LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   For further information concerning the plans and reports, contact the Environmental Cleanup Program Manager in the Department of Environmental Protection Regional Office under which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed. Box 2100, Valley Forge, PA 19482-2100, has submitted a Final Report concerning the remediation of site soil contaminated with BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide Health Standard and was approved by the Department on June 5, 2001.

   24th and Fairmount Streets Site, City of Philadelphia, Philadelphia County. Frank Lynch, Enviro Link, Inc., 165 Daleville Rd., Cochranville, PA 19330, on behalf of the 2336 Corp., 2336 Fairmount St., Philadelphia, PA, has submitted a Final Report concerning the remediation of site soil contaminated with solvents. The report was submitted within 90 days of the release of the contaminant. The report demonstrated attainment of the Statewide Health Standard and was approved by the Department on June 7, 2001.

   Northwest Region: Environmental Cleanup Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   Bradford Refinery--Crude Tank Farm, 77 North Kendall Avenue, Bradford, PA 16701, County of McKean, City of Bradford and Aaron D. Svitana, Enviro-Sciences Inc., 2944 Hunter Mill Road, Suite 104, Oakton, VA 22124 on behalf of Bradford Refinery had submitted a Remedial Investigation and Risk Assessment Report concerning remediation of soil, groundwater, surface water and sediment contaminated with lead, heavy metals, solvents, BTEX, PHCs and PAHs. The report did not document remediation of the site to meet the Background, Statewide Health and Site Specific Standards and was disapproved by the Department on June 4, 2001.

   96-027:  Delaware Valley Wool Scouring Co. (3419 Richmond Street, Philadelphia, PA 19134) issued a revised Synthetic Minor Operating Permit on June 8, 2001, to correct a mistake in establishing conditions of the permit for their facility in the City of Philadelphia, Philadelphia County. The Synthetic Minor facility's particulate air emission sources do not vent outside and have now been classified as insignificant activities in the permit. These sources include a bale breaker/blender controlled by a baghouse, two cone dusters controlled by a baghouse, a squirrel cage controlled by a baghouse and a compressor/baler controlled by a baghouse. Subsequent emission limitations, work practice standards, testing requirements, monitoring requirements and recordkeeping requirements have been removed for these sources.

This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E59-414.  PA Department of Transportation, 715 Jordan Avenue, Montoursville, PA 17754. SR 49 Bridge Over Cowanesque River, in Westfield, Tioga County, ACOE Baltimore District (Potter Brook, PA Quadrangle N:  6.8 inches; W:  12.5 inches).

   To remove the existing structure and to construct, operate and maintain a reinforced concrete box beam bridge structure with a clear span of 94 feet and a width of 23 feet over the Cowanesque River. The application also proposes authorization to construct a temporary stream crossing to facilitate a detour around the project area. This temporary crossing is proposed to be located 150 feet downstream of the current bridge and would consist of seven 96 inch diameter corrugated metal culvert pipes and associated fill. This project is located three miles west of Westfield on SR 0049.

   To amend permit E04-241 which authorized the construction and maintenance of a 78 inch corrugated metal pipe (depressed 12 inches) 219 feet long, to construct and maintain four outfall structures in a tributary to Wallace Run (WWF) and to place and maintain fill in approximately 0.3 acre of wetlands (PFO) for the purpose of providing access to a proposed retail development site. The project is located on the north side of Route 51 approximately 3,000 feet northwest of its intersection with Route 251 (New Galilee, PA Quadrangle N:  5.3 inches; W:  1.2 inches) in Chippewa Township, Beaver County. The permit also includes a review of an Environmental Assessment for a proposed nonjurisdictional dam. The permit amendment will include the construction and maintenance of seven new outfall structures, the placement and maintenance of fill within the floodplain, the placement and maintenance of fill in 0.7 acre of wetlands (PEM) and the operation and maintenance of an existing temporary stream crossing. To meet the wetland replacement requirement the applicant proposes to construct 0.65 acre of replacement wetlands (PEM) and to pay into the wetland replacement fund to 0.2 acre of wetland.

The Department's review of the project and the information received has not identified any significant, adverse environmental impact resulting from this proposal. The Department hereby categorically excludes this project from the State Environmental Review Process.
