PUBLIC WATER SUPPLY PERMITS The Department of Environmental Protection has taken the following actions on applications received under the Safe Drinking Water Act for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

The Department requests that the Borough and the Authority immediately take all actions necessary to revise the Borough's Official Sewage Facilities Plan.

Approval of Request for Variance The Department of Environmental Protection (Department), Bureau of Deep Mine Safety (Bureau) has approved Genesis, Inc.'s request for a variance from the requirements of section 242(c) of the Pennsylvania Bituminous Coal Mine Act (act) at the Genesis No. 17 Mine. This notification contains a summary of this request and the basis for the Department's approval. Summary of the Request: Genesis, Inc. requested a variance from section 242(c) of the act to allow for the common ventilation of belt conveyor entry with other entries at the Genesis No. 17 Mine. The proposal accords protections to persons and property substantially equal to or greater than the requirements set forth in the act.
The basis for the Bureau's approval is summarized as follows:
1. The plan provides for an advanced fire detection and control system consisting of CO monitors and a fire suppression system.
2. The plan provides a separate intake escapeway that will be isolated from the belt conveyor entries. The isolated intake escapeway will be maintained at a higher ventilation pressure than the belt and common entries.
3. The plan provides for the belt and common entries to serve as an alternate intake escapeway.
4. There are significant health and safety benefits associated with allowing entries in common with the belt entry. Safer access is provided to workers performing repair and maintenance work in the belt entry. Improved visual safety inspections are facilitated by open crosscuts.
This approval is limited to a variance from the requirements in section 242(c) of the act requiring that the belt entry is isolated from other entries. All other terms and requirements of section 242(c) of the act shall remain in effect. This approval applies to all areas developed after May 20, 1998. Continued authorization for operation under the approval is contingent upon compliance with the measures described in the plan and the following conditions:
1. Operation, maintenance and calibration of the Pyott-Boone's CO Monitor System shall comply with the manufacturer's recommendation and the Department equipment approval number BOTE 1070-89.
2. The mine operator shall comply with the Mine Safety and Health Administration's approved Fire Fighting and Evacuation Plan.
3. The mine foreman shall notify the Department District Mine Inspector when the point CO monitor system has been installed.
4. The designated surface person responsible for responding to alarms from the CO monitor system should be task trained in the procedures utilized for notifying all affected mine personnel should an alarm occur.
5. The investigating committee shall confirm that the intake escapeway is maintained at a higher pressure than the belt conveyor entry and commons entries.
6. A test button should be installed to allow a daily function check of the pole-mounted alarm system.
7. The pole-mounted visual warning device located on the surface should be a revolving strobe that is clearly visible to the loader operator under all conditions.
8. The pole-mounted audio alarm located on the surface should be noticeably different from back up alarms currently in use on the property and clearly noticeable to the loader operator.
9. Verification by the Department District Mine Inspector that the plan is implemented according to the mine operator's submitted plan and this approval.
Plan Revision Approval under the Municipal Waste Planning Recycling and Waste Reduction Act Northcentral Region: Waste Management Program Manager, 208 West Third Street, Williamsport, PA 17701.
The Department of Environmental Protection (Department) approved a revision to the Potter County Municipal Waste Management Plan on June 7, 2002.
