PUBLIC WATER SUPPLY PERMITS The Department of Environmental Protection (Department) has taken the following actions on applications received under the Safe Drinking Water Act for the construction, substantial modification or operation of a public water system.
Persons aggrieved by these actions may appeal, under section 4 of the Environmental Hearing Board Act (35 P. The flow from the existing homes will be conveyed to the WWTP via the Palmer Township Municipal Sewer Authority's North Intercepting Sewer, the Forks Township Municipal Sewer Authority's Bushkill Creek interceptor and downstream wastewater conveyance facilities in the City of Easton. The PTMSA conveyance facilities have adequate capacity for the additional wastewater flow and Palmer has adequate reserve capacity allocation in the downstream conveyance and treatment facilities for the projected flow of this project.

HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF OCTOBER 18, 1988
Proposed Consent Order and Agreement
Tri-State Petroleum Recovery Site, Kennedy Township, Allegheny County Under section 1113 of the Pennsylvania Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305), the Department of Environmental Protection (Department) has entered into a Consent Order and Agreement (CO&A) with Tri-State Petroleum Recovery, Inc. and Stanley Cieslak, Jr. (Consenting Parties) concerning a site investigation of the Tri-State Petroleum Recovery Site (Site).
In the past, hazardous substances were disposed of at the Site and these substances contaminated the environment at the Site. The Department is undertaking an investigation of the Site to determine what threat to human health and the environment the hazardous substances they pose. Stanley Cieslak, Jr. is the owner and operator of the Site. The Consenting Parties are ''responsible parties'' as defined in section 103 of HSCA. Under the terms of the CO&A, the Consenting Parties shall remit to the Department, on a monthly basis, reimbursement of those costs the Department expends in investigating and remediating the Site. The Consenting Parties shall continue making these payments until they have made reimbursement in full to the Department in settlement of its share of responsibility for the cleanup of the Site.
The specific terms of this settlement are set forth in the CO&A between the Department and Consenting Parties. The Department will receive and consider comments relating to the CO&A for 60 days from the date of this public notice. The Department has the right to withdraw its consent to the CO&A if the comments concerning the CO&A disclose facts or considerations which indicate that the CO&A is inappropriate, improper or not in the public interest. After the public comment period, the Department's settlement with the Consenting Parties shall be effective upon the date that the Department notifies the Consenting Parties, in writing, that this CO&A is final and effective in its present form and that the Department has filed a response to significant written comments to the CO&A or that no comments were received.

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The final report demonstrated attainment of the Statewide Health standard and was approved by the Department on February 14, 2002.
Madison Square Furniture, Borough of Hanover, York County. Alliance Environmental, 1414 North Cameron Street, Harrisburg, PA 17103 (on behalf of Madison Square Furniture, West Elm Street, P. O. Box 65, Hanover, PA 17331) submitted a combined remedial investigation and final report concerning the remediation of site soils and groundwater contaminated with PCBs, solvents, BTEX, PHCs and PAHs. The combined report demonstrated attainment of a combination of the Statewide Health and Site-Specific standards and was approved by the Department on February 20, 2002.
Esbenshade Residence, Elizabeth Township, Lancaster County. Earth Data Northeast, Inc., 924 Springdale Drive, Exton, PA 19341 (on behalf of Lamar Esbenshade, 619 East 28th Division Highway, Lititz, PA 17543) submitted a final report within 90 days of a release concerning remediation of site soils contaminated with benzene, toluene, ethylbenzene, cumene, fluorine, naphthalene and phenanthrene. The final report demonstrated attainment of the Statewide Health standard and was approved by the Department on February 22, 2002.
Penn Fuel Gas Shippensburg, Borough of Shippensburg, Cumberland County. Corporate Environmental Solutions, LLC, 260 Miller Run Road, Bridgeville, PA 15017 (on behalf of PPL, Two North Ninth Street, Allentown, PA 18101-1179) submitted a risk assessment concerning the remediation of site soils and groundwater contaminated with lead, BTEX, PAHs and phenolic compounds. The report was approved by the Department on February 22, 2002.

Corporate Environmental Solutions, LLC, 260 Miller Run Road, Bridgeville, PA 15017 (on behalf of PPL, Two North Ninth Street, Allentown, PA 18101-1179) submitted a remedial investigation report concerning the remediation of site soils and groundwater contaminated with heavy metals, BTEX, PAHs, phenol compounds and cyanide. The report was approved by the Department on February 22, 2002.

The Remedial Investigation Report was approved by the Department on January 31, 2002.

Gary Antoinette, Geologic Services Corporation, 129 McCarrell Lane, Suite 2B, Zelienople, PA 16063 (on behalf of Exxon Mobil Corporation, 220 Commerce Drive, Suite 205, Ft. Washington, PA 19034) has submitted a Remedial Investigation Report concerning the remediation of site soil and groundwater contaminated with lead, BTEX and MTBE. The Remedial Investigation Report was disapproved by the Department on February 11, 2002.
