Notice of Intent to Request Release of Funds

On or about March 26, 2001, the Commonwealth of Pennsylvania, Department of Health will submit a request to the U. S. Department of Housing and Urban Development (HUD) for the release of Lead-Based Paint Hazard Control in Privately-owned Housing Grant Program funds under Section 1011 of the Housing and Community Development Act of 1992, (Public Law 102-550) for the following project: to identify, remove, and/or control lead-based paint hazards in eligible pre-1978 low and very low-income residential housing and premises; to integrate program activities with one or more community development corporations and/or non-profit organizations involved in housing weatherization, rehabilitation programs, and other local programs; and to provide temporary relocation for families displaced during certain types of lead hazard control work.
A total of approximately $1,464,384 of Federal assistance is required.
The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Pennsylvania Department of Health, Bureau of Family Health, Division of Maternal and Child Health, 2635 Paxton Street, Harrisburg. PA 17111, and may be examined or copied weekdays between the hours of 9:00 a.m. and 4:00 p.m.
Any individual, group, or agency may submit written comments on the ERR to the Pennsylvania Department of Health. All comments received by March 25, 2001, will be considered by the Pennsylvania Department of Health prior to authorizing submission of a request for release of funds.
RELEASE OF FUNDS The Pennsylvania Department of Health certifies to HUD that Clara Hartung, Deputy Secretary for Administration, in her official capacity as Certifying Officer, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Pennsylvania Department of Health to use Program funds for the project.
OBJECTIONS TO RELEASE OF FUNDS HUD will consider objections to its release of funds and the Pennsylvania Department of Health's certification for a period of fifteen days following either the anticipated submission date or HUD's actual receipt of the request (whichever is later) only if the objections are on one of the following bases (a) that the Certification was not executed by the Certifying Officer of the Pennsylvania Department of Health; (b) the Pennsylvania Department of Health has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58 before approval of a release of funds by HUD; (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and may be addressed to HUD as follows: U. S.
