APPLICATIONS RECEIVED UNDER SECTION 401:  FEDERAL WATER POLLUTION CONTROL ACT

ENCROACHMENTS

   The following Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval, and requests for water quality certification have been received by the Department of Environmental Protection (Department). Section 401(a) of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a) requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Safety or Encroachment Permit or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.

   Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

   E39-391. Encroachment. Dorney Park and Wild Water Kingdom, 33 Dorney Park Road, Allentown, PA 18104. To (1)  construct and maintain a single-span reinforced concrete adjacent box beam bridge, having a span of approximately 50 feet and an underclearance of approximately 8 feet, across Cedar Creek (HQ-CWF) to provide vehicular access to an auxiliary parking area; (2)  modify and maintain an existing bridge across Cedar Creek, with work consisting of removal of the center pier and replacement of the superstructure and deck, for the purpose of pedestrian and service vehicle use; (3)  construct and maintain a 15-inch stormwater outfall to Cedar Creek; and (4)  modify and maintain an existing structure (Zephyr train ride) in the floodway of Cedar Creek, with work consisting of the removal of existing piers and tracks from the channel of the creek, and the relocation of the track approximately 15 feet westward. The project is located at Dorney Park and Wild Water Kingdom, approximately 0.5 mile northeast of the intersection of S. R. 309 and S. R. 0222 (Allentown West, PA Quadrangle N:  14.0 inches; W:  5.5 inches), South Whitehall Township, Lehigh County (Philadelphia District, U. S. Army Corps of Engineers).

   E52-166. Encroachment, Pennsylvania Department of Conservation and Natural Resources, Bureau of Forestry, P. O. Box 8552, Harrisburg, PA 17105-8552. To remove the existing structure and to construct and maintain a road crossing of Craft Brook (EV), consisting of a single-span bridge having a span of approximately 26 feet and an underclearance of approximately 4 feet. The project will impact a de minimis area of wetlands less than 0.05 acre. The project is associated with the rehabilitation of the Lily Pond Dam, in the Delaware State Forest, and is located immediately downstream of the dam (Milford, PA-NJ Quadrangle N:  20.0 inches; W:  14.5 inches) in Milford Township, Pike County (Philadelphia District, U. S. Army Corps of Engineers).

   E30-194. Encroachment. Greene County, 93 East High Street, Waynesburg, PA 15370. To remove the existing structure and to construct and maintain a single span bridge having a normal clear span of 92.3 feet and an underclearance of 7.9 feet across Whiteley Creek (WWF) located on T-411 at a point approximately 0.35 mile east of its intersection with SR 2011. The project includes construction and maintenance of cofferdams during construction (Masontown, PA Quadrangle N:  8.9 inches; W:  15.35 inches) in Green Township, Greene County.

   E56-299. Encroachment. Somerset Conservation District, 1590 North Center Avenue, Suite 103, Somerset, PA 15501. To construct and maintain a 200-foot long, 10-foot wide, 6-foot deep open box culvert in Beaverdam Creek (HQ-CWF), to relocate and maintain approximately 1,500 LF of the channel of said stream located between its confluence with Quemahoning Creek and SR 4023. The project includes 1.08 acres of wetland impact. The purpose of the project is to enhance the passive treatment of the acid mine drainage (Boswell, PA Quadrangle N:  5.95 inches; W:  6.05 inches) in the Borough of Jennerstown, Somerset County.

   E10-321. Encroachment. Butler County Commissioners, P. O. Box 1208, Butler, PA 16003-1208. To remove the existing Miller Hays Bridge (County Bridge No. 73) and to construct and maintain a composite steel beam bridge having a clear, normal span of 46.5 feet and an underclearance of 5 feet across Little Buffalo Run on Hays Road (T-626) approximately 450 feet south of Fenelton Road (T-595) (Worthington, PA Quadrangle N:  20.4 inches; W:  11.45 inches) in Clearfield Township, Butler County.

