Clean Water State Revolving Fund Projects; Public Hearing on Federal FY 2002 and 2003 Project Priority List and FY 2002 Intended Use Plan
[32 Pa.B. 128] The Pennsylvania Infrastructure Investment Authority (PENNVEST) and the Department of Environmental Protection (DEP) have prepared a combined Federal fiscal year 2002 and 2003 wastewater construction Project Priority List (PPL) and the fiscal year 2002 Intended Use Plan (IUP) list of municipal wastewater projects to be considered for a construction loan from funds Pennsylvania expects to receive from fiscal year 2002 funds approved by Congress to capitalize the Clean Water State Revolving Fund (CWSRF) program.
The projects included on the PPL have a project priority rating under DEP's regulations in Chapter 103 (relating to financial assistance) concerning project priority rating system, and as such, regulations have been approved by Environmental Protection Agency (EPA) for such purpose. The Clean Water Act stipulates that States must maintain a PPL of municipal wastewater projects from which to develop the annual CWSRF IUP list of projects to be funded.
Projects listed on the FY 2002 IUP list are on Pennsylvania's CWSRF PPL and are expected to proceed to construction in the near future. Other projects on the PPL are projects that are in development or will be developed for future construction loan consideration. Any project removed from an IUP is maintained on the PPL unless otherwise completed.
A project must appear on the approved IUP before it can receive a loan from the CWSRF. The CWSRF IUP was developed in accordance with the ranking criteria listed in section 10(b) of the Pennsylvania Infrastructure Investment Authority Act (35 P. S. § 751.10(b)). These ranking criteria differ somewhat from the DEP regulations in Chapter 103, as does the methodology used to evaluate projects. In addition, a project's readiness to proceed and the reasonable availability of alternative funds also have a bearing on project selection for the IUP. Consequently, the rank ordered list of projects on the PPL does not dictate the order in which they will be chosen for inclusion in the IUP.
The CWSRF will be capitalized with approximately $52.8 million of Federal FY 2002 funds from the EPA and $12.8 million of State funds. In addition, some $11.1 million of deobligated Title II construction grant funds will be transferred to the Title VI CWSRF loan program. These funds will be available as loan funds for projects on the IUP. Some $38.9 million of CWSRF loan repayments will be used to allow additional project funding opportunities on the FY 2002 IUP. The FY 2002 CWSRF IUP has 34 municipal wastewater construction projects listed with a total dollar value of approximately $113 million. Some $2.6 million of the Federal FY 2002 funds will be set aside for program administration costs. A public hearing will be held, as described in this notice. After the public hearing and assessment of the comments received, the final FY 2002 CWSRF IUP will be completed; potentially, it may include other projects from the CWSRF PPL.
Federal guidance and regulations on development of the CWSRF PPL and Intended Use Plan direct that the lists be subject to public comment and review before being submitted to the EPA.
The DEP has scheduled a public hearing for 10 a.m., February 20, 2002, in the Auditorium of the Rachel Carson State Office Building, located at 400 Market Street, Harrisburg, PA. The hearing is scheduled for the purpose of receiving comments from the public regarding the combined fiscal year 2002/2003 CWSRF PPL and the FY 2002 CWSRF IUP. Interested persons are invited to express their views at the public hearing. Persons wishing to offer comments should contact the Administrative Services Section, Division of Municipal Financial Assistance, Bureau of Water Supply and Wastewater Management, 10th Floor, Rachel Carson State Office Building, P. O. Box 8466, Harrisburg, PA 17105-8466, (717) 787-6744, or by Internet e-mail (amaisano@state.pa.us) by 4 p.m., February 19, 2002. Where written statements are prepared and will be submitted at the hearing, speakers will be asked to restrict the oral portion of the statement to a summary of the written comments. Speakers will be called to present their comments generally in the order of receipt of the notice of intent to appear at the hearing.
It is not necessary to appear at the public hearing to present comments. Interested persons may submit written comments to the DEP at the address shown previously. The written comments will be considered equivalent to oral statements presented at the hearing. To be considered by the DEP and PENNVEST, the written comments must be received by the Administrative Services Section on or before the date of the hearing.
