LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

Preamble 3
The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediations Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.
Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediations Standards Act (Act). Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Church Road, King of Prussia, PA 19406, has submitted a Final Report concerning remediation of site soil contaminated with lead, BTEX and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standards and was approved by the Department on September 21, 2000.
Airport Business Center, Tinicum Township, Delaware County. Susan L. Gordon, Farer Fersko, 600 South Avenue, P. O. Box 580, Westfield, NJ 07091-0580, has submitted a Final Report concerning remediation of site soil contaminated with heavy metals, pesticides and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standard and was approved by the Department on September 26, 2000.
Former Diamond Oil Property--Lot 2, City of Coatesville, Chester County. James Taylor, Taylor Geo Services, 341 Dartmouth Avenue, Swarthmore, PA 19081, has submitted a Baseline Remedial Investigation Report concerning remediation of site soil and groundwater contaminated with BTEX and polycyclic aromatic hydrocarbons. The report was approved by the Department on September 27, 2000.
2555 Street Road, LLC, Bensalem Township, Bucks County. Darryl D. Borrelli, Manko, Gold & Kathcher, LLP, 401 City Avenue, Suite 500, Bala Cynwyd, PA 19004, has submitted a Remedial Investigation/Final Report concerning remediation of site groundwater contaminated with solvents. The report demonstrated attainment of site-specific standards and was approved by the Department on October 4, 2000.
Heating Oil Partners, L. P./Gill Brothers Oil Co., Northampton Township, Bucks County. Sean M. Grexa, The Tyree Organization, Ltd., 1350 S. U. S. Highway 130, Burlington, NJ 08016, has submitted a Final Report concerning remediation of site soil contaminated with petroleum hydrocarbons and groundwater contaminated with BTEX. The report demonstrated attainment of site-specific standards and was approved by the Department on October 4, 2000.

E59-396. Encroachment. Pennsylvania Department of Transportation, Engineering District 3-0, 715 Jordan Avenue, Montoursville, PA 17754. To change the channel of Slate Creek; modify, operate and maintain an existing stream enclosure of Slate Creek; modify, operate and maintain existing stream enclosures of nine unnamed tributaries to the Tioga River; modify, operate and maintain an existing stream enclosure of Ellen Run; realign, operate and maintain the channel of Ellen Run; construct, operate and maintain a four span bridge across the Tioga River; modify, operate and maintain an existing stream enclosure of Kelly Creek for the construction of a limited access highway. The channel change and modification of the stream enclosure of Slate Creek shall be limited to a maximum waterway impact of 509-feet. The maintenance of the Ellen Run channel shall be in perpetuity with design cross-sections being maintained for a minimum of 400-feet downstream of the stream enclosure outlet. The bridge across the Tioga River shall be constructed with a minimum total span of 535-feet, underclearance of 49.8-feet, and skew of 56-degrees. The modifications at the stream enclosure of Ellen Run shall be limited to a maximum waterway impact of 400-feet. The modifications at the stream enclosure of Kelly Creek shall be limited to a maximum waterway impact of 190-feet. The modifications at the stream enclosures of the nine unnamed tributaries to the Tioga River shall be limited to a total waterway impact of 722-feet. Construction of SR 6015, Section E61 and Section F12 will result in the permanent impact to 0.60-acre of wetland and 1464-feet of waterway. Construction of SR 6015, Section E61 and Section F12 will result in the temporary impact to 2.33-acres of wetland and 20-feet of waterway. All permanent wetland impacts authorized by this permit shall be mitigated by the permittee through replacement wetlands at the Hilfiger site (0.60-acre). The 1434-feet of permanent impact to waterways authorized by this permit shall be mitigated by the permittee through the stream stabilization and riparian corridor restoration at Canoe Camp Creek. All waterway and wetland mitigation shall be constructed prior or concurrent with the activities authorized by this permit. This permit also authorizes the construction, operation and maintenance of temporary construction accesses across Waters of the Commonwealth; upon completion of the project, all construction accesses shall be removed and the areas restored to original contours, elevations, geometry and hydrology. The project is located along the eastern right-of-way of SR 0015 approximately 500-feet east of SR 0015 and SR 0006 intersection (Mansfield, PA Quadrangle N: 9.8 inches; W: 5.7 inches) in Mansfield Borough and Richmond Township, Tioga County. Public Hearing Notice The Department of Environmental Protection (DEP) will conduct a public hearing on Tuesday, December 12, 2000, beginning at 7 p.m. in the auditorium of Seneca Valley High School, 128 Seneca School Road, Harmony, PA, in response to an application from AK Steel Corp., Butler Works for discharge of treated industrial wastewater. This application is for renewal of a National Pollutant Discharge Elimination System (NPDES) permit to discharge the treated wastewater to Connoquenessing Creek in the City of Butler, Butler County. The NPDES application number is PA0006343. DEP personnel will be at Seneca Valley High School at 6 p.m. for a public availability session prior to the hearing.
Any person who wishes to present testimony at the hearing should submit a written notice of such intent to Pat Williams, Water Quality Program, DEP, 230 Chestnut Street, Meadville, PA 16335-3494, on or before December 5, 2000. The written notice should include the person's name, address, telephone number and a brief statement as to the nature of the testimony to be offered at the hearing. Testimony may be presented in either written or oral form. All testimony should be concise, to the point and relevant to the permit issue. Calendar Year 1999 Applications For Municipal Recycling Program Performance Grant ApplicationsThe Department of Environmental Protection (Department) announces an extension to the deadline for calendar year 1999 Recycling Program Performance Grant applications from municipalities for grant assistance under section 904 of the Municipal Waste Planning, Recycling and Waste Reduction Act (Act 101) (53 P. S. § 4000.904).
The deadline for submission of calendar year 1999 applications has been extended to 3 p.m., November 17, 2000. Applications must be on forms provided by the Department. Applications received by the Department after that date will not be considered. All grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.
