PUBLIC WATER SUPPLY PERMIT

   Under the Pennsylvania Safe Drinking Water Act, the following parties have applied for a public water supply permit to construct or substantially modify a public water system.

   Persons wishing to comment on a permit application are invited to submit a statement to the office listed before the application within 30 days of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. Comment responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held after consideration of comments received during the 30-day public comment period.

   Following the comment period, the Department will make a final determination regarding the proposed permit. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

   The permit application and any related documents are on file at the office listed before the application and available for public review. Arrangements for inspection and copying information should be made with the office listed before the application.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 1


Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard or who intend to remediate a site as a special industrial area, must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of the cleanup standards or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

   Under sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period the municipality may request that the person identified, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved and comments, should be directed to the remediator of the site.

   For further information concerning the content of a Notice of Intent to Remediate, contact the Environmental Cleanup Program Manager in the Department Regional Office listed before the notice. If information concerning this acknowledgment is required in an alternative form, contact the Community Relations Coordinator at the appropriate regional office listed.    American Refining Group--Indianola Plant, Indiana Township, Allegheny County. AIR QUALITY

NOTICE OF PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

NEW SOURCES AND MODIFICATIONS

   The Department of Environmental Protection (DEP) has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for DEP, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

   DEP has received applications for plan approvals and/or operating permits from the following facilities.

   Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office identified in this notice. Persons interested in reviewing the application files should contact the appropriate regional office to schedule an appointment.

   Persons wishing to receive a copy of the proposed Plan Approval or Operating Permit must indicate their interest to the DEP regional office within 30 days of the date of this notice and must file protests or comments on a Proposed Plan Approval or Operating Permit within 30 days of the DEP providing a copy of the proposed document to that person or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that a hearing be held concerning the proposed plan approval and operating permit. Any comments or protests filed with DEP regional offices must include a concise statement of the objections to the issuance of the plan approval or operating permit and relevant facts, which serve as the basis for the objections. If DEP schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

   42-197A: M&M Royalty, LTD, Irishtown Processing Plant (Route 307, Lewis Run, PA 16738) for construction of a compressor, dehydrator and extraction plant located in Lafayette Township, McKean County. The facility is subject to the New Source Performance Standards (NSPS) of 40 CFR Part 60 Subpart KKK pertaining to Standards of Performance for Equipment Leaks of VOC From Onshore Natural Gas Processing Plants.

   62-141A: NFG Supply Corp.--Roystone Compression Station (Route 6, Star Route Box 574, Sheffield, PA 16347) for minor modification of Plan Approval 62-329-004A to increase CO and NMHC emissions in Sheffield Township, Warren County. The facility is a Title V Facility.

   24-131D: SGL Carbon, LLC (900 Theresia Street, St. Marys, PA 15857) for installation of a dust collector and construction of a bulk bag loading station in St. Marys, Elk County. The facility is a Title V facility.

   06-03091: The Rose Corp. (P. O. Box 15208, Reading, PA 19612-5208) for construction of a paint spray booth and a grit blast booth in the City of Reading, Berks County. This is a non-Title V facility. The operation has the potential to annually emit about 7.1 tons of VOC and 3.7 tons of HAPS. The plan approval will contain additional emission, monitoring, record keeping, reporting and work practice standards designed to keep the facility within applicable requirements.

   07-05036: Tarmac-It Materials, Inc. (515 West 17th Street, Tyrone, PA 16686) for installation of a bituminous concrete batch plant controlled by a fabric collector at the Tyrone Plant in Snyder Township, Blair County. This is a non-Title V facility. The plan approval will contain both annual production and hourly operational conditions limiting the emissions of nitrogen oxides below 5 tons per year. The plan approval will include emission restrictions, work practice standards, monitoring, record keeping and reporting requirements designed to keep the source operating within all applicable air quality requirements.

   59-399-013: Truck-Lite Co., Inc. (R. R. 7 Box 942, Wellsboro, PA 16901) for construction of two wave soldering machines and eight associated hand soldering stations in Wellsboro Borough and Charleston Township, Tioga County.

   The two wave soldering machines and eight associated hand soldering stations have the potential to emit 5.98 tons of volatile organic compounds per 12 consecutive month period, 0.17 ton of lead per 12 consecutive month period and 0.77 ton of hazardous air pollutants (including lead) per 12 consecutive month period.

