Merck & Co., Inc.

Riverside Borough, Northumberland County

   Merck & Co., Inc. (P. O. Box 600, Danville, PA 17821-0600) has submitted an application (49-313-032H) to the Department of Environmental Protection (Department) under section 127.11 of Chapter 127 of Article III of the Department's Rules and Regulations for approval to install several air cleaning devices for the control of air contaminant emissions from several existing sources (pharmaceutical manufacturing equipment) at its Cherokee facility in Riverside Borough, Northumberland County.

   Merck & Co., Inc., is a major facility for which a Title V Operating Permit application (49-00007) has been submitted but for which no Title V Operating Permit has yet been issued.

   Information provided by Merck indicates that the air cleaning devices will potentially emit up to 10.9 tons of carbon monoxide per 12 consecutive month period, 1.0 tons of volatile organic compounds per 12 consecutive month period, some of which will also constitute hazardous air pollutants, 8.8 tons of sulfur oxides per 12 consecutive month period, 17.0 tons of nitrogen oxides per 12 consecutive month period, 6.4 tons of particulate matter per 12 consecutive month period, and 6.4 tons of particulate matter less than or equal to 10 microns (PM10) per 12 consecutive month period. A preliminary review of this information by the Department indicates that the air cleaning devices will allow the existing sources to continue to comply with all applicable air quality requirements including the best available technology requirements of 127.1 and 127.12 of Chapter 127 of Article III of the Rules and Regulations of the Department. Based on this finding, the Department proposes to approve the application and issue plan approval for the installation of the proposed air cleaning devices. If this plan approval is issued and if the proposed air cleaning devices and existing sources are subsequently found to be in compliance with all conditions of the plan approval as well as all applicable regulatory requirements, the plan approval will be incorporated into an operating permit via administrative amendment in accordance with Section 127.450 of Chapter 127 of Article III.

   In order to ensure compliance with all applicable standards, the Department proposes to place the following conditions in the respective plan approval:

   1.  The air cleaning devices are to be installed in accordance with the plans submitted with the application (as approved herein).

   2.  This plan approval is issued for the installation of a T-Thermal #LPV-14M thermal oxidizer equipped with a modified (low nitrogen oxides) burner, a Sub-X water-cooled quench, and a Ceilcote #SPT-54-120 packed bed scrubber, or equivalent, for the control of air contaminant emissions from the following:

   a.  the sources identified in condition 7 of Operating Permit 49-313-032G.

   b.  the sources identified in condition 6 of Operating Permit 49-313-035K under the heading ''Summary of process vessels controlled by the fume incinerator''.

   3.  Under the best available technology provisions of section 127.1 and 127.12 of Chapter 127 of Article III of the Rules and Regulations of the Department of Environmental Protection, during any time that the T-Thermal #LPV-14M oxidizer is being used to control air contaminant emissions from any source identified in condition 2 herein the oxidizer shall maintain a minimum outlet temperature of at least 1,600°F. The only exception to this requirement is if the oxidizer (and Ceilcote packed bed scrubber) are being used to control air contaminant emissions from any of the following sources identified in condition 2b herein:  TA-812, TA-1548, TA-1238, TA-1250, HE-1284, TA-1297, ST-1245, or TA-1538 (these sources are also identified in condition 7 of Operating Permit 49-313-035K). During such instances the oxidizer and packed bed scrubber shall comply with the following operating criteria:

   a.  maintain a minimum oxidizer outlet temperature of at least 1,800°F.

   b.  maintain a minimum combined volatile organic compound destruction/removal efficiency of 99.9%

   c.  maintain a minimum combined methylene chloride destruction/removal efficiency of 99.99%

   d.  maintain a total hydrocarbon concentration in the packed bed scrubbed exhaust of not greater than 50 ppmv

   e.  maintain a particulate matter emission rate in the packed bed scrubber exhaust of not greater than 0.03 grains per dry standard cubic feet

   f.  maintain a minimum hydrogen chloride removal efficiency of 99%

   4.  Under the best available technology provisions of sections 127.1 and 127.12 of Chapter 127 of Article III of the Rules and Regulations of the Department of Environmental Protection, the T-Thermal #LPV-14M oxidizer shall be equipped with a temperature monitor/recorder that shall accurately monitor and record the oxidizer's outlet temperature. The oxidizer shall be equipped with an alarm that will alert the operator should the monitor ever indicate a temperature below the limits established in condition 3 herein. Additionally, the final exhaust stack (downstream of the packed bed scrubber) shall be equipped with oxygen and carbon monoxide monitors that shall accurately monitor the oxygen and carbon monoxide content of the final stack exhaust whenever the oxidizer is in use.