   E20-481A. Encroachment. Conneaut Valley Economic and Industrial Development Authority 103 Main Street, P. O. Box 33, Springboro, PA 16435. To amend Permit No. E20-481 which authorized Conneaut Valley Economic and Industrial Development Authority to dredge and maintain the channel of a tributary to Conneaut Creek (CWF-MF) and to construct and maintain a levee to provide flood protection to the Logan Drive Trailer Court along S. R. 18 approximately 0.7 mile north of S. R. 198 (Conneautville, PA Quadrangle N:  2.8 inches; W:  16.9 inches) in Spring Township and Conneautville Borough, Crawford County. The proposed amendment is to dredge an additional 340 cubic yards of material and maintain the channel of a tributary to Conneaut Creek (CWF-MF) south of the Logan Drive Trailer Court beginning at S. R. 18 and extending upstream approximately 533 feet.

   E24-212. Encroachment. Borough of Johnsonburg, P. O. Box F, Johnsonburg, PA 15845, to maintain the existing Johnsonburg Flood Protection Project constructed by the United States Army Corps of Engineer in and along a total reach of approximately 3,200 feet of West Branch Clarion River extending upstream from its confluence with East Branch Clarion River and approximately 1,632 feet of Silver Creek extending upstream from its confluence with West Branch Clarion River in the Borough of Johnsonburg, Elk County. Extent of activities includes maintenance of all structures as well as periodic removal of accumulated sediments and debris necessary to maintain the capacity of the channel as constructed and shown in the ''As-built'' drawings providing by the United States Army Corps of Engineers dated June 1, 1956 and January 25, 1957.

   E24-213. Encroachment. PA Department of Conservation and Natural Resources, Bureau of Forestry, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8451, Harrisburg, PA 17105-8451. To conduct the following activities associated with the replacement of the bridge across Dents Run on Porcupine Road immediately south of Dents Run Road in Elk State Forest (Dents Run, PA Quadrangle N:  20.3 inches; W:  13.8 inches) in Benezette Township, Elk County:

   1.  Remove the existing bridge.

   2.  Remove a gravel bar adjacent to the left abutment measuring approximately 100 feet in length.

   3.  Construct and maintain a rock riprap stream deflector along the right side of the channel approximately 50 feet upstream of the bridge.

   4.  Construct and maintain a prestressed concrete spread box beam bridge having a clear, normal span of 35.8 feet and an underclearance of approximately 8 feet.

   5.  Construct and maintain a stabilized parking area along the left bank upstream of the roadway and adjacent to the intersection of Porcupine Road and Dents Run Road.

   This project includes a permanent impact to a de minimis area (0.012 acre) of wetlands adjoining Dents Run associated with construction of the stream deflector and approach roadway.

   This project also includes a temporary roadway across Dents Run consisting of four 36-inch-diameter plastic pipe culverts and clean rock fill located approximately 50 feet downstream of the bridge and will temporarily impact a total of 0.04 acre of adjoining wetlands with the temporary roadway fill.

   E25-618. Encroachment. Venango Township, 9141 Townhall Road, Wattsburg, PA 16442. To construct and maintain a prestressed concrete adjacent box beam bridge having a clear, normal span of 93.5 feet and an average underclearance of 14 feet across West Branch French Creek on T-645 (Hanna Hall Road) approximately 0.3 mile west of S. R. 89 near Lowville (Wattsburg, PA Quadrangle N:  6.0 inches; W:  10.6 inches) in Venango Township, Erie County.

   E25-619. Encroachment. PA Department of Transportation, District 1-0, P. O. Box 398, 255 Elm Street, Oil City, PA 16301. To remove the existing bridge and to construct and maintain a prestressed concrete spread box beam bridge having a normal span of 32.8 feet and an average underclearance of 13.6 feet on a 45 degree skew across Sixteen Mile Creek on S. R. 0005, Section B00, Segment 0940, Offset 1218 approximately 100 feet east of S. R. 89 (North East, PA Quadrangle N:  20.2 inches; W:  11.2 inches) in North East Township, Erie County.

   E43-290. Encroachment. PA Department of Conservation and Natural Resources, Park Region No. 2, P. O. Box 387, Prospect, PA 16052-0387. To construct and maintain a public swimming beach by excavating an area of shoreline measuring approximately 450 feet long by 75 feet wide and permanently occupying approximately 0.6 acre below normal pool elevation along the northern shore of Lake Wilhelm (Sandy Creek-WWF) in Maurice K. Goddard State Park south of Georgetown Road approximately 2.5 miles east of Lake Wilhelm Road (New Lebanon, PA Quadrangle N:  5.7 inches; W:  15.6 inches) in New Vernon Township, Mercer County.