   The Department has determined that the proposed equipment will comply with all applicable regulatory requirements pertaining to air contaminant sources and the emission of air contaminants including the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12. The Department consequently intends to issue plan approval for the installation of the respective equipment. Additionally, if the Department determines that equipment is operating in compliance with all applicable plan approval conditions and regulatory requirements following their construction, the conditions established in the plan approval will be incorporated into an operating permit.

   The Department intends to place conditions in the plan approval to be issued pertaining to the operation and monitoring of the two wave soldering machines and eight hand soldering stations. These conditions are intended to assure proper operation of the equipment as well as maintenance of compliance with all applicable air quality regulatory requirements. The following is a summary of these conditions:

   1.  The company shall not use more than 800 gallons of flux or 800 gallons of thinner or 3.6 tons of solder paste in the two wave soldering machines and eight associated hand soldering stations during a 12 consecutive month period.

   2.  The eight hand soldering stations shall not use more than 2 tons of solder per 12 consecutive month period or use a solder that contains a lead content greater than 40% by weight.

   3.  The two wave soldering machines shall not use more than 3.6 tons of solder per 12 consecutive month period or use solder that contains a lead content greater than 35% by weight.

   4.  The company shall keep monthly records of the amount of each solder, flux and thinner that is used in association with the two wave soldering machines and eight hand soldering stations.

   49-309-007K: Meckley's Limestone Products, Inc. (R. D. 1 Box 1682, Herndon, PA 17830-9799) for construction of a 1,000 ton capacity pulverized limestone storage silo, incorporating a bulk tank truck loadout spout and associated air cleaning device (fabric collector) in Lower Mahanoy Township, Northumberland County.

   The air contaminant emissions from the new limestone silo will be controlled by a new fabric collector, while the air contaminant emissions from the bulk tank truck loadout spout will be controlled by an existing fabric collector. The maximum potential for air contaminants to be emitted into the atmosphere from the exhaust of the new fabric collector is 0.38 ton of particulate matter in any 12 consecutive month period. There will be no increase in any air contaminant emissions from the existing fabric collector.

   The Department has determined that the proposed storage silo, truck loadout spout and associated fabric collector will comply with all applicable regulatory requirements pertaining to air contaminant sources and the emission of air contaminants including the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12. The Department consequently intends to issue plan approval for the construction of the respective equipment. Additionally, if the Department determines that equipment is operating in compliance with all applicable plan approval conditions and regulatory requirements following its construction, the conditions established in the plan approval will be incorporated into an operating permit via administrative amendment under 25 Pa. Code § 127.450.

   The Department intends to place conditions in the plan approval to be issued pertaining to the operation and monitoring of the storage silo, bulk tank truck loadout spout and associated fabric collector. These conditions are intended to assure proper operation of the equipment as well as maintenance of compliance with all applicable air quality regulatory requirements. The following is a summary of these conditions:

   1.  The loadout spout shall be used to load tank trucks only; no open top trucks are to be loaded with this loadout spout. When not in use, the loadout spout shall be gated or valved off from the fabric collector.

   2.  The new fabric collector exhaust shall not contain particulate matter in excess of 0.02 grain per dry standard cubic foot of exhaust.

   3.  The fabric collectors shall be equipped with instrumentation to continuously monitor the differential pressure across the collector. The air compressor supplying compressed air to the fabric collectors shall be equipped with an air dryer and oil trap.

   4.  The company shall keep onsite a sufficient quantity of spare fabric collector bags for the fabric collectors in order to be able to immediately replace any bags requiring replacement due to deterioration resulting from routine operation of the sources and fabric collectors.

   5.  No more than a total of two bulk loadout spouts controlled by the fabric collector associated with the loadout spout approved herein shall be in simultaneous use at any given time.

   18-313-018C:  Avery Dennison Chemical Division (US) (R. R. 2, Box 70, Mill Hall, PA 17751) for construction of a reactor and several pieces of chemical processing equipment and for the modification of a reactor and several pieces of chemical processing equipment in Bald Eagle Township, Clinton County. These sources may potentially result in the emission of 0.742 ton per 12 consecutive month period of volatile organic compounds, 0.631 ton of which may also be hazardous air pollutants. A preliminary review of the information submitted by Avery Dennison Chemical Division (US) indicates that the sources will meet all applicable air quality requirements including the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12. Based on this finding, the Air Quality Program intends to approve the application and issue a plan approval to construct/modify the sources. Additionally, if the Department determines that the sources are operating in compliance with all applicable plan approval conditions and regulatory requirements, the conditions established in the plan approval will be incorporated into an operating permit via administrative amendment in accordance with 25 Pa. Code § 127.450.

