LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 3
The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed. WATER OBSTRUCTIONS AND ENCROACHMENTS The Department of Environmental Protection has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. 1341(a)).

This work will include the removal of 150 linear feet of existing 36-inch CMP stream enclosure and impact to 225 linear feet of watercourse.
2. 42 linear feet of an 8-feet by 3-feet culvert across an unnamed tributary of the West Branch of Chester Creek (TSF), roadway approach, endwalls, storm water outfall, and riprap apron associated with an access road from S.R. 0202.
3. 128 linear feet of 24-inch by 38-inch HERCP stream enclosure, associated endwalls, storm water inlets, and riprap apron along an unnamed tributary of the West Branch of Chester Creek (TSF), and 0.04 acre of adjacent wetland (PSS) associated with an access road from S.R. 0202.
The project also includes the extension of one outfall structure which qualifies for a waiver of permit requirements according to § 105.12(a)(2), and the installation and maintenance of a sanitary sewer utility crossing within the proposed road crossing noted in Item 1 which qualifies for General Permit No. 5. The site is located approximately 1,000 feet southeast of the intersection of Baltimore Pike (S.R. 0001) and Wilmington West Chester Pike (S.R. 0202) (West Chester, USGS Quadrangle, N: 0.50 inch, W: 5.70 inches). Availability of Grants for the Remediation of Waste Tire Piles under the Waste Tire Remediation Grant Program for Municipalities for Fiscal Year 2001/2002 The Department of Environmental Protection (Department) hereby announces the availability of grants through the Waste Tire Recycling Act of 1996 (Act 190) for fiscal year 2001/2002 for the remediation of waste tire piles in this Commonwealth. The Waste Tire Remediation Grant Program for Municipalities provides a grant program, funded through the general fund. The grants are limited to only those municipalities having a waste tire pile containing 5,000 or more waste tires.
Only municipalities are eligible to participate and receive funding. To be considered for a grant, a municipality: 1) must propose to remediate a waste tire pile on the Department's list of priority waste tire piles or piles containing 5,000 or greater waste tires; 2) must not have contributed, in any manner, to the creation of a non-compliant waste tire pile; and 3) must have an identifiable end-use for the remediated waste tires.
Grant funds are intended for activities directly related to the remediation of waste tire piles (such as employee wages, operation of equipment, transportation, processing costs and the like). Grants may not be used for the purchase of equipment and grant recipients shall use the funds only for those activities approved by the Department.
All applicants must complete and submit an official two-part application for each proposed tire pile remediation. The Waste Tire Remediation Grant Application Parts A and B includes all the materials and instructions necessary for applying for a grant. Copies of these documents are available by contacting the Division of Municipal and Residual Waste at (717) 787-7381, or may be obtained electronically from the Department's Internet site at: http://www.dep.state.pa.us (type ''tires'' in directLINK). Six copies of the application containing both Parts A and B must be completed and submitted by 4 p.m. on June 15, 2001, to: Department of Environmental Protection, Division of Municipal and Residual Waste, 14th Floor-Rachel Carson State Office Building, 400 Market Street, P. At a minimum, all applications must contain: 1) a description of the applicant's or their contractor's experience in waste tire remediation, 2) markets or end-uses for the remediated tires, 3) a schedule for the remediation of tires at the site, 4) proposed cost of the waste tire pile remediation, and 5) any additional information the Department deems necessary. Follow the instructions in Part A and B Grant Application to assure that all of the necessary information is submitted in the correct format.

The following notification contains a summary of this request. The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Section 702 of the Pennsylvania Bituminous Coal Mine Act (Act) (52 P. S. §§ 701--702) provides a mechanism for operators to obtain variances from specific requirements of the Act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.
Section 228(a) of the Act, states that ''No person shall enter the mine until the mine examiners return to the mine office on the surface, or to a station located in the intake entry of the mine (where a record book as provided for in this section shall be kept in a fire-proof vault and signed by the person making the examination), and report to the mine foreman or the assistant mine foreman, by telephone or otherwise, and a written report made thereof by the person receiving the report, that the mine is in safe condition for the men to enter. When a station is located in any mine, it shall be the duty of the mine examiners to sign also the report entered in the record book in the mine office on the surface.''
Summary of the Request: Eighty Four Mining Company requests a variance to allow Mine 84 to maintain two records of each examination that is called out to a portal the examiner is not exiting from. One record will be maintained as called out at one portal and a second matching record signed by the certified examiner and maintained where they exit the coal mine. This request is only for completed records for persons called out to one portal and exiting at a second portal.
Approval of Request for Variance The Department of Environmental Protection, Bureau of Deep Mine Safety (BDMS) has approved Rosebud Mining Company's request for a variance from the requirements of section 242(c) of the Pennsylvania Bituminous Coal Mine Act (Act) (52 P. S. §§ 701--702) at the Twin Rocks Mine. This notification contains a summary of this request and the basis for the Department's approval. Summary of the Request: Rosebud Mining Company requested a variance from section 242(c) of the Act to allow for the common ventilation of belt conveyor entry with other entries at the Twin Rocks Mine. The proposal accords protections to persons and property substantially equal to or greater than the requirements of section 242(c).
The basis for the Bureau's approval is summarized as follows:
1. Twin Rock's plan provides for an advanced fire detection and control system consisting of carbon monoxide (CO) monitors, thermal detectors, and a fire suppression system.
2. Twin Rock's plan provides a separate intake escapeway that will be isolated from the belt conveyor entries. The isolated intake escapeway will be maintained at a higher ventilation pressure than the belt and common entries.
3. Twin Rock's plan provides for the belt and common entries to serve as an alternate intake escapeway.
4. There are significant health and safety benefits associated with allowing entries in common with the belt entry. Safer access is provided to workers performing repair and maintenance work in the belt entry. Improved visual safety inspections are facilitated by open crosscuts.
This approval is limited to a variance from the requirements in section 242(c) of the Act requiring that the belt entry is isolated from other entries. All other terms and requirements of section 242(c) shall remain in effect. This approval applies to all areas developed after May 20, 1998. Continued authorization for operation under the approval is contingent upon compliance with the measures described in Twin Rock's plan and the following conditions:
1. Operation, maintenance and calibration of the Model LTPA-98 Point CO Monitor System shall comply with the manufacturer's specifications and DEP equipment approval number BOTE 1712-98.
2. At all times, Rosebud Mining Company shall comply with the requirements of the Mine Safety and Health Administration's (MSHA) approved Fire Fighting and Evacuation Plan.
3. Notification of DEP District Mine Inspector when the point CO monitor system has been installed.