   5.  Under the best available technology provisions of sections 127.1 and 127.12 of Chapter 127 of Article III of the Rules and Regulations of the Department of Environmental Protection, during any time that the Ceilcote #SPT-54-120 packed bed scrubber, or equivalent, is being used to control air contaminant emissions from any source identified in condition 2 herein the scrubber shall comply with the following operating criteria:

   a.  utilize a caustic solution as the scrubbing solution

   b.  maintain a scrubbing solution pH of at least 7

   c.  maintain a scrubbing solution flow rate of at least 85 gallons per minute

   6.  Under the best available technology provisions of sections 127.1 and 127.1 of Chapter 127 of Article III of the Rules and Regulations of the Department of Environmental Protection, the Ceilcote #SPT-54-120 packed bed scrubber, or equivalent, shall be equipped with monitors that shall accurately monitor the scrubber's pressure drop and the scrubbing solution's pH and flowrate. The scrubber shall additionally be equipped with an alarm that will alert the operator should the monitors ever indicate a pH or flowrate below the limits established in condition 5 herein.

   7.  The use of the T-Thermal #LPV-14M oxidizer for the control of air contaminant emissions from the sources identified in condition 2a herein may be temporarily or permanently discontinued at any time at the company's discretion without the necessity of notifying the Department provided the requirements identified in conditions 7 and 10 of Operating Permit 49-313-032G are complied with.

   8.  The use of the T-Thermal #LPV-14M oxidizer for the control of air contaminant emissions from the sources identified in condition 2b herein may be temporarily or permanently discontinued at any time at the company's discretion without the necessity of notifying the Department provided the requirements identified in conditions 6, 7, 10, and 11 of Operating Permit 49-313-035K are complied with.

   9.  Within 120 days of startup of the T-Thermal #LPV-14M oxidizer and Ceilcote #SPT-54-120 packed bed scrubber, the company shall perform stack testing upon these units in order to verify the following:  volatile organic compound destruction/removal efficiency, methylene chloride destruction/removal efficiency, and hydrogen chloride removal efficiency. The company shall also perform stack testing upon the outlet of the packed bed scrubber for nitrogen oxides and total hydrocarbons. All testing shall be performed using reference method test procedures acceptable to the Department.

   10.  At least 60 days prior to the performance of any testing required by condition 9 herein a pretest plan shall be submitted to the Department for evaluation. This test plan shall contain the specific testing and analytical procedures to be used in performing the testing.

   11.  The Department shall be given at least 14 days advance notice of the specific dates and times for the performance of any testing required by condition 9 herein in order that Department personnel can arrange to be present. The Department is under no obligation to accept the results of any testing performed without adequate advance notice having been given to the Department.

   12.  Within 60 days of completion of any testing required by condition 9 herein, two copies of the test report shall be submitted to the Department. The report shall contain the results of the testing, a description of the testing and analytical procedures actually used, all air cleaning device operating parameters, a copy of all raw test data and a copy of the calculations generated during the data analysis.

   13.  The air contaminant emissions from the T-Thermal #LPV-14M thermal oxidizer, Sub-X water-cooled quench, and Ceilcote #SPT-54-120 packed bed scrubber, or equivalent, shall never exceed the following limits:

   14.  Merck shall maintain comprehensive, accurate records of the following:

   a.  the outlet temperature of the T-Thermal #LPV-14M thermal oxidizer

   b.  the dates and times that any of the sources identified in condition 7 of Operating Permit 49-313-035K are operated.

   Merck shall maintain these records onsite for at least 5 years and shall make these records available to the Department upon request.

   15.  Issuance of an operating permit for the aforementioned sources is contingent upon the air cleaning devices being installed and the sources and associated air cleaning devices being maintained and operated, as described in the application and supplemental materials submitted for plan approval, as well as in accordance with all conditions contained herein, and upon satisfactory demonstration that any air contaminants emitted from the sources are in compliance with the requirements specified herein and with the requirements specified in, or established under, any applicable rule or regulation contained in Article III of the Rules and Regulations of the Department of Environmental Protection.

   16.  The company shall immediately notify the Department of any malfunction of the sources or associated air cleaning devices which results in, or may possibly be resulting in, the emission of air contaminants in excess of the limitations specified in, or established under, any applicable rule or regulation contained in Article III of the Rules and Regulations of the Department or in excess of the limitations specified in any condition contained herein or which otherwise results in, or may possibly be resulting in, noncompliance with the requirements specified in any condition contained herein.

   17.  This plan approval authorizes temporary operation of the sources covered by this plan approval for a period of up to 180 days from the date of completion of installation of the air cleaning devices for the purpose of equipment shakedown and stack test performance.

   In accordance with Section 127.45 of Chapter 127 of Article III of the Rules and Regulations of the Department, the proposed plan approval conditions do one or more of the following:

   1.  identify the air contamination sources and location

   2.  establish allowable emission rates

   3.  establish, monitoring, recordkeeping, testing and reporting requirements

   4.  ensure proper operation and adequate maintenance

   A copy of the application and the Department's analysis are available for public inspection during normal business hours at the address listed below.

   Any person wishing to protest the issuance of this plan approval or provide the Department with additional information that he/she believes should be considered prior to the issuance of the plan approval may submit the protest or information to the Department at the address listed. Each written protest or comment should include the following:  name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval 49-313-032H, and a concise statement regarding the relevancy of the information or any objections to the issuance of the plan approval.