   In order to ensure compliance with all applicable air quality standards, the Department proposes to place the following conditions in the respective plan approval:

   1.  The air contaminant emissions from all sources shall be controlled by an existing Yorkaire ''vertical 500 cfm'' thermal fume oxidizer and an existing Con-Serve model #1500-M3 thermal fume oxidizer.

   2.  The sources shall be covered at all times during use and shall not be vented to atmosphere other than through the two thermal fume oxidizers except as may be allowed under condition 5 herein.

   3.  No more than 40 cfm shall be vented to either one of the thermal fume oxidizers. If the sources identified herein and the sources identified in Operating Permit 18-313-018B are, in total, venting in excess of 40 cfm, both thermal fume oxidizers must be in use, except as may be allowed by condition 5 herein.

   4.  The thermal fume oxidizers, when in use, shall be operated so that the oxidizer exit gas temperature is at least 1600°F at all times, except as may be allowed under condition 7 herein.

   5.  The thermal oxidizers may be bypassed or operated at a temperature of less than 1600°F for up to 30 minutes per month, during which time the reactors and chemical processing equipment may continue to operate. The permittee shall maintain accurate records of all occurrences and shall provide these records to the Department upon request.

   6.  The outlet temperature of the thermal fume oxidizers shall be continuously monitored and recorded. These records shall be retained onsite for at least 5 years and made available to the Department upon request.

   7.  The products produced in the new reactor (R-800) shall be water-based polymer or copolymer products used as adhesives, coatings or resins, manufactured from a monomer mixture containing no more than 37% vinyl acetate by weight (measured as a percentage of total monomer content), containing no monomer with a vapor pressure higher than vinyl acetate and containing no halogenated solvents. Additionally, production in reactor R-800 shall not exceed 876 batches per calendar year.

   8.  Modified reactor R-700 may be used to produce solvent-based polymer or copolymer products used as adhesives, coatings or resins, as described in the application and supplemental materials submitted for this plan approval. Reactor R-700 may also continue to be used to produce water-based polymer or copolymer products used as adhesives, coatings or resins, in accordance with the provisions of condition 13 of Operating Permit 18-313-018B. The production rate of both solvent-based and water-based products shall, in total, never exceed 876 batches per year.

   9.  The use of any hazardous air pollutants differing from those described in any applicable plan approval application must be approved by the Department, in writing, prior to their use.

   49-310-007:  Central Builders Supply Co. (P. O. Box 152, Sunbury, PA 17801) for construction of a new wet sand and gravel processing plant in West Chillisquaque Township, Northumberland County.

   The plant will incorporate various crushing, conveying and screening equipment. Particulate matter emissions from the wet sand and gravel processing equipment are expected to be minimal due to the moist nature of the initial material being processed and the water which will be applied throughout the process. The main entrance/exit road of the facility will be concreted or paved in order to reduce any possible road dust.

   The Department has determined that the proposed wet sand and gravel processing plant will comply with all applicable regulatory requirements pertaining to air contaminant sources and the emission of air contaminants including the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12. The Department consequently intends to issue plan approval for the construction of the respective equipment. Additionally, if the Department determines that equipment is operating in compliance with all applicable plan approval conditions and regulatory requirements following its construction, the Department intends to issue an operating permit.

   The Department intends to place conditions in the plan approval to be issued to assure proper operation of the equipment as well as maintenance of compliance with all applicable regulatory requirements. The following is a summary of these conditions:

   1.  If at any time it is determined that the air contaminant emissions from the crushing, screening, conveying and the like, equipment are in excess of any applicable air contaminant emission limitations, the company shall install water spray dust suppression nozzles and/or take other control measures as are necessary to reduce the air contaminant emissions to within the applicable limitations.

   2.  The air contaminant emissions from the wet sand and gravel plant shall comply with the applicable requirements specified in Subpart OOO of the Federal Standards of Performance for New Stationary Sources, 40 CFR 60.670--60.676.

   3.  No generators or engines shall be constructed.

   4.  The company shall have onsite an operable water truck equipped with a pressurized spray bar to be used, as needed, for the prevention and control of fugitive air contaminant emissions from the roadways, stock piles, truck loading activities and so on.

   37-023C:  Orion Power MidWest, LP, New Castle Plant (Route 168, New Castle, PA 16101) for installation of selective noncatalytic reduction on Boiler Unit Nos. 3, 4 and 5 in New Castle, Lawrence County. The facility currently has a Title V Operating Permit No. 37-00023. This plan approval will, in accordance with 25 Pa. Code § 127.450, be incorporated into the Title V operating permit through an administrative amendment at a later date. This installation will result in no increase in air emissions.

