Notice of Prompt Interim Response
Marvec Manufacturing Site, Upland Borough, Delaware County The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) has initiated a prompt interim response at the Marvec Manufacturing Site. This response has been initiated under sections 501(a) and 505(b) of the HSCA (35 P. S. §§ 6020.501(a) and 6020-505(b)). The site is located at 115 Sixth Street, Upland Borough, Delaware County, PA.
The site consists of a large industrial building that was abandoned in 2000. The site has been under investigation by the Department since it was discovered to be abandoned in February of 2001 on a routine inspection by the Department's Waste Management Division. Based upon the findings of the investigation the Department determined that a large number of drums containing hazardous materials had been abandoned in the basement of the site. The Department has also determined that process vats still contain liquids that contain hazardous materials.
As part of the investigation activities at the site, sampling of the main process vats were collected and analyzed for metals. The analysis revealed that the vats contained highly caustic bases and toxic metals. The Department also determined that approximately 40 drums containing corrosive sludge and 60 drums containing waste quenching oils were abandoned in the basement of the facility.
On June 25, 2001, a site visit was conducted with a consulting firm to assess the condition of the site and the drums. At that time the Department determined that the drums containing corrosive caustic sludge were beginning to show signs of corrosion. The security of the building was questionable with many windows broken and unlocked during the site visit.
The Prompt Interim Response Action consists of stabilization and sampling followed by off-site transportation and disposal of hazardous materials in drums and lab pack containers at the site as well as proper reuse, recycling, or disposal of empty drums and containers off-site. The action also consists of pump and cleanout of the process vats. The Department chose to conduct a prompt interim response at the site because of the condition of the drums and the nature of materials stored in the basement. Conditions at the site created a reasonable basis to believe that prompt action was required to protect public health and safety under 25 Pa. Code § 3.21(b).
The Department determined that a prompt interim response under the authority of sections 501(a) and 505(b) of HSCA was the most environmentally sound and protective alternative for the site. The Department considered taking no action at the site and determined that taking no action would not have addressed or resolved the threat to public health and the environment associated with the site.
The administrative record (AR) which contains the information that forms the basis for and documents the selection of this response action, is available for public review and comment Monday through Friday from 8 a.m. to 5 p.m. at the Department's Southeast Regional Office located at Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428. A second copy of the AR is available for public inspection at the Upland Borough Hall located at 224 Castle Avenue, Upland, PA, from 9 a.m. to 9 p.m. Monday through Thursday and from 9 a.m. to 5 p.m. Friday and Saturday.
Written comments concerning the Department's response and the information contained in the AR will be accepted in person, if delivered, or by mail, if postmarked on or before November 30, 2001. In addition, the public will have the opportunity to present oral comments at a public hearing. The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)).
Except as otherwise noted, the Department certifies that the construction and operation herein described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State Water Quality Standards.
Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, P. O.