   The following Storage Tank Site Specific Installation Permit application has been received by the Department and is currently under review. Persons wishing to comment on the proposed permit are invited to submit a statement to the Bureau of Watershed Conservation, Division of Storage Tanks, P. O.    The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O.    PAS-10-H087. Individual NPDES. Group & Group, 102 Sunset Drive, Mt. Holly Springs, PA 17013. To implement an Erosion and Sedimentation Control Plan for the construction of mini-storage facility known as Midway Park and Car Wash on 19.3 acres in South Middleton Township, Cumberland County.    A.  5599501. The Department denied a construction permit to Riverview Mobile Home Park, P. O. Box 339, Camp Hill, PA 17001, Union Township, Snyder County. The application was submitted proposing modification of the public water system that serves the Riverview Mobile Home Park. This system has no valid construction or operation permits.

Notice of Proposed Settlement under the Hazardous Sites Cleanup Act

Ashland Metals and Giordano Waste Materials HSCA Sites

Butler Township, Schuylkill County

   The Department of Environmental Protection (Department), under the authority of Section 1113 of the Hazardous Sites Cleanup Act (35 P. S. § 6020.1113) (HSCA) has entered into a Consent Order and Agreement with Paul F. and Madeline R. Kerrigan (the Kerrigans). The proposed Consent Order and Agreement concerns settlement of the Department's response costs for the Ashland Metals and the Giordano Waste Materials HSCA sites, both of which are located in Butler Township, Schuylkill County (Sites). The Kerrigans have owned the Ashland Metals Site since June 22, 1970. The Kerrigans owned the Giordano Waste Materials Site from June 22, 1970 until March 24, 1980.

   The Ashland Metals Site, which covers approximately 13 acres in area, is the location of a former lead acid battery recycling facility that operated from 1979 to 1986. Several buildings were on the Ashland Metals Site including the former processing building. Waste piles of chopped battery casings, waste acid tanks, and trailers containing whole and chopped battery casings were present. The primary hazardous substance of concern at the Ashland Metals Site is lead. Lead is found in site soils, waste piles, debris, battery casings, onsite containers, and groundwater. During the period June 1 to September 25, 1998 the Department conducted an interim response at the Ashland Metals Site. The response involved the removal of all surface hazardous waste piles of chopped and whole battery casings, ash, tires, building contents, and debris followed by the placement of a soil cover over the site.

   The Giordano Site, which covers an area of approximately 7 acres, is the location of a former lead acid battery reclamation facility that was operated from 1978 to 1986. Located on the Giordano Site were a building, piles of ash, and piles of battery casings. The primary hazardous substance of concern at the Giordano Site is lead. Lead is found in surface and subsurface soil, buried waste, and groundwater. The Department has undertaken two interim responses at the Giordano Site. The first response took place from September 5, 1989 to April 27, 1990. That interim response involved the transport and disposal of contaminated battery casings and ash to an appropriate disposal facility. The second response took place from June 7 to October 20, 1997. That response involved the removal of additional surface ash and debris piles, scrap metal, battery casings, building debris and contaminated soil.

   The Department has agreed to accept $187,500 in settlement of the Kerrigan's liability for past response costs at the Sites. Additionally, the Kerrigans have agreed to perform future operation and maintenance activities at the Ashland Metals Site.

   This notice is provided under section 1113 of HSCA (35 P. S. § 6020.1113). Section 1113 of HSCA provides that the settlement shall become final upon the filing of the Department's response to significant written comments. The proposed Consent Order and Agreement, which contains the specific terms of the settlement, is available for public review and comment. The proposed Consent Decree can be examined from 8 a.m. to 4 p.m. Monday through Friday at the Department's Northeast Regional Office located at 2 Public Square, Wilkes-Barre, PA 18711, by contacting Woodrow Cole at (570) 826-2511 or through the PA AT&T Relay Service at (800) 654-5984 (TDD). A public comment period on the proposed Consent Decree will extend for 60 days from today's date. The Department will accept written comments concerning the proposed Consent Order and Agreement until December 20, 2000.