Box 2621, Harrisburg, PA 17105) for the administrative amendment to Title V Operating Permit No. 07-05004 for the Altoona Terminal to incorporate Tank 30, storage tank for gasoline and distillate, installed as per Plan Approval 07-05004A, in Allegheny Township, Blair County. This change will increase the facility's VOC potential by 3.8 tpy. The facility's major sources of emissions include loading racks and storage tanks which primarily emit VOC. The Title V operating permit will contain monitoring, record keeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

   67-03086:  Electro-Platers of York, Inc. (209 East Willow Street, Wrightsville, PA 17368) for operation of metal plating systems in Wrightsville Borough, York County. Emission sources at the facility include plating tanks and wet scrubbers. A decorative chrome plating tank is subject to 40 CFR Part 63, Subpart N-- National Emission Standards for Chromium Emissions from Hard and Decorative Chromium Electroplating and Chromium Anodizing Tanks. The natural minor operating permit will contain monitoring and record keeping requirements designed to keep the facility operating within all applicable requirements.

   The air contaminant emissions from the boiler are controlled by a multiclone flyash collector. The boiler will emit particulate matter at a rate of up to 4.88 pounds per hour, nitrogen oxides at a rate of up to 1.3 pounds per hour and carbon monoxide at a rate of up to 21.95 pounds per hour.

   The Department has determined that the respective boiler was constructed and is operating, in conformance with all conditions of Plan Approval 08-302-042 as well as with all applicable regulatory requirements including the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12. The Department consequently plans to issue an operating permit for the boiler.

   The Department intends to place conditions in the operating permit to be issued which are intended to assure proper operation of the boiler and continued compliance with all applicable regulatory requirements and plan approval conditions. The following is a summary of these conditions:

   1.  The emission of particulate matter, nitrogen oxides and carbon monoxide shall not exceed .3 pound, .08 pound and 1.35 pounds per million BTU of heat input, respectively.

   2.  The boiler shall only be fired on green or kiln-dried wood. No coated or treated wood, laminated wood, particleboard, flakeboard or materials other than green or kiln-dried wood shall be burned.

   3.  All wood fuel placed in the storage silo associated with the boiler shall be blended at a consistent ratio to avoid fuel stratification and consequent boiler combustion upsets.

   4.  The multiclone collector shall be equipped with a differential pressure gauge.

   5.  The multiclone collector ash discharge system shall remain sealed from the open air except when changing collection drums and the level of accumulated ash in the collection drum shall be checked daily.

Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

   Written comments or objections or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--83.34 (relating to public notices of filing of permit applications, opportunity for comment and informal conferences).

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the previous, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the previously-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   3.  To install and maintain a 5-foot wide by 750-foot long gangway.

   4.  To install approximately 25 mooring bollards.

   5.  To modify and maintain the existing facility by installing a security fence, guard house, fender system, sewage grinder pump system, steam generator, sewage holding tanks, trash receptacle, crane tie down pins and various utility connections.

   This work will utilize a total of 200 various diameter pipe piles with a total impact area of approximately 300 sq.ft in the river.

The project is located along the southside of Crackersport Road, at the northwest corner of the intersection of S.R. 0022 and the Pennsylvania Turnpike Northeast Extension (Allentown West, PA Quadrangle N:  17.5 inches; W:  10.0 inches).

   E58-243. Pennsylvania Department of Transportation, Engineering District 4-0, P. O. Box 111, Scranton, PA 18501, in Rush Township, Susquehanna County, U. S. Army Corps of Engineers, Baltimore District.

   To remove the existing structure and to construct and maintain a road crossing of a tributary to Deer Lick Creek (CWF), consisting of a 15.0-foot x 7.0-foot precast concrete box culvert, with its invert depressed 1.0-foot below streambed elevation. The project includes a temporary road crossing of the tributary, including a 0.03-acre wetland impact. The project is located along S.R. 0267, Section 574, approximately 1.1 miles southeast of the intersection of S.R. 0267 and S.R. 0367 (Lawton, PA Quadrangle N:  4.3 inches; W:  8.0 inches).

The upstream limit of the channel excavating and maintenance is at the confluence of Sandy Lick Creek and Laborde Branch; the downstream limit of the channel excavating and maintenance is at Clearfield/Jefferson County line.
