LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

PREAMBLE 2
The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.
For further information concerning the final report, contact the Environmental Cleanup Program Manager in the Department Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed. The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of 25 Pa. Code § 250.8, administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Former Harris Residence, City of Harrisburg, Dauphin County. ARM Group, Inc., 1129 West Governor Road, Box 797, Hershey, PA 17033-0797 (on behalf of Shipley Energy Company, 550 East King Street, Box 946, York, PA 17405) submitted a Final Report concerning remediation of site soils contaminated with PHCs. The final report demonstrated attainment of the Statewide Health standard, and was approved by the Department on October 11, 2001.
Northwest Region: Environmental Cleanup Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.
Greater Erie Industrial Development Corporation (GEIDC), 254 Lytton Ave., Pittsburgh, PA 15213, the former Currie Landfill site, West 16th St., Millcreek Township, Erie County and Pat Pontoriero, P.G., Harding ESE, 700 North Bell Ave., Bldg. 4, Pittsburgh, PA 15106 had submitted a Work Plan concerning remediation of soil, groundwater and surface water. The Work Plan was approved by the Department on March 20, 2001, and did demonstrate attainment of the Statewide Health and Site Specific Standard.

World Resources Company, Inc. is a treatment and storage facility for selected metal finishing and the production of nonferrous and precious metal concentrate products from the recycling of electroplating wastewater treatment sludges. This permit is for the waste receiving areas and process areas that are completely enclosed within a structure, which is designed to provide control of the material and shielding from the wind and weather. The permit was issued in the Regional Office on October 1, 2001.

Nitrogen Oxides (NOx) Allowance Program

Code §§ 123.101--123.120 The Department of Environmental Protection (Department) has issued an Operating Permit that includes allocations under the provisions of 25 Pa. Code §§ 123.101--123.120 (relating to NOx allowance requirements). These regulations establish a NOx budget and a NOx allowance trading program for NOx affected sources for the purpose of achieving the health-based ozone ambient air quality standard.
Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)).
Except as otherwise noted, the Department certifies that the construction and operation herein described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State Water Quality Standards.

To construct and maintain three streams and wetland crossings associated with the construction of a collector road connecting Newtown Street (S.R. 0252) a Bishop Hollow Road by tying into the existing Stoney Brook Boulevard. The crossings are as follows:
1. To install and maintain 124 linear feet of open bottom, precast box culvert with a 33-foot clear span and an underclearance minimum of 4 feet 6 inches spanning Hunter Run (CWF), and impacting 0.17 acre of wetlands (PFO).
2. To install and maintain 80 linear feet of open bottom, precast box culvert with an 18-foot clear span and an underclearance minimum of 3 feet 7 inches spanning an unnamed tributary to Hunter Run and impacting 0.32 acre of wetlands (PFO).
3. To install and maintain 84 linear feet of a precast arch bridge with a clear span of 35 feet 4 inches and a rise of 10 feet 2 inches spanning an unnamed tributary to Hunter Run, and impacting 0.17 acre of wetlands (PFO).
The work associated with Springton Pointe Woods Phase 4 also includes the installation and maintenance of 70 linear feet of 10-foot wide by 4-foot high concrete, three-sided box culvert crossing an unnamed tributary of Hunters Run for Wiltshire Lane. This crossing qualifies for a waiver of permit requirements under § 105.12(a)(2) which will be solely constructed and maintained by Pulte Homes Corporation. Work for Phase 3 and Phase 4 of the development also includes the installation and maintenance of various utility lines that cross Hunter Run and its tributaries, including gas lines, cable TV lines, electric lines, water mains, sanitary sewer lines and storm sewer lines that will be done in accordance with the conditions for General Permit No. 5 (Utility Line Stream Crossing).
The site is located approximately 3,300 feet southeast of the intersection of S.R. 0252 and S.R. 0003 (Media, PA Quadrangle N: 18.7 inches; W: 3.3 inches). The permittee has agreed to provide 0.68 acre of replacement wetlands.

This work includes the construction of a temporary bypass roadway, which will be converted into a bike/pedestrian trail after construction. The activity is associated with Phase II of the Whitemarsh Township Storm Drainage Improvement Project located approximately 600 feet northeast of the intersection in West Valley Green and Cricket Road (Germantown, PA Quadrangle N: 19.35 inches; W: 13.90 inches).

Public Notice of the Renewal and Availability of NPDES General Permit No. PAG310001 for Discharges from Stripper Oil Well Facilities The Department of Environmental Protection (Department), by this notice, announces the availability of the final general NPDES permit for discharges from Stripper Oil Well Facilities. The general permit is now available for use by eligible new and existing operations that need a permit in accordance with Pennsylvania's NPDES regulations. The draft general permit was published in the Pennsylvania Bulletin for public comment on September 8, 2001. No comments were received.
The final general NPDES permit and notice of intent (NOI) will be posted on the Department website at http://www.dep.state.pa.us/dep/deputate/minres/oilgas/oilgas.htm.

Request for Variance The Department of Environmental Protection (Department), Bureau of Deep Mine Safety (BDMS), has received a request for variance from R & R Mining, Inc. The following notification contains a summary of this request. A complete copy of the variance request may be obtained from Allison Gaida by calling (724) 439-7469 or from the BDMS website at http://www.dep.state.pa.us/dep/deputate/minres/dms/dms.htm.
The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the BDMS to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice. Comments should be addressed to Richard E. Stickler, Director, Bureau of Deep Mine Safety, Fayette County Health Center, 100 New Salem Road, Room 167, Uniontown, PA 15401.
Section 702 of the Bituminous Coal Mine Act (52 P. S. § 702) provides a mechanism for operators to obtain variances from specific requirements of the Act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.
Section 273(b) states that all conveyor entries shall be provided with a minimum width and height of not less than 4 feet for travel; but in conveyor entries in which track is installed, the minimum amount of clearance width shall not be less than 2 1/2 feet, which clearance width shall be continuous throughout the entry. All travel space and clearance space shall be kept free of all forms of obstruction under foot, and free from electric wires and electric cables.
Summary of the Request: R & R Mining, Inc. requests a variance to allow for clearance along belt lines at the #73 Mine.
