On July 18, 2001, the Independent Regulatory Review Commission (Commission) received this regulation from the Insurance Department (Department). This rulemaking adds 31 Pa. Code Chapter 67b. Notice of proposed rulemaking was omitted for this regulation; it will become effective upon publication in the Pennsylvania Bulletin.
This rulemaking establishes the terms and conditions under which insurers in the Pennsylvania Assigned Risk Plan (Plan) must give notice to participants insured under the Plan that they are eligible for a mandatory offer of coverage in the voluntary market from their assigned carrier.
We have determined this regulation is consistent with the statutory authority of the Department (75 Pa.C.S. § 1741) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