   A public hearing may be held if the Department, in its discretion, decides that such a hearing is warranted based on the information received. All persons protesting the issuance of plan approval, submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in a newspaper of general circulation in Northumberland County, by publication in the Pennsylvania Bulletin, by letter, or by telephone, where the Department determines such notification by telephone is sufficient. All protests, comments and requests must be received by the Department no later than 30 days after publication of this notice.

MINING

APPLICATIONS TO CONDUCT COAL AND NONCOAL ACTIVITIES

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to the applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.

   Written comments or objections, or requests for information conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code § 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. These NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

   E23-404. Encroachment. Applied Card Systems, Inc., 800 Delaware Avenue, Wilmington, DE 19801. To construct, operate and maintain the following structures associated with a proposed commercial office facility.

   1.  180 linear feet of 36 inch RCP stream enclosure across an unnamed tributary of West Branch of Chester Creek (TSF), a roadway approach fill in 0.42 acre of adjacent wetland (PSS), which will include two 42 inch by 29 inch HERCP cross drains, endwalls and rip-rap apron associated with an access road which will provide access from SR 0001. This work will include the removal of 150 linear feet of existing 36 inch CMP stream enclosure and impact to 225 linear feet of watercourse.

   2.  42 linear feet of an 8-foot × 3-foot box culvert across an unnamed tributary of West Branch of Chester Creek (TSF), roadway approach fill in 0.10 acre of adjacent wetland (PEM), endwalls and rip-rap apron associated with an access road off of SR 0202. This work will include the removal of approximately 30 linear feet of 27 inch CMP culvert and impact to 90 linear feet of watercourse.

   The project also includes the extension of two outfall structures which are waived according to 105.12(a)(2) and the installation and maintenance of a sanitary sewer utility crossing which qualifies for General Permit No. 5.

   The site is located approximately 1000 feet southeast of the intersection of Baltimore Pike (SR 0001) and West Chester Pike (SR 0202) (West Chester, USGS Quadrangle N:  0.50 inch, W:  5.70 inches) in Concord Township, Delaware County.

To construct and maintain a channel change, having a length of approximately 600 feet in a tributary to the Lehigh River (CWF), consisting of the following:  (1)  a grass-lined trapezoidal channel with a minimum depth of 18 inches, a bottom width of 10 feet, and 4 to 1 sideslopes; (2)  six R-5 riprap step energy dissipaters with heights varying from 2 to 4 feet spaced uniformly along the main channel; and (3)  approximately 150 of R-4 riprap lining at the end of the channel change. To remove the existing structure and to construct and maintain a 48-inch ADS N-12 polyethylene pipe with the associated clean approach fill and to realign less than 100 feet of stream channel at the inlet and outlet of the culvert that is in an unnamed tributary to Laurel Run located 0.75 mi. up Straw Jack Road from its intersection with Julian Pike (Bear Knob, PA Quadrangle N:  0.85 inch; W:  14.0 inches) in Houston Township, Centre County. This project proposes to directly impact 110 feet of an unnamed tributary to Laurel Run, which is classified as an Exceptional Value--Cold Water Fishery.

   E59-408. Encroachment. Lawrence Clark, P.E., Mansfield University, 110 Brooks Maintenance Building, Mansfield, PA 16933. To construct and maintain a 6.2 foot wide by 3.4 foot high by approximately 50 foot long CMP storm sewer outfall, with flared end section and R-5 rip rap protection, and a parallel 24 inch diameter CMP outfall to the old bank of Corey Creek and to construct and maintain earthen/cobble fill over and to the sides of the CMP pipes to extend to the old bank of Corey Creek and to construct R-4 rip rap along the limits of the restored old bank of Corey Creek. The project is located on the northeastern side of Mansfield University along Route 6 (Mansfield, PA Quadrangle N:  10.85 inches; W:  9.25 inches) in Richmond Township, Tioga County. The project will not impact wetlands while impacting approximately 200 feet of waterway. Corey Creek is a warm water fisheries stream.

To remove the existing bridge and to construct and maintain a single span bridge having a normal span of 18.29 meters and an underclearance of 3.96 meters across Brush Creek (TSF) for the purpose of improving transportation safety and roadway structures. Also proposed is the construction and maintenance of two outfall structures consisting of a 0.61 meter RCP on S. R. 4008, 11.5 meters right of Station 0+017.000 and a 0.52 meter RCP on S. R. 3077, station 1+452.5. To construct and maintain a passive treatment system in and along several unnamed tributaries to Laurel Run, to treat three acid mine discharges. The proposed system will consist of two vertical flow ponds, two flush ponds an open limestone channel and/or horizontal flow limestone bed, an anoxic limestone drain, a settling pond, and an aerobic wetland. The proposed facilities will replace an existing active treatment system that has previously treated two of the discharges. Construction of the new system will impact approximately 0.23 acre of wetlands. The project site is located along Laurel Run, approximately 1,700 feet south of its confluence with Meadow Run (Ohiopyle, PA Quadrangle N:  17:0 inches; W:  16.5 inches) in Stewart Township, Fayette County.
