SEWAGE FACILITIES ACT PLAN APPROVAL Plan Approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

Benton Township, Lackawanna County and Nicholson Township, Wyoming County. This Plan Revision addresses a change in the proposed wastewater treatment plant site, which was previously selected in the Official Sewage Facilities Plan Update approved by the Department on July 31, 1997. The proposed treatment plant will be located at a site approximately 500 feet south east of the Lake Sheridan outlet. The treated effluent will be discharged into an unnamed tributary of the South Branch of Tunkhannock Creek. There are no other substantial changes to the previously approved plan, which calls for construction of a wastewater collection and conveyance system to serve the communities around Lake Sheridan, Baylor's Pond and Lake Kewanee. The design capacity of the proposed treatment plant is 0.140 mgd.
The Department's review of this plan revision has not identified any significant environmental impacts resulting from this proposal. The Department approved the plan on December 5, 2000.

Location: Taylorstown Area of Blaine Township and Buffalo Township, Washington County approximately 3 miles north of the intersection of S. R. 221 and Interstate 70.
Approval of an Official Sewage Facilities Plan Update of Blaine Township. The Plan proposes construction of a .030 mgd sewage treatment facility to be located 1/3 mile northwest of Taylorstown on S. R. 221. Discharge will be to Buffalo Creek, a high quality warm water fishery. The collection system consists of individual grinder pumps. The service area includes the Town of Taylorstown including Taylorstown Ridge Road, portions of Rural Valley Road northeast of Taylorstown, and S. R. 221 south to the Blaine Township/Buffalo Township border. The service area also extends into Buffalo Township to serve the Blaine Buffalo Elementary School. The Department's review of the Sewage Facilities Plan Update has not identified any significant environmental impacts resulting from this proposal.

Proposed Consent Order and Agreement
Avtex Adjunct Mercury Sites, O'Polka Site
Woodcock Township, Crawford County Under Section 1113 of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1305) (HSCA), the Department of Environmental Protection (Department) has agreed to a de minimis Consent Order and Agreement (Agreement) with the Heatrex, Inc., Frederick R. O'Polka and Gary Slezak (Settlers), concerning the resolution of their liability for the Avtex Adjunct Mercury, O'Polka Site (site). The site is located on a 75.5-acre parcel adjacent to Peters Road in Woodcock Township, Crawford County, PA.
Since 1995, mercury-containing wastes (wastes) were transported from the Avtex Fibers, Inc. facility in Vernon Township, Crawford County, PA for use as fill material to various locations. The site received wastes in conjunction with the construction of access roads used for timbering operations there. These wastes contaminated the environment at the site. Mercury in the wastes is defined in section 103 of HSCA (35 P. S. § 6020.103) as a ''hazardous substance''. The Department removed the wastes from the site for proper offsite disposal in April 2000, at a cost of approximately $17,000. That response mitigated the threat to human health and the environment posed by the wastes.
As an owner during the time of the release and threatened release of hazardous substances at the site, each of the Settlers is a ''responsible person'' as defined in section 103 of HSCA (35 P. S. § 6020.103). Under the terms of the Agreement, Settlers shall pay the Department $172.00 to resolve their liability at the site. The specific terms of this settlement are set forth in the Agreement between the Settlers and the Department. The Department will receive and consider comments relating to the Agreement for 60 days from the date of this Public Notice. The Department has the right to withdraw its consent to the Agreement if the comments concerning the Agreement disclose facts or considerations, which indicate that the Agreement is inappropriate, improper, or not in the public interest.
After the public comment period, the Department's settlement with the Settlers shall be effective upon the date that the Department notifies the Settlers, in writing, that this Agreement is final and effective in its present form, and that the Department has filed a response to significant written comments to the Agreement, or that no such comments were received.

Modification to Consent Orders and Agreements
Millcreek Dump Site
MIllcreek Township, Erie County Under section 122 of the Federal Comprehensive Environmental Response, Compensation and Liability Act of 1980 (42 U.S.C.A. § 9622) and section 1113 of the Hazardous Sits Cleanup Act (35 P. S. § 6020.1113), the Department of Environmental Protection (Department) has modified its 1995 and 1997 consent orders and agreements with Millcreek Township (Township) concerning the 84.5 acre Millcreek Dump Site (Site) in Erie County, PA.
From approximately 1970 until 1981, wastes containing hazardous substances were disposed at the Site. The 1995 and 1997 consent orders and agreements between the Department and the Township concerned the 4 acre parcel that the Township owns within the Site, and the 64.7 acre parcel that Conrail donated to the Township adjacent to the Site (Conrail property). Under these past agreements, the Township, among other things, paid the Department $1,000 in response costs and provided permanent easements for the construction of the landfill cap and flood retention basin at the Township and Conrail parcels.
The original Record of Decision for the Site called for a standard landfill cap over the wastes at the Site. However, the Department and the United States Environmental Protection Agency agreed to modify this remedy to provide for a recreation area at the Site, along with protecting the public and environment from the wastes at the Site. Specifically, the remedy was modified to allow for the construction of a golf course, tennis courts, ball fields and hiking trails on top of the landfill cap. The construction of this recreation area began this past summer.
On December 14, 2000, the Department entered into a proposed Consent Order and Agreement with the Township that modifies and replaces the 1995 and 1997 consent orders and agreements. Under the December 14, 2000 Consent Order and Agreement, almost all of the parcels located within the Site will be donated to the Township, and the Township will maintain the recreation area for public use in perpetuity. Upon donation of the parcels to the Township, the Department will terminate the liens that exist on some of the parcels at the Site as a result of the Department's past financial inability to pay settlements with the Sitter Brothers and Mr. and Mrs. Joseph Malmi.
The Department will receive and consider comments on the December 14, 2000 Consent Order and Agreement for 60 days from the date of this Public Notice. The Department has the right to withdraw its consent if the comments disclose facts that indicate that the December 14, 2000 Consent Order and Agreement with the Township is inappropriate, improper, inadequate or not in the public interest. After the public comment period, the December 14, 2000 Consent Order and Agreement shall become final and shall replace the 1995 and 1997 consent orders and agreements upon the filing of the Department's response to significant written comments (if any) to the December 14, 2000 Consent Order and Agreement.

