Replacement wetlands have been constructed at the Mayview Wetland located along Chartiers Creek, South Fayette Township, Allegheny County.

ENVIRONMENTAL ASSESSMENT

Approvals to Use NPDES and/or Other General Permits

   The following parties have submitted (1)  Notices of Intent (NOIs) for Coverage under General NPDES Permits to discharge wastewater into the surface waters of this Commonwealth; (2)  NOIs for Coverage under General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania; or (3)  Notifications for First Land Application of Sewage Sludge.

   The approval of coverage under these General Permits may be subject to one or more of the following:  pollutant or effluent discharge limitations, monitoring and reporting, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective general permit. The Department of Environmental Protection (Department) has reviewed the NOIs and determined that they comply with administrative requirements of the respective permit application. Also, the Department has evaluated the First Land Application of Sewage Sludge for the sites applying for coverage under PAG-7, PAG-8 and PAG-9 and determined that the sites are suitable for land application of sewage sludge.

   The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision:  40 CFR 123.24.

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.
