NOTICES

Nationwide Mutual Insurance Company, et al.; Doc. No. RT01-03-033

   On March 19, 2001, Nationwide Mutual Insurance Company, Nationwide Mutual Fire Insurance Company, Nationwide Property and Casualty Insurance Company, and Nationwide General Insurance Company (collectively Petitioners or Nationwide) filed an appeal and request for hearing on the denial by the Insurance Department (Department) of the companies' proposed modified Uninsured/Underinsured Motorists Coverage Endorsements. The Petitioners also requested waiver of the time in which a hearing must be held under 40 P. S. § 477b. A presiding officer has been appointed and the parties and interested persons ordered in part as follows:

   1.  Proceedings for Nationwide filings are consolidated under the single docket number RT01-03-033.

   2.  The Petitioners' application for waiver is granted. A hearing, if necessary, will be scheduled at a future time upon the agreement of the parties or following request by the Petitioners that a hearing be scheduled.

   3.  A prehearing telephone conference initiated by the Administrative Hearings Office is scheduled for June 8, 2001, at 10 a.m. The telephone conference will include the parties in the Appeal of Erie Insurance Company et al., Docket Number RT00-11-024. If all parties in both actions agree that the prehearing conference will be in person rather than by telephone, counsel shall so notify the Administrative Hearings Office by June 5, 2001, and the prehearing conference will be held at 901 North Seventh Street Room 200, Harrisburg, PA 17102.

   4.  At the prehearing conference, the parties shall be prepared to discuss the possible consolidation of this matter with Docket Number RT00-11-024, additional prehearing procedures, the necessity and timing of an evidentiary hearing, stipulations, settlement and such other matters to aid in the orderly conduct and disposition of these proceedings. No prehearing statement is required at this time.

   5.  On or before May 15, 2001, the Petitioners shall file a concise statement of the appeal, setting forth in numbered paragraphs the statutory and regulatory provisions which the appellant asserts are applicable to the instant appeal and the statutory, regulatory and industry standards alleged to have been violated by disapproval of the subject policy forms.

   6.  The Department shall be prepared to answer the numbered allegations set forth in the Petitioners' submissions within 7 days following the prehearing conference if so directed by the presiding officer.

   7.  Petitions to intervene and notices of intervention shall be filed on or before May 8, 2001.
