Addition of Substances Subject to Registration
[32 Pa.B. 3044] The Noncontrolled Substances Reporting and Registration Act (act) (35 P. S. §§ 881--888) provides that any manufacturer, wholesaler, retailer or other person who is engaged in the sale, distribution, transfer or furnishing of any substance covered by the act shall register with the Secretary of Health (Secretary).
The act enumerates various substances which are subject to registration, itemizes what information is required to be reported to the Secretary, itemizes what records are required to be kept by the registrants and provides for penalties for failure to comply with the act.
The act also permit the Secretary, by notice, to add to the list of substances subject to registration. The act requires that notice be sent to every person known to the Secretary to be engaged in the sale, distribution, transfer or furnishing of these substances.
In addition to the notice as required by the act, the Secretary is also publishing this notice so that persons engaged in the sale, distribution, transfer or furnishing of these substances, not known to the Secretary, will also be informed of the registration and record keeping obligations.
Currently, there are 32 substances subject to the provisions of the act. Accordingly, the Secretary hereby adds the following four substances to the list of substances subject to the provisions of the act:
(33) Red phosphorus
(34) White phosphorus
(35) Hypophophites
(36) Hypophosphorus acid
The Secretary believes that these substances are being used or could be used in the illegal manufacture of controlled substances or in the illegal sale of controlled substances.