Proposed Settlement under the Hazardous Sites Cleanup Act and the Comprehensive Environmental Response, Compensation and Liability Act
Hellertown Manufacturing NPL Site
Borough of Hellertown, Northampton County The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1304) (HSCA), has entered into a proposed consent decree in United States and the Commonwealth of Pennsylvania Department of Environmental Protection v. Federal Mogul, Inc. and Paikes Enterprises, Inc., Civil Action No. 00-4977 (E.D. PA). The proposed consent decree was lodged on October 3, 2000 with the United States District Court for the Eastern District of Pennsylvania. The consent decree resolves the claims of the Commonwealth of Pennsylvania against Federal Mogul, Inc. and Paikes Enterprises, Inc. under section 107(a) of the Comprehensive Environmental Response, Compensation and Liability Act, as amended (CERCLA), 42 U.S.C.A. § 9607(a) and section 507 of the HSCA (35 P. S. § 6020.507), for reimbursement of response costs incurred by the Department of Environmental Protection (Department) in connection with the Hellertown Manufacturing Site located in Hellertown, Northampton County, PA. Under the terms of the consent decree, the Department would receive $287,000 in costs incurred by the Department up to August 31, 1999 at the Site.
This notice is provided under section 1113 of HSCA (35 P. S. § 6020.1113) and 25 Pa. Code § 1021.120(d). The proposed consent decree is subject to final approval by the Department and the Court. The proposed consent decree containing the specific terms of the proposed settlement is available for public review and comment. The proposed consent decree can be examined from 8 a.m. to 4 p.m. at the Department's Northeast Regional Office at 2 Public Square, Wilkes-Barre, PA 18711-0790. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.
Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act (act). Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report, and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The report was submitted in partial fulfillment of a combination of the Statewide health and site-specific standards, and was approved on December 11, 2000.
ICI Explosives USA Inc.--Wakefield Property, Walker Township, Schuylkill County. URS Greiner Woodward Clyde, 1400 Union Meeting Road, Suite 202, Blue Bell, PA 19422-1920 and RBR Consulting, Inc., 650 Shady Drive, Beaver Falls, PA 15010 submitted a Remedial Investigation Report (on behalf of their client, ICI Explosives USA Inc., Tamaqua, PA) concerning the characterization of site soils and groundwater, and adjacent surface water and sediments, found or suspected to have been contaminated with lead and other metals, polycyclic aromatic hydrocarbons, polychlorinated biphenyls, and volatile organic compounds. The report was submitted in partial fulfillment of a combination of the Statewide health and site-specific standards, and was approved on November 10, 1999.

Bureau of Deep Mine Safety The Bureau of Deep Mine Safety (BDMS) has approved Rosebud Mining Company's request for a variance from the requirements of Section 242(c) of the Pennsylvania Bituminous Coal Mine Act at the Dutch Run Mine. This notification contains a summary of this request and the basis for the Department's approval. A complete copy of the variance request may be obtained from Allison Gaida by calling (724) 439-7469 or from the BDMS web site at http://www.dep.state.pa.us/dep/deputate/minres/dms/dms.htm.
Summary of the request: Rosebud Mining Company's requested a variance from Section 242(c) of the Pennsylvania Bituminous Coal Mine Act to allow for the common ventilation of belt conveyor entry with other entries at the Dutch Run Mine. The proposal accords protections to persons and property substantially equal to or greater than the requirements of Section 242(c).
The basis for the Bureau's approval is summarized as follows:
1. Dutch Run's plan provides for an advanced fire detection and control system consisting of CO monitors, thermal detectors and a fire suppression system.
2. Dutch Run's plan provides a separate intake escapeway that will be isolated from the belt conveyor entries. The isolated intake escapeway will be maintained at a higher ventilation pressure than the belt and common entries.
3. Dutch Run's plan provides for the belt and common entries to serve as an alternate intake escapeway.
4. There are significant health and safety benefits associated with allowing entries in common with the belt entry. Safer access is provided to workers performing repair and maintenance work in the belt entry. Improved visual safety inspections are facilitated by open crosscuts.
This approval is limited to a variance from the requirements in section 242(c) requiring that the belt entry is isolated from other entries. All other terms and requirements of section 242(c) shall remain in effect. This approval applies to all areas developed after May 20, 1998. Continued authorization for operation under the approval is contingent upon compliance with the measures described in Dutch Run's plan and the following conditions.
1. Operation, maintenance and calibration of the point CO (carbon monoxide) monitor system shall comply with the manufacturer's recommendation and DEP equipment approval number BOTE 1712-98.
2. At all times, Rosebud Mining Company shall comply with the requirements of the Mine Safety and Health Administration's (MSHA) approved Fire Fighting and Evacuation Plan.
3. Notification of DEP District Mine Inspector when the point CO monitor system has been installed.

Notice of Planning Grant Awards under Section 901 of the Municipal Waste Planning, Recycling and Waste Reduction Act The Department of Environmental Protection (Department) announces the following grants to counties under section 901 of the Municipal Waste Planning, Recycling and Waste Reduction Act (Act 101) (53 P. S. § 4000.901) and section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996). The awards listed here are based upon applications received by the Department in 2000.
Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.
