FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between the hours of 8 a.m. and 4 p.m. on each working day at the office noted before the application.

To replace and maintain the River Road Bridge across approximately 50 feet of Mill Creek (TSF) and to perform associated roadway improvements. The proposed structure is a prestressed concrete spread box beam bridge with a single clear span of approximately 25.31 meters (83.04 feet) and an underclearance of approximately 1.24 meters (4.07 feet). The crossing is located along Mill Creek at River Road approximately 150 downstream from the Schuylkill Expressway (I-76) Crossing (Norristown, PA Quadrangle N: 8.2 inches, W: 0.9 inch).

The site is located approximately 250 feet northeast of the intersection of Easton Road (SR 611) and Meetinghouse Road (Ambler, PA USGS Quadrangle, N: 10.4 inches, W: 1.0 inch). This project is also associated with the Meetinghouse Road widening project consisting of a proposed stream enclosure extension on the upstream end (Application No. E46-911).

To fill a total of 0.21 acre of wetlands to extend Runway 7-25 a length of 300 feet to meet Federal Aviation Administration Safety Standards. The project is located approximately 1.7 miles southeast of the intersection of SR 310 and SR 830. Wetlands to be impacted by this project are upslope and to the east of the existing Runway 7-25 and west of the headwaters of Kyle Run (HQ-CWF). The project includes creation of 0.21 acre of replacement wetlands approximately 900 feet south of the existing wetlands and to construct and maintain two 40-foot long, 2-foot diameter corrugated polyethylene pipe culverts in Kyle Run to create a stream crossing to access the wetland replacement area.

Certification Request initiated by Reliant Energy Mid-Atlantic Power Holdings, LLC (REMA), 1001 Broad Street, P. O. Box 1050, Johnstown, PA 15907-1050. Piney Hydroelectric Project (FERC Project No. 309-PA), in Piney Township, Clarion County, ACOE Pittsburgh District (Clarion, PA Quadrangle N: 12.125 inches; W: 8.125 inches).
Project description: REMA has requested a Section 401 State Water Quality Certification for the operation of the Piney Hydroelectric Project (Project) near the Borough of Clarion in Clarion County. This request supercedes a previous Certification Request published at 31 Pa.B. 1406 (March 10, 2001). The Project currently operates as a peaking/load-regulating dam with restrictions on the summer and winter impoundment drawdown levels and minimum conservation releases. Under the current mode of operation, water is released from the Project during periods of power generation and when the storage capacity of the reservoir is exceeded. Minimum conservation releases of 100 cfs from May 1 to October 31 and two 4-hour blocks of 500 cfs from November 1 to April 30 are also provided during periods of nongeneration. REMA proposes modifying the current mode of Project operation by operating in a run-of-river (ROR) mode from April 1 to June 20 annually. Under ROR operation, reservoir levels would be held constant and Project releases would approximately equal Project inflow at all times with no peaking or pulsing. Conservation releases would be increased to 158 cfs from June 21 to October 31 and certain additional water releases would be provided to enhance summer drift-boating opportunities. REMA also requests authorization to lower reservoir pool levels by 1 additional foot in the summer to enhance electricity generation capabilities. Project operation would remain essentially unchanged during the rest of the year.

APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS The following parties have submitted: (1) Notices of Intent for Coverage under (1) General NPDES Permits to Discharge Wastewater into the Waters of the Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations. Monitoring, reporting requirements and other conditions set forth in the general permit: (2) General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in this Commonwealth; (3) General NPDES Permit Authorizing the Discharge of Stormwater Associated with Construction Activities to Waters of the Commonwealth; (4) Notification for First Use Application of Sewage Sludge.
The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. The Department of Environmental Protection approves the following coverage under the specific General Permit.
The EPA Region III Administrator has waived the right to review or object to this permit action under the waiver provision 40 CFR 123.23(d).
The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.
